To the WA ICC

While we are sad that the ICC was not able to try mr. Ken Bradley we will not deprive this glorious court the opportunity to attend, and possibly participate, in the quendi held case against mr. Bradley. I am sure that he himself will also be happy to see some people who wishes for him to have a fair trial as I doubt that there will be many there that would care if he was innocently convicted (ooc: http://forum.nationstates.net/viewtopic.php?f=5&t=59281)

I believe that is something we need to discuss as part of procedures. It wouldn't be just if a judge resigned. It would also have to take into account people losing interest and not showing up any more.

Here is what I was thinking: we could have a period to time to allow nominations, then a separate thread for the election of a candidate(s) by existing judges. If there is not enough judges, then it would be first come first served.

By the way I have set up my profile at the external forum.

You should set up your chambers also, it is sort of like a way that we can telegram one another on the external forum. It is also an opportunity to detail a bit about your character through what they have in their office.

Done, honoured ambassador, although we preferred a "simplicity" approach.

Simple... Yet effective. Like the sleekest of marketting campaigns.

People's Republic of Victoriosa
Provisional Committee of the Revolution

Bearing in mind the recomendations of the judges of the ICC, the Provisional Committee of the Revolution has authorised the following statement on the matter of legal representation in the trial of Mr. Rye:

Whilst we understand the concerns of judges within the ICC to avoid a potentially volatile situation in the People's Republic, we feel that this is unlikely to be avoided whether legal representation is from Victoriosa or abroad. We also feel that a case brought by the government of the People's Republic should be pursued by the People's Republic. Nonetheless, in the interests of ensuring international neutrality and fairness in the court of law, we would be prepared to accept the defence attorney for Mr. Rye to be appointed by a neutral third-party nation of the judge's choice. However, we continue to insist upon the prosecution being undertaken by a representative of the government of the People's Republic.

I can perfectly understand your desire to prosecute him yourself but I also respect that you are willing to compromise in the interests of International Law.

- Timmy Van Der Mallet, Judge.

I will be happy to take up his cause with candour and enthusiasm. I will need to be allowed to contact him if I am accepted. If you however feel that I am not from a neutral enough third party nation, though we are totally neutral and have no diplomatic ties to anyone, then I will understand your concern.

After due deliberation, we find the appointment of Mr Maullet the Third to be acceptable as the Defence Attorney of Mr. Rye. You will be given the ability to contact Mr. Rye in whatever means you require; he is currently being held under house arrest by military units of the Victoriosan People's Army at one of his former Presidential abodes.

A quick thought from Martha Abjol: We should probably "recruit" more defense attorneys, in the case of ours being absent, we couldn't continue to receive cases until Mister Von Maullet returned. It would be most prudent assemble a team, rather than an individual.

Plus, I doubt your bisexual, thus making it nigh impossible for us to date.

Eduard Heir vs. the Peoples of Unibot, Phanelmgm, Antarctic Oasis and the World

Image

ICC Case Application:

Prosecutor (individual, state, or "the nation of"):
    Unibot Labor Union (ULU)
Prosecution Lawyer:
    Benjamin M. Palmer jr.
Other Prosecution Info:
After growing months of tension, a labor union between the employees of Heir Industries Inc. and the Corporatocracy of Unibot have taken the opportunity of the ICC’s creation to trial and imprison the multibillionaire corporate executive officer of Unibot, Eduard Heir, for numerous human and civil rights abuses.
Defendant (and nationality):
    Eduard Heir, Unibotian
Defense Lawyer:
    Benjamin M. Palmer jr.
Crimes that the Defendant is charged with:
  • Patent infringement on numerous products, most notably patented pharmaceuticals: Protosemxica™, Dopopodozaic™, Tribronopripotontoese™ and Montopropornozoriac™.
  • Polluting Outer Space with the current nuclear weapon testing program for Heir Industries arranged to be executed outside of the orbital zone by decree of Eduard Heir.
  • Attempted murder against Sir Joesph Queene IV of the Unibotian Monarchy and second-degree murder of the Unibotian actor, Louis Arthur Fenchané.
  • Proliferating biological, nuclear and landmines, and other weapons to non-member nations, terrorists and pirates under the disguise of ‘Heir Industries’ being legally separate from the Corporatocracy of Unibot.
  • Sexual harassment of Ms. Harper, Ms. Hall and other female ambassadors of the World Assembly.
  • Attempting to prohibit industry unions and systems of socioeconomic dissension in Unibot.
  • Impeding a Homicide Investigation by hiding the body of his late father-in-law in the Stranger’s Bar’s refrigerator.
  • Labor Income Violations, as employees of Heir Industries are paid well below the Basic Poverty Line. (Average Annual Income: $13,861 (2010 est.))
  • Child Labor Income Violations, as employees of Heir Industries as young as five work in Heir Industries’ manufacturing facilities with their education generally being limited to a standard brochure.
  • Unethical pharmaceutical testing, as Heir Industries has gone as far as to poison large masses of people with air-dispersion techniques in rural areas of Unibot.
  • Environmental negligence, with the defendant supposedly authorizing the oceanic acidification of Antarctic Oasis (with the notable exception of the Aundotutunagirian territorial zone) that damaged the ecosystem and the local fishing industry.
  • Further environmental and corporate negligence, as a uranium trade agreement concluded with the destruction of the Phanelmgm indigenous peoples and an endangered species of sentient trees that was local to the area.
  • International piracy, with a history of drug trafficking.
  • Preventing legal drug trafficking in an attempt to increase revenue from other regions,
  • Public nudity in several occasions, most notably outside of a tropical fish store in Stash Kroh, and an evasion of court proceedings related to said crimes.
  • Stealing Vice Ambassador Pascal Wagner’s green fountain pen, and Antarctic Oasis's commendation.
Charge Punishment (Fine, imprisonment, etc.):
The prosecution seeks a quadruple lifetime sentence in maximum security incarceration, with no chance of parole for the defendant for the noncompliance to the following resolutions:

[ Noncompliance to the General Patent Charter ] (GA#93)
[ Noncompliance to the Protection of Outer Space ] (GA#63)
[ Noncompliance to the Biological Weapons Conference ] (GA#65)
[ Noncompliance to the Nuclear Arms Possession Act ] (GA#10)
[ Noncompliance to the Landmine Convention ] (GA#40)
[ Noncompliance to the WA Labor Relations Act ] (GA#43)
[ Noncompliance to the Living Wage Act ] (GA#21)
[ Noncompliance to the Restrictions on Child Labor ] (GA#4)
[ Noncompliance to the Universal Clinical Trials Act ] (GA#82)
[ Noncompliance to the Endangered Species Protection ] (GA#66)
[ Noncompliance to the Convention Against Genocide ] (GA#38)
[ Noncompliance to the Drug Trafficking Act ] (GA#90)
[ Noncompliance to the Suppress International Piracy ] (GA#20)
[ Noncompliance to the WA Counterterrorism Act ] (GA#25)
[ Noncompliance to the Diplomatic Protection Act ] (GA#22)

As well as the evasion of court proceedings, attempted murder, second degree murder, public nudity and theft he has committed.

Other Defense Information:
The defense will also be represented by Benjamin M. Palmer jr. Mostly because as a Labor Union, in said Corporatocracy they are a state entity and thus must be represented by an official that is approved by the crown, who is... Eduard Heir. Benjamin M. Palmer jr. came recommended to the prosecution by Mr. Heir. The peoples of Unibot has put forth the following court case to the WA International Criminal Court because it cannot hope to see justice in a Unibotian trial, Unibot supersedes all right to trial its diplomat (under the WA provisions of GA#22) to the ICC.

You case is by far the most impressive and important one that we've seen so far. With the acceptance of the judges, I would like this to be the first case we use. Your case has the most completed information, for sure.

Just one question though; are you sure you don't wish to use one of our attorneys? That way, your nation wouldn't have to be on both sides of the argument.

Eduard nodded to his defense attorney, Palmer, who nodded his head to the Prosecution table, who looked frustrated and nodded their heads to the crown attorney, Palmer.. who sternly nodded his head to the judicial representation of the ICC.

"Positive, your honor" Palmer said.

I would be willing to act as an attorney for Mr Heir if you wish. I am trained in civil and international law (I have a Doctorate in this subject). Should I need to fill out any paperwork to ensure this, I am willing to do so

Yours, with honour

Dr. John Rasmussun (LLD - civil and international law)

"That won't be necessary, my client finds me adequate as an attorney." Palmer said.

Benjamin nodded to the Prosecution table as he made some last minute arrangements.

He stood up before the judges of the International Criminal Court.

"The Prosecution would like to add attempted murder and second-degree murder with malice aforethought and intent to kill Sir Joesph Queene IV of the Unibotian Monarchy to the charges laid against the defendant. The defendant inadvertently murdered, Unibotian actor, Louis Arthur Fenchané with a blind shot in the dark, instead. Previously, Eduard was acquitted for said crimes, whilst Mr. Archibald Reynolds was found guilty of nine accounts of first-degree murder and fourteen accounts of fourth-degree murder. New evidence presented to the prosecution table indicate that Mr. Reynolds was not guilty of the first account of fourth-degree murder, but in fact Mr. Eduard had unintentionally murdered Mr. Fenchané." Benjamin explained.

Eduard stood up furiously, and shouted at his attorney,
"THIS IS AN OUTRAGE!"

Benjamin quickly turned furiously as well and demanded sternly, "Agreed. This is an outrage your honor, we demand that the prosecution stop including more crimes to the list of charges against my client."

OOC: I would prefer it if this was allowed to be trialed as well...

What do you mean? It will be on trial...

OOC: Trialed.. as in.. I would prefer it this additional crime was allowed to be included into the list of charges, even though I was late on thinking about it.

(Behind the Scenes)

Usually the Prosecution, honoured ambassador. (Checking the scripts) I assume that I not only open the session but the Chief Justice (Robert) should read the charges to the defendant? Also, do we roleplay each case in its own thread?

You sound like a nice friend, but since I am 19, it wouldn't really work out well legally.

Plus, I doubt your bisexual, thus making it nigh impossible for us to date.
