Treatment of Drug Users Act

Preamble
A Bill to provide a scheme under which drug users and their families can obtain an integrated health and social care plan for their treatment and rehabilitation; to fund additional treatment services for drug misuse from the proceeds of drug-related crime; and for connected purposes.
Be it enacted by the Senate of Aurentina in respect to the sovereignty of the People of Aurentina the following act.
Section I – Duty of the Ministry of Health to promote the treatment of Drug Users
1. It is the duty of the Ministry of Health to promote the integration of health and social care services to secure the prevention of drug misuse and the treatment of drug users.
2. In discharging that duty the Ministry of Health shall, by regulations, make such further provision as they think fit in connection with —(a) the introduction of a scheme to assess the needs of drug users to determine an appropriate care plan to treat their addiction;
(b) the delivery of such health, social care and employability services as may be necessary to treat and rehabilitate drug users; and
(c) the delivery of social care, child care and child protection services for the families of drug users.
3. The regulations shall, in particular, make provision about —(a) the right of a drug user to be assessed for a care plan within seven days of requesting one;
(b) the timeframe in which a care plan shall be implemented for a drug user who is susceptible to treatment;
(c) the appointment and functions of persons designated to carry out a care plan assessment;
(d) the types, forms and packages of health and social care services to be deployed to treat drug users, which shall include detoxification, residential and community based rehabilitation services, substitute prescribing and such other forms of treatment as the Minister of Health think appropriate;
(e) the form of employability support to be deployed to enable drug users to gain employment or voluntary work experience;
(f) the types, forms and packages of social and child care services for the families of drug users; and
(g) a complaints procedure for drug users and their families who are dissatisfied with services provided to them under this section.
4. The regulations may also modify any enactment (excluding this Act) or instrument for the purposes of making such further provision as is mentioned in subsection (2) above.
5. The regulations may also make provision for a code of practice giving guidance to any person providing health, social care, child care or employability services to drug users or their families.
6. The Ministry of Health shall, before giving effect to a code of practice drawn
up under subsection (5) above —(a) consult such persons as they think fit; and
(b) lay a draft of the code before the Senate to be placed in the Senate Archives,
and a code of practice drawn up under subsection (5) above shall be given effect by being confirmed by order made and brought into force on a day appointed by the Minister of Health.
7. Any person providing health, social care, child care or employability services to drug users or their familes shall have regard (so far as applicable to the services which they provide) to the provisions of any code of practice published under subsection (5) above for the time being in force.
8. The Ministry of Health may, from time to time, revise the whole or part of any code of practice published under subsection (5) above; and if a code is so revised, subsection (6) shall apply to any revised code of practice.
9. Any revision of the whole or part of any code of practice as permitted under subsection (8) must be laid before the Senate and placed in the Senate Archives.
Section II – Proceeds of Drug Crime to fund treatment of Drug Users
1. Where the accused has been convicted of an offence concerning the possession, supply or trafficking of controlled drugs, proceeds recovered under this Part shall be applied to fund care plans for drug users.
2. “Proceeds” shall be defined as any financial collection from the accused.

Cetacean and Great Ape Bill of Rights

Understanding that Great Apes and Cetaceans have very complex emotional and intellectual lives, and deserve to be protected from humans and human violence. Also understanding that Orca Whales specifically have larger and more complex emotional areas in their brains, meaning they actually feel more emotion than humans. Great Apes and Cetaceans need to be left alone in peace.
Defines captivity for the purposes of this bill as the holding or imprisonment of a cetacean or great ape without the approval of GACREA or without following the regulations set by GACREA.
All Cetaceans and Great Apes hereby shall receive the following rights:
1. Every individual cetacean and great ape has the right to life.
2. No cetacean or great ape should be held in captivity or servitude; be subject to cruel treatment; or be removed from their natural environment.
3. All cetaceans and great apes have the right to freedom of movement and residence within their natural environment.
4. No cetacean or great ape is the property of any State, corporation, human group or individual.
5. Cetaceans and great apes have the right to the protection of their natural environment.
6. Cetaceans and great apes have the right not to be subject to the disruption of their cultures.
7. The rights, freedoms and norms set forth in this Declaration should be protected under domestic law.
8. No State, corporation, human group or individual should engage in any activity that undermines these rights, freedoms and norms.
9. Nothing in this Declaration shall prevent the State from enacting stricter provisions for the protection of cetacean or great ape rights.
10. Nothing in this Declaration shall prevent the care or help given to cetaceans or great apes.
11. No cetacean or great ape will be punished by, or bound to, any human created law.
12. Knowingly depriving Cetaceans and Great Apes of the aforementioned rights is a derelict, and accidentally depriving Cetaceans and Great Apes of the aforementioned rights is a contravention.
Section 1
1. Establishes the Great Ape and Cetacean Rights Enforcement Agency (GACREA) who's duty will be determining whether or not a great ape or cetacean's rights have been violated, and to take charge of cases involving such violations.
2. The GACREA will also be responsible for determining proper living conditions for injured or disabled apes that are in the care of a qualified human or veterinary association.
3. The GACREA will report to the Ministry of the Environment.
4. Establishes a cetacean sanctuary off the coast of Woozen in Andersbai for injured or disabled cetaceans who require human care.
