[DRAFT] Indigenous Lands Accord Proposal

Postby Santa Thereza » Fri Oct 09, 2026 8:36 am

Esteemed Varanius, UPC, Merethin, Islandwalk, and Moduland
Fellow WA delegates and members,

I have submitted the INDIGENOUS LAND STEWARDSHIP proposal to the WA assembly and would welcome your feedback and approval to bring it to a vote.

https://www.nationstates.net/page=UN_vi ... 1791560258

It is a fully voluntary, opt-in framework that encourages consultation with Indigenous and originary peoples, while each nation sets its own participation targets and keeps final authority over land use.The text carries no vetoes, penalties, or external enforcement, so it protects biodiversity without restricting sovereignty or economic growth.

I’m excited by an Indigenous-focused proposal, and I’d be grateful for your thoughts and, if you find it worthy, your endorsement.

Warm regards,

Santa Thereza
WA Member. WA Delegate (2020-2024 non-consecutive)
Prev. South America President (2021-2023)

I support this proposal in theory, but not as written. It creates apparently inconsistent mandates ("Member state officials shall facilitate voluntary ILSA TASK FORCES"). It also technically doesn't apply to any nation, however willing, because you say that "A member state joins by adhering to the Indigenous Lands Accord proposal in the WA Assembly" while the name of your proposal is actually Indigenous Land Stewardship. I would recommend going back and drafting your proposal on this thread in the highly likely event that it does not go to vote.

The WA Secretariat only makes recommendations for proposals. They can't approve your proposal just because they are in the Secretariat, even though two of the five members are WA Delegates in their own rights.

The General Assembly,

Recognizing that INDIGENOUS and ORIGINARY PEOPLES have sustained distinct cultures, languages, and ecosystems across generations, and that their stewardship is closely linked to biodiversity conservation;

Acknowledging that protected habitats are most durable when the communities living in them take part in decisions affecting them, and that exclusion erodes both cultural heritage and ecological outcomes;

This body hereby enacts as follows:

  1. Section A - Definitions
    1. 'ORIGINARY PEOPLES' means communities that a participating member state’s competent authority recognizes as having historical continuity with a territory predating its current national boundaries and as maintaining distinct cultural, linguistic, or vernacular social institutions. Each participating member state determines recognition under its own domestic law.
    2. 'PROTECTED HABITAT' means any land or waters formally designated by a participating member state for conservation, cultural preservation, or ecological protection.
    3. 'PARTICIPATING STATE' means a member state that has opted in under Section B.
  2. Section B - Indigenous Lands Accord
    1. Establishment. The INDIGENOUS LANDS ACCORD is created as a voluntary framework under the auspices of the World Assembly.
    2. Opt-In. A member state joins by publicly declaring its adherence to this resolution, the Indigenous Land Accord, by dispatch or other public notice, and becomes a participating member state from that date. It may designate which Protected Habitats fall under the ILA and may withdraw on reasonable public notice, whereupon its obligations under this resolution cease.
    3. Core Commitments. Participating member states shall establish a consultation process through which Originary Peoples may give input on decisions that materially affect Protected Habitats within their traditional territories; make good-faith efforts to include representatives of Originary Peoples on advisory and management bodies for those habitats; and where appropriate, incorporate traditional ecological knowledge into conservation planning and execution.
    4. Scope. Participation is strictly voluntary. Nothing in this resolution applies to a member state or its territory unless that member state has opted in under Section B.
    Matters Covered. Participating member states may extend Section B.3 to matters including, but not limited to, tourism within PROTECTED HABITATS, the participation of ORIGINARY PEOPLES in urban development initiatives, the allocation of financial resources for biodiversity protection, and the development of a NATURAL HABITATS BASE.

  3. Section B - Section C - Cooperation Incentives
    1. Task Forces. Participating member states may facilitate voluntary taskf forces, composed of Originary Peoples, conservation experts and government officials, to share best practices, technical assistance, and monitoring methods.
    2. Incentives. Participating member states that report on task force commitments are eligible for priority access to conservation assistance, joint research and cultural exchange programs, and recognition as a partner nation in the public registry.
    3. Advisory Role. Task Forces are advisory only; their recommendations are non-binding.

It'll make it easier to give feedback if you place your most recent draft in the OP of the thread.
