[PASSED] Repeal "Equal Justice Under Law"

The printer at the desk of Adelia Meritt is producing an ominously large number of pages. One such page reads as follows:

Repeal "Equal Justice Under Law"
Category: Repeal || Resolution: GAR #572 || Proposed by: Excidium Planetis

Description:

The Assembly of Worlds,

Believing in the value of holding public officials accountable for their actions, including ending unnecessary immunity from prosecution of crimes,

Arguing that nevertheless, GA#572 "Equal Justice Under Law" not only does not do that, but also even endorses such "qualified immunity" of public officials,

Stating the facts as such:
  • GA#572 "Establishes that all private and public individuals, officials, entities, and institutions... be held accountable... under any guidelines and/or disciplinary measures that may be in use by a particular organization."
  • GA#572 makes no rules regarding these disciplinary measures.
  • Institutions in member nations may therefore set their own guidelines and disciplinary measures, including such things as paid administrative leave, and consider this to be sufficient accountability.

Encouraging the members of this Assembly to think carefully about the legislation they choose to enact in the future and whether it is really an improvement over the resolutions we frequently repeal,

The Rule of Law was, in fact, repealed and replaced by Equal Justice Under Law (a title I suggested!) so that the World Assembly could take effective action to end qualified immunity. It does not, as you argue, "endorse" QI, as most Americans would understand it (i.e. in the context of the police). To claim otherwise would be an Honest Mistake.

Besides, I am a fan of some of the other repeals you have put to this forum over the last few hours. But I am not a fan of this repeal. It complains that the World Assembly (via EJUL) does not micromanage organisational disciplinary codes, before going on to argue that the World Assembly (in principle) should not be micromanaging organisational disciplinary codes.

OOC: I can get the opinion of further members of GenSec (IA and Banana have both commented on this already), but I don't believe what I put in the repeal is substantially false. Equal Justice Under Law does in fact allow organizations in member nations to hold their members responsible according to their own guidelines, which the resolution does not restrict.

OOC. I want to note that the repeal-replace process that Tinhampton Daarwyrth co-lead actually vitiated the then-existing legislation which actually did obliterate qualified immunity… to replace it with legislation that did not. If we actually care about getting rid of qualified immunity, Tinhampton & Co Daarwyrth et al are not credible advocates for it.

Edit. My apologies to Tinhampton for wrongfully associating her good name with the repeal-replace effort that destroyed qualified immunity and replaced it with admin-leave-for-all. Daarwyrth rightfully corrected me below; I was wrong not to attribute the programme of ensuring police officers are given paid administrative leave in lieu of real punishment thereto. Fixed wrong tag; I used blocktext instead of strike.

OOC: Tinhampton was not an author of the repeal or replace, mind you. Greater Cesnica repealed with me as co-author, and I authored the replacement with Greater Cesnica as co-author. If we're talking about credibility, it would serve you well to have your facts straight, before saying anything about the credibility of another.

Oh, my apologies, I had confused this legislative effort that left the world worse off (Equal Justice Under Law) one of the other legislative efforts on a similar topic that left the world worse off (LEO Force Restrictions). I discussed the two at the same time in a blog post about resolutions that don't do anything, which must be the source of my confusion. Thank you for the correction and for taking credit for writing this resolution that doesn't do anything instead of that other resolution that doesn't do anything.

While our fellow WA member for Daarwyth might have authored a sufficient draft response to this repeal in the spirit of replacing GAR #572, which the whole of Far Away Enough's leadership is in support of, our leadership nonetheless has decided to vote against this repeal. The basis of our vote is that a repeal with no concrete suggestion for improvement is not something our leadership feels they can support, and must stand against.

Further, we feel that a statement such as "Encouraging the members of this Assembly to think carefully about the legislation they choose to enact in the future and whether it is really an improvement over the resolutions we frequently repeal" implies that members of this Assembly do not think carefully about legislation that they choose to enact. Though Far Away Enough has only been a member nation of the World Assembly for a short time, we feel it is far away from the dignity of the Assembly to apply our support to a proposal of this kind that seeks to make out the weakness of will of World Assembly members.

It is our belief that if the delegate from Excidium Planetis really cares about the outcome of this proposal, that they will in future think carefully about proposals they choose to put forth, and might consider working with the members whose work they seek to repeal and replace with even more nothing than they consider GAR #572 to be. In that case, the delegate from Excidium Planetis might have been given the opportunity to co-author a resolution that satisfied their goals, and would not insult their fellow members of the World Assembly.

(naturally, it's really hard for any of you to hear any of that speech. The delegate from Far Away Enough was definitely standing out of earshot)
