This has to be one of the biggest piles of bullshit in legality since the whole "refer madness" fiasco. Neo and/or TCT, could you explain to me why the gay panic defense has actually been successful before? How is that even possible? How does it not come off to everyone as the lamest excuse ever, let alone supposedly educated judges?

It is used as a defense in court for murder or assault/battery. The defendant argues that he wasn't in control of his actions because the victim, who is gay, came onto him. It is every bit as pathetic as the statement "She was asking to be raped with the way she was dressed." It has actually been successful in some cases, and apparently in one, the defendant was actually acquitted for murder.

But I don't see how anyone of any intelligence at all can take this excuse seriously. I could understand a jury, but doesn't a judge have to be educated quite extensively? I didn't think you could be a moron and manage to get a JD.

There are plenty of educated idiots. Judges are not exempt from this.

Or something in that manner, and i can already see terrorists as well as several religious extremist looks in their eyes as if it is the day before Christmas.
