Constitution of the Capilean State
We, the Capilean people, in order to achieve a democratic form of government and to guarantee and defend our God-given rights and freedoms, name this to be the document by which all of Capile and her sovereign territories are governed. It certifies the independence of this nation and will serve as a Constitution to which the Capilean government is bound. Henceforth, the Grand Duchy will guarantee the rights, put into writing below, of all of its citizens.Article I
All powers given in this document to the Capilean legislature will be vested in the Reichstag, further divided into the Edelrat and the Volksrat. The Reichstag shall meet in the Volkshalle in Saxtonberg, which shall be the Duchy's capital. Every District within the Duchy is granted fourteen Electors in the upper house, the Edelrat, which shall be elected by the lower house. Every District's general populace (as specified in Article II) shall elect sixty-five of their peers to sit on the Volksrat as Electors. The Reichskanzler (see Section IV) will preside over the Edelrat, and the Stellvertretender Reichskanzler shall preside over the Volksrat.
Section I
Regarding the election, necessary qualifications, and privileges of Electors, as well as the operation of the Reichstag.
1. In order to sit on the Edelrat one must have a noble title, have been born in the Grand Duchy or its territories, be a citizen of the Grand Duchy, have attained the age of at least twenty-five, be male, and be an inhabitant of the District for which they were elected. The Edelrat will hold elections every eight years. This document acknowledges that each District has the right to specify additional qualifications for their Electors, provided that they do not violate this Constitution.
2. In order to sit on the Volksrat one must have been born in the Grand Duchy or its territories, be a citizen of the Grand Duchy, have attained the age of at least thirty-five, be male, and be an inhabitant of the District for which they were elected. The Volksrat will hold elections every four years. This document acknowledges that each District has the right to specify additional qualifications for their Electors, provided that they do not violate this Constitution.
3. Should a vacancy occur in any position in the Reichstag, the Grand Duke shall appoint a replacement to serve the remainder of that seat's term.
4. The Reichstag alone will have the power of impeachment over the Reichskanzler.
5. Both houses of the Reichstag must assemble no less than one time a year and can be called to meet at any time by the Reichskanzler.
6. Each house shall be the judge of its elections, and a majority present can constitute a quorum to begin a meeting.
7. Each house is required to keep records detailing the events of all of their meetings.
8. Each house may determine the rules and regulations of its proceedings and may punish or expel its Electors for disorderly or dishonorable behavior, provided that at least three-quarters of said house concur on the ruling.
9. As recompense for their services, each Elector shall be paid a salary stipulated by their house and taken from the national exchequer. This salary shall be universal for all members of that house, and shall not be subjective to any one Elector.
10. No Elector may be arrested except for charges of felony or treason while in assembly with their house.
11. No Elector may hold civil office outside of their position in their house.
Section II
Regarding the process of voting within a house.
1. Any Elector in any house may at any time propose a bill, which is then voted on by that house. If it succeeds in winning a majority of the votes, it then passes to the other house, which must also approve it before it is sent to the Reichskanzler and Grand Duke for signing.
2. Both the Reichskanzler and Stellvertretender Reichskanzler may only vote in the case of a tie.
3. Every proposition that has been approved by the Reichstag must pass through the offices of the Reichskanzler and the Grand Duke before it is to become a law. Both must sign it to put the law into effect, and if either refuses to sign it they overturn the proposition. The proposition must then be sent back through the houses, where it must achieve at least two-thirds of the vote in both houses. If this is the case, the Reichskanzler and Grand Duke lose all right to overturn the proposition, and must sign it, making it a law.
4. All propositions with the intention of levying tax or other revenues must originate from the Edelrat, though the Volksrat may propose or concur on amendments, just as any other proposition in the Reichstag.
Section III
Regarding the powers of the Reichstag.
1. The Reichstag has the power to raise taxes, levies, imposts, excises, and other revenues, so long as they are used to:
- Borrow funds on behalf of the Grand Duchy
- Regulate commerce and trade between nations or Districts
- Set standard measurements and weights, mint coins and print paper money, and to regulate the value of said currency
- Build and maintain roads and basic infrastructure
- Encourage and cultivate science and the arts
- Constitute tribunals
- List and punish felonies, piracies, and offenses against the nation
- Declare war, issue letters of marque, and define rules on capture on land and water
- Maintain, expand, and refit a Navy, Air Force, Army, or other military force necessary to defend the nation
- Levy, organize, and arm militia for the defense of the nation and the repulsion of invaders, and also to appoint officers for said militia
- Preside over land disputes between Districts and territories and to enforce rulings in said disputes; also, to erect buildings deemed necessary by the Reichstag
- Create government agencies for the betterment of the Duchy or for its defense, security, or well-being
Section IV
Regarding the office of Reichskanzler and its powers.
1. The Reichskanzler will be elected in a general election every eight years. The runner up shall become Stellvertretender Reichskanzler.
2. In order to run for and be Reichskanzler one must have been born in the Grand Duchy or its territories, be a citizen of the Grand Duchy, have attained the age of at least thirty-five, and be male.
3. The Reichskanzler shall preside over the Edelrat, and the Stellvertretender Reichskanzler will preside over the Volksrat (see Section II).
4. Should the position of Reichskanzler fall vacant, then the Stellvertretender Reichskanzler will take his place for the remainder of his term. The title shall fall to the members of the Reichskanzler's cabinet should the position become empty again.
5. At the beginning of their term, the Reichskanzler will choose individuals to lead and man government agencies and to compose his cabinet of advisors. He may replace them at any time.
6. The Reichskanzler may create new government agencies with the consent of the Reichstag.
7. The Reichskanzler and Grand Duke will share the position as Commanders in Chief of all Capilean military forces.
8. The Reichskanzler may impeach judges.
9. The Reichskanzler may appoint District Governors.
10. The Reichskanzler may propose a general draft of the Capilean populace or conscript personages, as specified in Article XXI.
Article II
Every male citizen over the age of eighteen who has been registered with the Grand Duchy has the privilege of voting in District and national elections. This privilege may be confiscated, temporarily or indefinitely, provided that one has committed an offense that has been deemed by the courts as worthy of disenfranchisement (or the confiscation of voting privileges).Article III
This Constitution guarantees Capilean citizens the right to practice whatever denomination of Christianity they choose.
Section I
Regarding the limitations on Article III.
1. The state also guarantees that those who choose to practice no religion, or those who practice a Nordic Pagan religion, also have the right to worship freely.
2. Should any religion or sect be deemed a threat to the state or Capileans as a whole, its rights shall be suspended.
3. The state officially adopts Capilean Lutheranism as its religion, though this religion shall not be impressed upon anyone and will not be afforded special advantages.
4. Churches, as religious and sanctified places, are exempt from tax.Article IV
In order to preserve the power of the monarchy and ensure that democracy does not completely usurp its position, the Grand Duke will be guaranteed certain powers.
Section I
Regarding the powers held by the Grand Duke.
1. Recognizing the Grand Duke's divine right to rule, this Constitution guarantees that in a time of war, revolution, internal instability, or other crisis, he may suspend the Reichstag and assume its powers and responsibilities, as well as those of the Reichskanzler. However, this Constitution will not be suspended, and will still serve as the governing document that the Grand Duke must abide by. After the crisis has passed, or at a time of his choosing, the Grand Duke shall end this suspension.
2. The period during which the Reichstag is suspended must extend no longer than five years, at which time the Reichstag will reconvene and once again become the governing body of the nation.
3. In addition, during any time at which the Reichstag has been suspended, a public plebiscite may be organized and held as to whether or not to end the period of suspension.
4. The Grand Duke may, as any Elector, suggest propositions. He may also, at any time, prompt a vote to punish or expel an Elector.
5. The Grand Duke may issue laws without the concurrence or input of the Reichstag, but only if these laws deal with the raising of taxes and revenues or the conscription of soldiers.
6. The Grand Duke may at any time begin a vote to impeach the Reichskanzler.
7. The Grand Duke may create new government agencies, either with consent from the Reichstag or by using funds from his private Ducal Treasury.
8. The Grand Duke may make treaties (to be ratified by the Reichstag) and mobilize troops.
9. The Reichskanzler and Grand Duke will share the position as Commanders in Chief of all Capilean military forces.
10. The Grand Duke may impeach judges.
11. The Grand Duke may grant asylum to asylum-seekers.
12. The Reichskanzler may propose a general draft of the Capilean populace or conscript personages, as specified in Article XXI.Article V
The Grand Duchy of Nova Capile maintains complete and utter sovereignty over the Capilean islands and all territories it controls, as well as the airspace and territorial waters of these lands. Furthermore, the Duchy is granted control of the environment of this land, and the mineral, animal, and plant resources of these areas. Finally, the Grand Duchy has absolute authority over the private property existing in this land, and, should it see fit, may confiscate this property at any time.
Section I
Regarding the limitations on Article V.
1. The owners of private property must be properly and immediately reimbursed should their property be confiscated.
2. Those who commit serious offenses or felonies are liable to have their property confiscated without recompense.Article VI
Any foreign or domestic ideologies, organizations, or individuals who threaten or act to attack this nation or its people, or to extinguish its vibrant culture, shall immediately be liable to disbandment, outlawing, or arrest. This is to protect and sanctify our nation, its people, and its culture. Furthermore, this Constitution recognizes that certain ideologies espouse tenants of destruction and degeneration and that they, listed in Section I, will hitherto be outlawed, and adherents to them liable to arrest.
Section I
Regarding those ideologies which shall be banned in the Duchy.
1. Communism, in any form, shall be banned. Recognizing the grim history of Communism and its tens of millions of victims, as well as its dangerous creeds of revolution and statelessness, this Constitution declares it to be outlawed. No political organization embracing the philosophies of Marxism, Stalinism, or indeed any other incarnation of Communism, shall be allowed to form or congregate. The state has license to arrest and imprison anyone who adheres to this dangerous ideology.
2. Islam, in any form, shall be banned. This Constitution recognizes the malicious doctrines of this religion, and wishing to prevent the detriment of Capilean life, hereby declares the practice of Islam illegal. Any adherents to Islam are liable to be placed under arrest or imprisoned.
3. Any seditious, revolutionary, subversive, or anarchist organization, as well as organizations that call for treason against the state in any form, are hereby outlawed, and their members liable to arrest and imprisonment.
4. Ideologies not stated here may at any time be added to this list by a popular referendum, in which at least half of all participants must vote to ban the ideology for it to be stripped of its rights.Article VII
Judicial power shall be vested with courts starting at a city level, ascending to provincial and then District-level courts, and finally to the Hochgericht. The Hochgericht's ruling shall be final in all cases.
Section I
Regarding judgeship, and the powers and priveleges therein.
1. Judges shall be appointed by the Reichskanzler, or by officials that the Reichskanzler instates.
2. Judges shall be afforded a commission specified by the city, province, or District they serve. Those who sit on the Hochgericht shall have their salary decided by the Reichskanzler.
3. Judges at any level may be impeached by the Reichskanzler or Grand Duke.
4. Judicial power shall extend to all citizens of the Grand Duchy, including ambassadors, ministers, and consuls.Article VIII
Hereby divides the Capilean island into nine Districts: Sächsisch, Kaiserlich, Nordöstlich, Frank, Wiese, Zentralgebirge, Ostland, Südland, and Schlaraffenland. Each of these Districts shall be administrated by a Governor, who himself shall be appointed by the Reichskanzler. Each District will also have an elected body known as a Bezirksrat, which shall pass laws that shall effect that District only.
Section I
Regarding the Bezirksrat.
1. For every 250,000 citizens that live in a District, one Elector will be added to their Bezirksrat.
2. In all cases, laws passed by the Reichstag will hold absolute over laws passed by the Berzirksrat, should they come into conflict.
3. Each individual District may set their own qualifications for Electors to sit on the Bezirksrat.
4. Electors shall be elected in a general vote once every four years, following the regulations set in Article II.
5. At their first assembly after an election, the Bezirksrat will elect from amongst themselves a Präsident to preside over them.
6. Should a vacancy open in a Bezirksrat, the Präsident will appoint someone to fill it.
7. The Bezirksrat shall abide by the same regulations set for the Reichstag in Article I, Sections I and II.
8. The District Governors shall serve the same role in the Bezirksrat as the Reichskanzler in the Reichstag, as outlined in Article I, Section II.
Section II
Regarding the District Governors and their powers and privileges.
1. To be appointed as a Governor, one must meet the following qualifications: one must be a citizen of the Grand Duchy, have been born in the Duchy or its territories, be male, have attained the age of at least thirty-five, and hold a noble title.
2. The District Governors shall have the power to create District agencies, raise District levies and revenues, and appoint judges.
3. The District Governors shall at all times be subservient to the Grand Duke, Reichkanzler, and Reichstag. If he at any time disregards, countermands, or defies orders from any of them, this shall be regarded as an act of treason and the Governor shall be treated as a traitor to the Duchy.Article IX
All judges and officials, including the Grand Duke, Reichskanzler, District Governors, and Electors, shall be bound by this Constitution, and shall at the beginning of their reign or term take an oath to uphold it. Should any of them at any time violate this Constitution, then the people of Capile have right to depose or impeach them.Article X
This Constitution hereby recognizes that families are the nuclei of all society and the building blocks upon which civilization is based, and therefore will act to preserve and protect the family unit wherever possible.
Section I
Regarding marriage, homosexuality, and sexual identity.
1. This document refuses to recognize the legality of same-sex relationships; hitherto, only unions between a man and woman (by birth) will be recognized by the state.
2. Those who participate in or ordain illegal marriages are liable to arrest and re-education. Repeat offenders may be imprisoned or transferred to mental asylums.
3. This Constitution, in order to protect the sanctity of marriage, hereby criminalizes intercourse other than that between a man and woman; this includes copulation between more than two individuals, between a human and animal, and between two humans of the same sex.
4. Maintaining that only two sexes exist, that being male and female, this Constitution criminalizes declaring oneself a member of a fabricated gender. It also criminalizes sex-switches (transgenderism).
Section II
Regarding the privileges of families.
1. Recognizing the declining birth rate in the Grand Duchy, this document will reward the merits of large families with state rewards. The government is bound to award recompense to families that produce five or more children.
2. These pensions may include money and property, the amount of which can be modified according to the situation by the Reichstag.
Section III
Regarding the sanctity of marriage.
1. In order to discourage promiscuity and promote matrimony, the state declares that children born out of wedlock will be confiscated, unless the parents of the child marry within two months of the birth.
2. In the same effort, the state criminalizes intercourse out of wedlock; those who partake in it may be fined, and repeat offenders may be jailed.
Section IV
Regarding familial life.
1. Parents are responsible for nourishing, clothing, and providing shelter for their children. Parents who fail to do so are liable to be fined and their children confiscated.
2. Confiscated children, as well as orphans, will become wards of the state. The state will be responsible for finding willing foster homes. Foster parents will receive stipends for taking in children and will be subject to the same laws as biological parents.
3. The institution of corporal punishment in the case of children is protected, both at home and in schools; however, excessive beating (such as that resulting in scars, wounds, or other permanent defects) is criminalized as abuse and will be dealt with on a case-by-case basis.
4. All children of the ages of eight and above shall be required by law to join the Jugendbund, with the consent of their parents or not. This is to promote values and merits in our children and foster our posterity.Article XI
The Grand Duchy establishes that citizenship is a status that is given to those born to Capilean parents within Capilean territory.
Section I
Regarding citizenship.
1. Those born to two Capilean citizens in another country are afforded citizenship.
2. Those born to one Capilean parent, whether inside or out of Capilean territory, must pass a simplified citizenship test parallel to that mentioned in Clause 2; this test is mandatory by the child's tenth birthday unless the child leaves Capilean territory before that time. However, if the child passes their test, they are granted full citizenship status immediately.
2. Those who wish to become Capilean citizens must first pass a mandatory citizenship test designed by the Department of Education, after which they are allowed to stay in the Duchy as second-class citizens. If, after the course of fifteen years, they have committed no felonies, they are allotted full citizenship. If, however, they do commit a felony, they shall be immediately and unconditionally expelled from the Duchy and declared persona non grata. For every misdemeanor, six months will be added onto their probation period; if they exceed ten misdemeanors, they will be immediately and unconditionally expelled from the Duchy and declared persona non grata.
3. The Grand Duchy will maintain a registry of nations from which they will accept immigrants, which may be modified by the Reichstag. This registry must not include nations which have Islam as their state religion or which espouse any of the ideologies listed in Article VI, Section I.
4. As of now, the Grand Duchy will only accept immigrants from the Unified German Reich and the United States of Columbia. This list, as stated above, may be modified by the Reichstag.
5. Undocumented immigrants and illegal aliens will be immediately and unconditionally expelled from the Grand Duchy and declared persona non grata.
Section II
Regarding foreigners within Capilean territory.
1. Foreigners, no matter their purpose for being within Capilean territory, are subject to Capilean law.
2. This is with the exception of foreign ambassadors and consuls, who are exempt from some charges, as to be specified by the Reichstag.
3. Foreigners wishing to travel within the Grand Duchy's borders must obtain a travel visa from the Reichsministerium of the Interior. The visa's allotted travel time must not exceed two months.
4. Foreigners wishing to work within the Grand Duchy's borders must obtain a work visa from the Reichsministerium of the Interior. The visa's allotted work time must not exceed eighteen months.
5. Any foreigner who outstays their visa is liable to be treated as undocumented and unregistered migrants. They may renew their visa with the Reichsministerium of the Interior before its expiration date.
6. Foreigners are not subject to protection by the Capilean government, nor is the state responsible for their well-being or protection.
7. This is with the exception of asylum-seekers. The state may grant asylum to no more than thirty individuals per year, and only with the concurrence of the Reichstag or the personal consent of the Grand Duke.Article XII
Recognizing the pressing need for centralized, government-run public services, this Constitution hereby establishes the Departments of Health and Education and the National Postal Service.
Section I
Regarding the Department of Health and its responsibilities.
1. The Department of Health will be administrated by a Reichsminister, as with all other government Departments, who will be appointed by the Reichskanzler. The Reichsminister of Health will be responsible for appointing officials under him and for administrating his Department.
2. The Department of Health will hitherto be responsible for establishing, staffing, and running public hospitals across the Grand Duchy. Funds will be allocated by the Reichstag, according to the amount needed.
3. Medical attention will be administered to any who request it, and the appropriate amount of money will be charged to them in exchange for the hospital's services. Those who cannot pay will become indebted to the hospital.
4. The Department of Health will also establish a Sanitation Commission, which will be responsible for:
- Establishing and maintaining sewage and waste management systems
- Establishing and maintaining landfills and recycling plants
- Purchasing and manning waste collection vehicles, which will be responsible for gathering refuse
- Organizing local commissions which will complete these tasks on city, provincial, and district-wide levels
5. Any other responsibilities which may arise but are not named here may be given to the Department of Health by the Reichstag.
Section II
Regarding the Department of Education and its responsibilities.
1. The Department of Education will be administrated by a Reichsminister, as with all other government Departments, who will be appointed by the Reichskanzler. The Reichsminister of Education will be responsible for appointing officials under him and for administrating his Department.
2. The Department of Education will hitherto be responsible for establishing, staffing, and running public schools across the Grand Duchy. Funds will be allocated by the Reichstag, according to the amount needed.
3. The Department of Education will be responsible for naturalizing immigrants.
4. The Department will establish and approve the curriculum for government-funded schools.
5. Primary, secondary, and tertiary education (to the age of eighteen) are available to all citizens without cost; however, parents may choose to personally educate their children or send them to a private school. Children must be educated in some form until they are sixteen. Higher education (universities) will not be run by the state but by private institutions, and will be available at a cost; furthermore, a university has the right to bar applicants from entering and to set their own qualifications for acceptance.
6. Any other responsibilities which may arise but are not named here may be given to the Department of Education by the Reichstag.
Section III
Regarding the National Postal Service and its responsibilities.
1. The National Postal Service will be administrated by a Postminister, who will be appointed by the Reichskanzler and will be responsible for administrating the Postal Service and appointing officials beneath him.
2. The Postal Service will hitherto be responsible for:
- Establishing and maintaining post offices where citizens may mail letters and packages
- Issuing and regulating the price of stamps
- Establishing mail routes
- Purchasing trucks and hiring employees to run these routes
3. Anyone may use the postal service to mail letters and packages to anywhere in the Duchy or its territories, provided it is sealed with an approved stamp; however, mailing to other countries will cost additional money. Furthermore, the state has license to read and censor letters, to search packages, and to arrest and imprison anyone based upon the contents of their mail, should it be illegal.
4. Any other responsibilities which may arise but are not named here may be given to the National Postal Service by the Reichstag.Artice XIII
Artistic expression is warranted to a certain extent. Any artwork of any form that encourages treason or dissent, promotes an ideology that is banned in Article VI, Section I, or derides the government shall be destroyed, and its creator is liable to punishment.Article XIV
This Constitution, recognizing that the place of a woman is at home with her children, hereby bars members of the female gender from serving with the armed forces, pursuing higher education, or entering politics.
Section I
Regarding the specifications of Article XIV.
1. In special cases, as decided by the courts, women may pursue certain degrees in universities.
2. Women may work in military field hospitals, or as secretaries in military administration.Article XV
In order to protect the Capilean people, those who publically declare their opposition to the state, their adherence to any of the ideologies banned in Article VI, Section I, ferment seditious activity, or attempt to convert anyone to this way of thinking, are liable to immediate arrest.Article XVI
In order to shield the Capilean people from unjust imprisonment, the writ of habeas corpus shall be protected under this Constitution. The state must have a valid reason to detain, arrest, or imprison anyone.Article XVII
Public demonstrations which advocate treason or sedition, promote those ideologies banned in Article VI, Section I, or derides the government, shall be disbanded and their orchestrators subject to arrest. Private assemblies in the same strain are also liable to the same conditions.Article XVIII
Those accused of committing a crime are warranted a proper defense.Article XIX
Cruel and unusual punishment, such as torture, is only warranted to certain criminals.
Section I
Regarding criminals who may be harshly punished.
1. Murderers may be sentenced to death.
2. Rapists, child molesters, and sexual deviants may be sentenced to death and castrated.
3. Traitors may be tortured and sentenced to death.
4. Those involved in conspiracy against the government may be tortured for information and sentenced to death.
3. Counterfeiting (see Article XXV, Section II) is punishable by death.
5. The Reichstag may ammend this list.Article XX
Recognizing that through time and with the march of progress that circumstances change and that the authors of this Constitution cannot be entirely clairvoyant, this document authorizes the Reichstag to make amendments to the Constitution.
Section I
Regarding the specifications of amendements.
1. Two-thirds of each house of the Reichstag must agree on an amendment.
2. Amendments may edit Articles and Sections, add new Articles and Sections, or remove Articles and Sections.
3. These Amendments must not contradict each other.
4. Amendments must pass through the same process as other propositions, as outlined in Article I, Section II.
The authors of this document, listed below, now recognize this Constitution as complete and ratify it. This Constitution is now law and shall act as the governing document for the Grand Duchy of Nova Capile, replacing any former instruments.

First Ammendment to the Constitution of the Capilean StateArticle XXI
Ammendment I
Granting the Reichskanzler and Grand Duke the power to enforce a draft on the populace of Capile and her territories, and also to conscript Capileans for the war effort.
Section I
Specifiying the provisions of Article XXI.
1. The Grand Duke and Reichskanzler are the only eligible candidates to propose a draft, which will then be sent through the two houses like any other proposition.
2. In order to be eligible for the draft, one must be a male Capilean citizen, have attained the age of at least eighteen, and be able to pass basic physical and mental examination, as prescribed by the Reichministerium of Defense.
3. Upon turning eighteen, all male Capilean citizens will be responsible for signing up for the draft. Refusing to do so and/or avoiding the draft is a punishable offense.
4. During a time of war, the Grand Duke and Reichskanzler are able to conscript anyone of their choosing without calling a draft, provided they are signed up for the draft or are in prison for committing a felony or higher offense and also meet the requirements of the draft as specified above.
The authors of this amendment, listed below, now recognize it as an official part of the Capilean Constitution.

Second Ammendment to the Constitution of the Capilean StateArticle XXII
Ammendment II
Regarding the means of communication in Capile and the defining laws thereof; also officially creates the Telekommunikation-Komitee (TeleKom), a state committee under the Reichsministerium für Kultur.
Section I
Regarding the responsibilities and regulations of TeleKom.
1. Thirteen TeleKom committee members will all be appointed by the Reichsminister für Kultur and will select from among themselves a Chairman to lead proceedings. In these proceedings, TeleKom will vote on whether or not to ban or dismember radio programs, television networks, and internet websites.
2. TeleKom will be responsible for policing radio airwaves, by monitoring radio programs and banning (and potentially taking action against) those deemed as illegal by Section II of this Article.
3. TeleKom will be responsible for managing television programming, and banning and dismembering programs and networks deemed dangerous as defined in Section III.
4. TeleKom will be responsible for policing the internet and blocking and banning dangerous websites (as defined in Section IV).
5. In order to put force behind the committee, the TeleKom Inquisitorial Board will be established under the authority of TeleKom, and will be responsible for coordinating with local police forces in investigating and arresting suspicious individuals. The Inquisitorial Board, themselves appointed by TeleKom, will be responsible for appointing Inquisitors, who will head official police investigations and operations concerning dangerous television, radio, and internet networks and the individuals associated with them.
6. In order to serve as a board member on TeleKom, one must be a member of the Reichsministerium für Kultur. In order to serve on the Inquisitorial Board, one must have a military or law enforcement background, preferably with a career in intelligence or investigative work.
Section II
Regarding radio communications.
1. All Capilean radio frequencies are hereby considered the property of the Grand Duchy; prospective radio stations and operators may request a frequency to broadcast their programs on, a privilege granted by TeleKom which can be revoked at any time.
2. Programs broadcasting material promoting or sympathetic to any of the ideologies listed in Article VI, Section I, or broadcasting material defaming any of the religions listed as acceptable in Article III, Section I, or calling for treason, sedition, or action against the state, will be immediately shut down by TeleKom, and their creators and employees subject to arrest and punishment as traitors, or whatever the courts deem them as.
Section III
Regarding television networks and services, and the rights and restrictions placed upon them.
1. Hereby declares that all Capilean television channels are property of the Grand Duchy. Prospective television networks may request channels to broadcast their programming from TeleKom, a privilege which can be revoked at any time.
2. Television programs broadcasting material which promotes or sympathizes with any of the ideologies listed in Article VI, Section I, broadcasting material defaming any of the religions listed as acceptable in Article III, Section I, or calling for treason, sedition, or action against the state, will be immediately shut down by TeleKom, and their creators, affiliates and employees subject to arrest and punishment.
Section IV
Regarding the internet.
1. Places all Capilean internet networks under the authority of TeleKom, which will have the power to ban and sequester websites and webpages it deems as traitorous, immoral, indecent, slanderous, anti-religious, seditious, or otherwise illegal.
2. Hereby vests TeleKom with the power to investigate into the owners and operators of websites deemed illegal and to arrest them and bring them to a court of a law whenever and wherever possible.

Ammendment III
Declares that all Capileans have basic human rights, defined in Article, which shall never be infringed upon by the government.
Section I
Guarrantes Capileans the right to food, shelter, and work.
1. Henceforth, all Capileans are entitled to basic sustenance and suitable living space as a necessity of life. Hereby establishes the Arbeitbüro, a new Ministry of Labor under the Reichsministerium of the Interior. The Arbeitbüro will absorb all previous government agencies dealing with employment, including the Arbeitsamt, and be responsible for assigning jobs to all unemployed and homeless male citizens, so they can feed and shelter themselves.
2. The Arbeitbüro may impress workers to:
- Construct or maintain highways and public roads
- Construct buildings commissioned by the Reichstag
- Serve in the Pionierkorps in order to build or destroy roads, bridges, and other improvements for the Capilean (or allied) military (ies)
- Serve in the Volkssturm
3. All impressed workers must be paid a minimum of 3ℛℳ an hour.
Section II
Prohibits cruel and unusual punishment.
1. Cruel and unusual punishment may be used when dealing with traitors to the Grand Duchy.
Section III
Gives all Capileans the right to bear arms in order to defend themselves from foreign or domestic aggressors.
1. All gun owners must first obtain a license from their local police department, or by filing an application with the Reichsministerium of Defense.
2. Civilians are prohibited from owning and carrying automatic weapons and weaponry defined as excessive (see below):
- Grenades
- RPGs and other rocket weaponry
- Short-barrelled rifles and shotguns
3. The right to bear arms is revoked from any citizens found to have committed a crime.

Ammendment IV
Defines the crimes "treason" and "felony," for legal purposes and to clarify and close potential loopholes in earlier legislation.
Section I
Defining treason.
1. Treason shall be regarded as the act of a Capilean citizen waging war or strife against their country, conspiring against the Capilean government or people, providing aid to the enemies of our country, breaching any of their sacred oaths of office, and disobeying the direct orders of the Grand Duke or Reichskanzler during wartime.
2. This legal definition can be added to, shortened, or otherwise amended by the Reichstag.
Section II
Defines felony.
1. A felony is henceforth determined as a crime whose punishment is either death, another form of bodily punishment (flogging, castration, etc.), or a sentence to a prison, as defined by local (District-wide) ordinances, and distinct from misdemeanours, or minor crimes, whose punishments may not extend beyond fines or confinement to local (city or Kreise) jail.
2. This definition may be amended by the Reichstag.

Fifth Ammendment to the Constitution of the Capilean StateArticle XXV
Ammendment V
Establishes the Reichsmark (ℛℳ) as the official and only currency to be used within the borders of the Grand Duchy and its territories.
Section I
Further defining the Reichsmark.
1. The Reichsmark will be backed by gold; two ℛℳ will be equivalent to a gram of gold, or three ounces of silver.
2. Reichsmarks will be printed in denominations of one, two, five, ten, fifteen, twenty, forty, fifty, eighty, one-hundred, two-hundred, and seven-hundred.
3. Reichsmarks will be further divided into decimal denominations of one, five, ten, fifty, and, one and two Reichsmark-coins. These are all to be made of copper or copper-based alloys.
4. All bills will be embossed with the government seal, the signature of the Reichsminister of the Exchequer, and whatever other implements- to be decided by the Reichsministerium of the Exchequer- that are deemed necessary to combat forgeries.
5. The design of each denomination of bill will be decided by the Exchequer; each, however, should bear the likeness of a Capilean leader, landmark, or historical event, and have a unique coloring to differentiate it from other bills.
6. The denominations of coins will be printed in a scaling size, with the lowest-value coins being the smallest, and the highest-value the biggest.
7. Each coin will have on it the year it was minted, the government seal, the name and portrait of the Grand Duke who was in power at the time the coin was minted, and a number representing its value.
Section II
Regarding the printing of bills and the crime of counterfeit.
1. Reichsmarks and coins will only be minted by the national government; mints will be established to produce said currency.
2. Counterfeiting bills or coins- defined as producing currency designed to impersonate Reichsmarks- is a capital offense, and offenders may be put to death.
3. Producing currency to be used to trade goods and services within Capilean borders and without the explicit consent of the Capilean government, but which does not impersonate the Capilean Reichsmark, is a felony.
4. Finally, knowingly using counterfeit currency is a misdemeanor.

Ammendment VI
Regarding legal and illegal substances.
Section I
Defining illegal substances.
1. The following substances and products are hereby banned. Manufacturing or growing, selling, possessing, or consuming these substances and products is a punishable offense:
- Tobacco products, including but not limited to cigarettes, cigars, and chewing tobacco
- Cannabinoids, including but not limited to marijuana and hashish
- Opiods, including but not limited to heroin and opium
- Hallucinatives, including but not limited to lysergic acid diethylene (LSD) and psilocybin
- Stimulants such as cocaine, amphetamine, and methamphetamine
- Methylenedioxymethamphetamine (MDMA/Ecstasy)
- Flunitrazepam/Rohypnol
- Anabolic steroids
2. This list may be at any time modified by the Reichstag.
3. The manufacturing and selling or distribution of any of these banned products is a felony punishable by no less than ten years in prison.
4. The possession or consumption of any of these substances is a felony punishable by no less than two years in prison.
5. Accused users of tobacco products may avoid punishment by renouncing their use of said products and signing up for a rehabilitation program instead. The Reichsministerium of Health will be responsible for furnishing this program for these citizens, who, if they prove to have reformed, will have all charges against them dropped. Failing the program will result in immediate punishment.
Section II
Regarding alcohol.
1. Any citizen over the age of seventeen may purchase and consume alcohol.
2. Purchasing or consuming alcohol for non-religious reasons is a misdemeanor for citizens under the age of seventeen.

I do not mean to offend anyone with this, though I realize that the terms it dictates are considered extreme by today's standards. The extremity of this constitution has a legitimate foundation in RP form, which I shall briefly explain:
For those unaware, the Grand Duchy of Nova Capile was once a totalitarian absolute monarchy ruled solely by a Grand Duke. The previous monarch, Hans Wilhelm, was a rampant imperialist and warmonger, who greatly expanded the Capilean empire, as well as revitalized its armed forces and reinvigorated its economy. Upon his recent death, his son appeared an ill-fated candidate to take the throne. Klaus was the complete opposite of his pragmatic, ambitious, vainglorious father, and his coronation was almost beset by a ripple of treason through the ranks of the aristocracy and military, though civil war was averted at the last minute. Just months into his reign, however, Klaus has issued a decree which caused such controversy that he was almost dethroned in its wake. You see, this Constitution might even be considered liberal by some denizens of the Grand Duchy, such is their conservatism.
Anyhow, I am also aware that some of the stipulations of this Constitution are ridiculous, such as the ludicrous amount of legislators called for. This is intentional; this system is meant to fail, not by its fictional creators (who have no idea how to run a democratic government) but by me.
Finally, on a lighter note, I have proofread this several times through, and I believe that I have caught the vast majority of contradictions and grammatical mistakes. Please point out any I have missed, however.
Oh, and I have tried as much as possible not to "copy and paste" from the U.S. Constitution. It could not be entirely averted (I am an American after all), but I hope that it's at least distinguishable from that document.
