CONCERNED that no legislation exists to deter these criminal acts.

How can one applaud efforts to deter said trafficking, if one believes no legislation exists?
Legislation does in fact exist to ban trafficking, in the form of GAR #23 - Ban on Slavery and Trafficking. The production and distribution of child pornography would specifically be banned by by GAR #222 - Prevention of Child Abuse.

Not to mention that the outright restrictions, and automated triggering of police incursions, would significantly infringe upon our scientists' ability to research trends in subversive materials in non-WA aligned states.

OOC: Image spam too. No need for the photo(s).

Wait... does it really? The definition of child abuse in GAR#222 does leave open some loopholes.

DEFINES [..] Child abuse as any and/or all of the following:
the forcing of [..] desire upon a child
any deliberate act and/or behaviour which results in serious emotional and mental trauma in a child,

PROHIBITS the creation and/or distribution of materials without artistic merit depicting child abuse

I'd say it is under the above.

Only if the child receives emotional or mental trauma.
There could be cases in which the child does not experience these traumas.

So... a voyeur filming two minors engaged in a consensual sex act can then sell and distribute that footage legally, provided they do not cause serious emotional/mental trauma to those minors -- perhaps by only selling it in remote countries, pixelating their faces so they can't be identified, or even waiting until they are adults so that they may only suffer the emotional and mental trauma once they reach adulthood. In this scenario you have the production and distribution of child pornography without inflicting child abuse. Yes?

(OOC: Lux, excuse the slight threadjack, but I suspect this may help your draft in the long run.)

Go on ahead.
All arguments are welcome, as long as the hostility is kept to a minimum.

That is the exception to revenge porn cases. Again, If the person consents to it then it does not violate their personal privacy nor should it cause any emotional trauma.

But... if they don't find out about it (or don't find out about it until adulthood), then there is no emotional trauma, and GAR #222 wouldn't cover this scenario. An outright ban on child pornography would certainly have some overlap with GAR #222 but as we said there are loopholes.

OOC: I'm not a mod, so this is only a suggestion based on my understanding, but Image Spam - Posting of images [..] that do not serve to help the flow of the thread. This includes images in both in-character and out-of-character posts.

IC: We would interpret that, under our national law, as having been emotional trauma caused due an act of abuse relating to childhood.. and therefore punishable under the law. We have quite a fluid interpretation of the statute of limitations here in Aligned Planets.

As would most nations we suspect, but we wonder if that's the case everywhere, and we still hold that it isn't addressed adequately in international law.

We REALLY hate to say this... but realistically the only way to adequately address this is a repeal/replace of GAR#222. Is doing so worth having a finite period where there is no international child abuse law?

I'd concur. R&R of 222 is the way forward on this.

The ambassador takes a thorough looks at the bill, and starts to cringe. "Err... This proposals rules are a tiny bit... draconian. Our country believes in the right of due process, and this bill takes due process, kicks it into the curb, lights it on fire, and then throws it into a garbage compactor, which sends it flying into a star. You have to take other possibilities into consideration; what if they are doing a research project about human trafficking, and child pornography?"

OOC: You're going to have to repeal GAR#222 to pass this, as stated before. You would also need to take in effect nations with no internet; many nations RP in different time periods, such as the medieval age.
