International Justice System [Draft]

Postby New Jaedonstan » Tue Apr 25, 2017 2:59 pm

Here is a proposal I think we need to implement.
•APPALLED at the lack of international justice,
•WISHING to establish a safe environment for all nations,
THE WA GENERAL ASSEMBLY HEREBY ESTABLISHES:
The International Justice System.
1. It will have no employees or overseers, being meant as an independent, autonomous, and WA member enforced system.
2. This system will allow for nations to enforce their laws outside of their jurisdiction.
3. This system will require that a international crime record be kept of all past or pending crimes and punishments on an international database.
4. This system will require that all member nations equip their national police force with access to this database.
5. Any person found having violated any law of the nation in which they are a citizen or previously a resident of will be detained by the nation's police force and returned to the nation in which they committed their crime.
6. No nation may alter the database without consent from the General Secretary of the WA. The database will be updated by any member nation (excepting removal of content, which will be confirmed by the GenSec).
If anyone thinks there could be more added, please comment.

Three problems.

1. Duties cannot be added to the WA Secretary General joke position. Doing so is a clear game mechanics violation, per precedent previously given by the moderators, who also still enforce the game mechanics rules.

2. Attempts to claim laws outside jurisdiction will likely violate On Universal Jurisdiction's requirement that the WA cannot usurp a member state's claim to criminal jurisdiction. This court would do that.

3. Extradition is already previously legislated upon.

OOC:

Welcome to the World Assembly! I'm afraid this proposal is illegal. Imperium Anglorum gave some of the reasons above; I'll add that assigning the Secretariat (GenSec) new duties is likely a game mechanics violation also; and extrajurisdictional law enforcement powers very likely contradict GAR #2 as well (please see Articles 1 & 2).

Don't be discouraged - most people's very first proposals are illegal! Stick around for a while and participate in proposal drafting threads to get a feel for the scope and construction of legal proposals, and try again later on. My signature below has links to resources like the GA Rules and the list of existing resolutions, so you can try to figure things out; and feel free to ask questions. Again, welcome to the WA!
