As long as they have a different judge it might actually get through. Paltry compared to the 20 years the DA wanted but better than 10 years cushy probation in a country club rehab center.

Not in this context. In the context of this case, "affluenza" refers to the notion that being rich places you above the requirement(s) to follow the law, adhere to basic human decency or otherwise not be a total waste of oxygen.

We should be nodding along and agreeing with this ruling then when they let it get enough precedent, BAM. We argue excessive wealth is a hazard to mental health and can be confiscated under that rationale, since the wealth is causing them to become a danger to others from being too messed up by it, and who cares if they complain, they are too fucked up by cash to know any better. As soon as it becomes a legitimate point of law that excessive cash = disconnection from reality (Something we all know to be probably true), then it becomes a matter of protecting the public, health and safety, and law enforcement to confiscate money from rich people.

Do you seriously think that say, if there was this pink goop that made people turn fucking crazy and a threat to society (IE, commiting crimes against others and being completely unaware they were doing anything wrong), that the government wouldn't be well within it's rights to confiscate it from people hording it?
If they want to argue that money is akin to that, then let them. They'll dig their own grave.

I reject popular sentiment intervening in the process of law, and this is indeed a representative case where I will profess my distain for it.

It is lamentable that four innocent people died because of some drunken driver, but that is what the case is: inebriated. No person should ever pay full penalty for what he has done when having a clouded mind, because the criminal law does not exist for this reason. It exists to punish intent.

And the driver was underaged, wasn't he/she? The driver's parent(s) should be fined for his/her/their inability to raise his/her/their child(ren) properly, but the driver should suffer no criminal punishment.
