According to this article, Republican Representative of Michigan, Justin Amash slammed the idea of President Trump declaring a national emergency for the wall on Twitter, and Republican Senator Lindsey Graham of South Carolina, Tweeted must declare a national emergency for the wall if law makers in congress fail to reach a deal on border security next month, if they fail to reach a deal, then President Trump must act through the emergency powers to build a wall, a barrier.

As you all know by now, I keep saying we don't need The Great Wall of Trump, what we need is real immigration reform, but the Democrats support easy asylum laws and open borders legal immigration, so under the circumstances I support the President declaring the national emergency if no deal is reached, and I think no good deal can be reached, I think he will have no choice but to do so, where 's my popcorn?

Declaring a national emergency would be on very shaky legal ground and almost certainly be challenged in court and would piss off many in Congress.

Trump unarguably has the legal authority to declare a national emergency over whatever he damn well likes.

Using that national emergency declaration to siphon DoD funds and personnel to build something that is A, useless and B, he couldn't get through Congress, is what is on very shaky legal ground.

I mean... sure, but that was 1941 as we were gearing up for war time. Normal protocol goes out the window with that situation. It is not uncommon for eminent domain cases to be tied up in court for years in the modern day.


Don't get me wrong, when push comes to shove the Fed will win this fight. but its not like he could have a Wall built this time next year even with eminent domain. Getting into court battles with hundreds of property owners along the border is just not going to be an easy prospect.
