[PASSED] Cannibalism Act

This contains text adapted from States of Glory's Convention on Cannibalism, as they have released the draft for public use. States of Glory is, to that end, credited as a co-author. The exception in Section 1a.ii refers to practices such as the Catholic Mass; as mentioned in States of Glory's thread, I am not personally keen on singling out a particular religion or practice.

Believing the non-consensual consumption of a person's body to be a violation of their dignity; and

Seeking to thus restrict cannibalism to ensure a minimum standard of consensuality and transparency in the practice;

The World Assembly enacts as follows.

  1. Definitions. The following provisions must be followed in interpretation of this resolution.
    1. "Person-sourced meat" refers to organs or tissues originating from a natural person or any meat derived therefrom, where produced, distributed, or otherwise used for the purpose of consumption as food.
      1. Personhood for the purpose of this definition shall be decided by the jurisdiction in which the meat is produced, subject to any exclusions or inclusions specified by section 1a.ii or other World Assembly law.

      2. In this resolution, "natural person" excludes supernatural entities or deities.
    2. "Cannibalism" refers to the act of knowingly and wilfully consuming person-sourced meat, regardless of whether the individual from whom the meat is sourced is alive at the time of consumption.

    3. "Entities" includes individuals.

  2. Production. Person-sourced meat may not be produced absent the affirmative and notarised written consent of every person from whom it was produced.

    1. Any act of homicide or bodily harm committed with the intent of producing person-sourced meat in a manner violating this section shall be prosecuted to the fullest extent possible as homicide or battery (or charges to the same end).

    2. Consent for production of such meat is not required only if (i) such meat is produced for immediate consumption as food where such consumption is absolutely necessary to prevent starvation of the consumer in a current or imminent emergency and (ii) no act of bodily harm or homicide was performed for the purpose of producing such meat.
  3. Consent. Individuals possess the right to withdraw section 2 consent, limit section 2 consent to specific organs or tissues, and determine whether such consent shall be limited to while they are alive or after their death. Consent is void if obtained by coercion, as a result of external material incentives, or without the consenter's full awareness of what they are consenting to.

  4. Distribution. No entity may provide person-sourced meat to another entity without having clearly informed the recipient of the nature of such meat as person-sourced. Any entity providing person-sourced meat to another entity must retain proof of section 2 consent, including the original written consent where possible, and provide it to competent authorities as well as the recipient of such meat on demand.

  5. Trade restrictions. Every member nation must prohibit all international trade and transshipment of person-sourced meat not compliant with this resolution, regardless of whether such meat is produced within World Assembly jurisdiction. A member nation shall be liable under this section if that nation chooses to allow violation of this section within its jurisdiction.

  6. Blocker. The World Assembly disclaims all authority to impose additional restrictions on cannibalism or person-sourced meat, excepting restrictions limited to the scope of
    1. informing individuals about the health and other risks of cannibalism;

    2. restricting the distribution of person-sourced meat likely to contain, or not tested for, or is not tested for, any contaminant, prion, or other substance which would pose a significant health risk to the intended or final consumer; or

    3. restricting consumption or distribution of person-sourced meats produced in a manner violating section 2.

  7. Contradiction. If a provision of this resolution contradicts some past World Assembly resolution still in force, that past resolution takes precedence.

Believing the non-consensual consumption of a person's body to be a violation of their dignity; and

Further noting that consumption of sapient meat can carry negative health risks for the consumer, making the sale of such meat illegitimate, profiting off danger to consumers;

The World Assembly enacts as follows.

  1. Definitions. The following provisions must be followed in interpretation of this resolution.
    1. "Person-sourced meat" refers to organs or tissues belonging to a sapient being as defined by national law, or any meat derived from such. To avoid prohibiting legitimate religious practices, "sapient being" excludes supernatural entities or deities for the purpose of this definition.

    2. "Cannibalism" refers to the act of knowingly and wilfully consuming person-sourced meat, regardless of whether the individual from whom the meat is sourced is alive at the time of consumption.

  2. Production. The World Assembly hereby prohibits the production of any person-sourced meat, unless every individual from whom the meat is sourced has provided their express written consent. Any act of homicide or bodily harm committed with the intent of producing person-sourced meat in a manner violating this Section shall be prosecuted to the fullest extent possible as murder or battery (or equivalent charges).

  3. Consent. Individuals shall possess the right to limit Section 2 consent to specific organs or tissues as well as to determine whether such consent shall be limited to while they are alive and/or after their death, in which case any breach of such restrictions shall be treated as described in Section 2. Consent shall be considered void if it was obtained by coercion, or without the consentee being fully aware of what they are consenting to.

  4. Sale restrictions. No entity may provide person-sourced meat to another entity in exchange for material profit, or without having clearly informed the recipient of the nature of such meat as person-sourced. Every member nation must fully embargo all international trade of person-sourced meats. Further, every member nation must proscribe the use of its territory to transport person-sourced meats for trade purposes. This applies regardless of whether said person-sourced meats were produced under the jurisdiction of the World Assembly.

  5. Blocker. The World Assembly disclaims all authority to impose additional restrictions on cannibalism or person-sourced meat, excepting restrictions limited to the scope of

Should a provision of this resolution contradict some past World Assembly resolution still in force, that previous resolution takes precedence.

So to be clear, you are making it illegal for member states to prohibit cannibalism and acting as though this is somehow a legitimate use of WA legislation?

Dr Justin Obama, Deputy Minister of Foreign Affairs: Please justify why cannibalism warrants international intervention from the World Assembly. The dignity of a person who does not even realise whats happening is not a good enough reason for member nations to be forced to expend this many resources on catching cannibals and prevent trade (even the trade of legitimate sources of human meat).

Also, a bone is a tissue.

As to the main point, there is not only the dignity issue, but also the health issue. The selling of person-sourced meat inherently profits off danger to consumers, and such exploitation ought to be prohibited -- not even only in communist nations. This is why the trade and sale restrictions exist. In terms of non-consensual sourcing of cannibal meats, member nations naturally have to comply to the best of their ability, as per GA #654, and member nations can obviously still allocate their law enforcement resources as is best, as long as good faith compliance is maintained. The only case where the 'fullest extent possible' provision applies is in cases of murder and battery of living individuals."

Okay, I assume when you say "member states" you mean "the WA" then which is quite the ambiguous phrasing. I would suggest directly referring to the WA instead.

Dr Justin Obama, Deputy Minister of Foreign Affairs: Almost every meat will cause danger to consumers, regardless of whether it came from people or not. As long as you are able to thoroughly cook and clean it, health dangers are mitigated. Why is it human meat that is proscribed in this way?

There is no safe or moral way to consume human meat. As we see nothing in this to offend other sapient beings, we support and wish you godspeed. Having now read "person-sourced meats" multiple times, we have all resolved to go and have a long think about our choice of career. -MSD@WAGA

Well now hold on, that's just not true. If I am having a leg amputated due to injury, you'd better believe me and some adventurous pals are gonna cook and eat whatever bits of it we can.

Okay, all kidding aside yes it is. If your statement was "there is no safe or moral way to consume human meat" I provided a manner which is both safe AND moral. The existence of a counterexample to your claim indicates your claim is in need of revision, Ambassador.
