The thing is the ICC isn't talking about going after monsters like Robert Bales. The ICC is talking about putting George W Bush on trial. The US didn't sign any treaties to grant them such power and for good reason obviously. These threats are merely representative of the american right wing stance non former soviet union foreign political intervention.

The ICC is not talking about that, because the ICC has no jurisdiction over the US and it knows that. However, if American citizens commit war crimes in nations where the Rome Statute is ratified, the ICC can prosecute them. If Bush committed a Rome Statute crime it was the crime of aggression, which has not been properly formulated yet. If he did it, he did it from the States where, again, the ICC has no jurisdiction.

Can you find an ICC statement where they mention going after Bush?

Ohhh, I missed this one. You are wrong, by the way. The territoriality principle is as old as the Treaty of Westphalia. American citizens can be tried in foreign countries, that is not a violation of international law. If they could be tried in a Dutch court, they could be tried before the ICC. That is not a violation of America's sovereignty, as the US doesn't need to agree to the Rome Statute to have her citizens tried there, just as the Netherlands doesn't need permission to try a US citizen. The US sovereign rights are not violated. You also seem to be confusing the ICC and the Netherlands.

The Vienna Convention on the Law of Treaties does not apply here. Could you state what article would be violated?
