I think that would be because there was no one to catch you. Ginny was surprised when Slughorn didn't get her in trouble when he saw her cast the bat bogey hex. I think you would get in trouble if someone caught you.

However I think the Ministry would be following up on any magic practised regardless; since its not actually on Hogwarts grounds, it would be investigated I would think. Not only that but the staff at Hogwarts, if they found out, would definitely investigate disciplinary options for those responsible.

Ah, I suppose this is all pedantic anyway. We could just assume that magic is allowed on the train but, for obvious reasons, if the staff found out about any incidents there would be serious consequences. That would explain Malfoy's actions not being reported.
