Section 0. Preamble -

We the senate affirm that poor writing of laws has once again led to the denial of much needed service, and the rendering of a failed operative clause. The National Defence Force is effectively useless due to bad writing on the part of the National Security Act.

Section 1. Operation and Clearance -

The National Defence Force shall be operated under the Ministry of Interior during states of emergency and under the Ministry of Defence during times of invasion. The President in his power a Commander in Chief is fully able to order the deployment and operation of the NDF.

The NDF may operate as a domestic police force with full powers as a law enforcement agency. They may only fulfill this roll during a state of emergency.

1.1. Operation as a Police Force - During a state of emergency.

NDF members while operating as a police force during a state of emergency must be clearly designated by a black armband with in white lettering MP designating them as Military Police. Keeping with the spirit of remaining a Military organization.

The NDF may detain any person for 24 hours during a state of emergency. Though, if said person detained has a legal case that the detainment was unneeded may bring up a case to the courts. Arresting officers will be dismissed and possibly face criminal charges upon the cases success.

Strikes out and renders null Section 4 of the National Security Act and replaces it with the following: (a) The National Defense Force (NDF) shall be established to protect against foreign invasion and insurrection and civil unrest.
(1) The NDF shall be divided into an Army, Navy, and Air Force, including a Military Police.
(2) The NDF shall be an all volunteer military, and no provision of this act shall allow conscription, except for during a time of war with approval of a senate vote brought to motion by any sitting senator.
(3) The NDF shall not be used for domestic law enforcement except upon the declaration of a state of emergency by the relevant authority with power to do so.
(4) NDF personnel shall not be quartered in private homes without the consent of the occupants.
(5) The NDF is presently authorized to hold a maximum strength of 150,000 uniformed officers and enlisted persons.

Hereby passes into law this act.
