The Organisation of Esquarian Nations
The Organisation of Esquarian Nations is an intergovernmental organisation whose goal is to promote peace, stability and good government across Esquarium. Founded in 2014 in response to the mounting tensions of the Esquarian Cold War in January 2014, the organisation seeks peaceful and diplomatic resolutions to the problems plaguing Esquarium.
The Charter of the Organisation of Esquarian Nations

We, the undersigned,

Affirming our dedication to the pursuit of peace and order within Esquarium,

Declaring our intentions to create an organisation based on the common values of our member-states,

This statute may be cited as the Charter of the Organisation of Esquarian Nations or as OEN General Assembly Resolution 001.

Section I - Founding
The Organisation of Esquarian Nations is hereby founded as an intergovernmental organisation dedicated to promoting peace, stability and good government.
The OEN shall not maintain an armed force and shall not participate in any war as a belligerent.
The OEN shall not appropriate itself the authority to expel a full member for any reason not listed in this Charter.
This Charter may not be repealed. However, it may be amended with a 2/3 supermajority vote.

Section II - Secretariat
The General Assembly of the Organisation of Esquarian Nations shall elect a Secretary-General every 2 months.
The Secretary-General shall not be a voting member of either council of the OEN.
The Secretary-General shall have the final say in matters of procedure raised in the councils.
The Secretary-General shall head the Secretariat of the Organisation of Esquarian Nations.
The Secretariat is responsible for admitting or rejecting members based on the qualifications of this Charter.
The Secretariat shall interpret any vague wording in Resolutions.

Section III - General Assembly
The General Assembly shall have the power to enact international law.
The OEN shall not prosecute or sanction any nation for violating a GA Statute, unless the SC orders it into obedience via way of a 75% supermajority vote.

Section IV - Security Council
The SC shall have the power to commend, condemn and issue international sanctions against nation-states, as well as refer individuals to the Esquarian Court for prosecution.
The SC shall be elected from the OEN's member-states each month.

Section V - Devolution
The following powers are devolved from the General Assembly:
  • Setting and regulating international standards and travel regulation, to be devolved to the Esquarian Organisation for Standardisation
  • Coordinating international medical aid and pandemic response, to be devolved to the Esquarian Health Directorate
  • Coordinating international humanitarian aid, to be devolved to the Esquarian Humanitarian Organisation
  • Coordinating Security Council-mandated non-belligerent peacekeeping efforts, to be devolved to the Esquarian Peacekeeping Command
  • Prosecuting war criminals and criminals against humanity with the 75% mandate of the Security Council, to be devolved to the Esquarian Court
Hereby proclaims the Charter of the Organisation of Esquarian Nations.

GAR 001 - Crimes Against Humanity Resolution

The General Assembly of the Organisation of Esquarian Nations hereby defines the following:

This resolution affirms the Esquarian Court’s right to prosecute with Security Council guidance as per Section V of the Charter of the Organisation of Esquarian Nations.

Crimes Against Humanity

Crimes Against Humanity shall be defined as the committing of the following actions in a wanton, systematic or widespread manner:
  • Murder, Extermination and Torture
  • Rape, Forced Prostitution and Other Sexual Violence
  • Segregation with the Goal of Affirming Supremacy or Domination of One Racial Group over Another
  • Destruction of Cultural Identity
  • Indiscriminate Attacks Against Civilian Populations and Property
  • Rescinding the Rights of a Civilian Population
  • Enforced Disappearance
  • Forcible Transfer of Population
  • Slavery
  • Imprisonment Without a Fair Hearing in an Independent Court of Law
War Crimes

War Crimes are defined as the following:
  • Purposeful Killing of an Unarmed Non-Combatant
  • Knowing Attack Against a Visually-Identifiable Humanitarian or OEN Vessel
  • Forcing or Coercing a Protected Person into Military Service
  • Treatment of Prisoners of War and Other Persons Affected by War in a Manner Inconsistent with OEN Human Rights Legislation
  • Improperly Using a Flag of Truce
  • Attacking a Civilian Centre that is Not a Military Objective or Defended
  • Attacking Institutions of Education, Culture, Religion, Unarmed Civil Defence and Medical Aid that does not offer Armed Resistance
  • Employing Chemical or Biological Weapons Against Civilian Centres
  • Employing Bullets that Expand or Flatten Easily in the Human Body
  • Degrading Treatment of a Civilian, Noncombatant or Surrendered Population
  • Attacking a Disarmed or Surrendered Combatant
  • Conscripting or Enlisting Children Under the Age of 14 (14 including) into Military Combat Service
  • Taking Hostages or Using Human Shields
  • Invading a Sovereign Nation-State without Valid Casus Belli

Applauding the OEN Charter for establishing this organization to create a better Esquarium for nations of all walks of life,

Noting the Charter's good intention,

Drawing attention to Section II of the Charter which states that "The General Assembly of the Organisation of Esquarian Nations shall elect a Secretary-General every 2 months."

Nervous about a Secretary-General-for-life becoming a matter of fact if one Secretary-General is elected over and over again.

Also drawing attention to Section IV of the Charter which states that "The [Security Council] shall be elected from the OEN's member-states each month."

Distressed that elections for the Security Council have not been held nor talked about, even as it has been a month since their elections,

Declaring the following:

I. STRIKING Section II of the Charter and replacing it with "The General Assembly of the Organisation of Esquarian Nations shall elect a Secretrary-General every 4 months for 2 consecutive terms before the incumbent must step down."

1a. It should be noted that the term limit applies if served consecutively. After another delegation has served 1 term, the former Secretary-General may run again.

II. STRIKING Section IV of the Charter and replacing it with "The SC shall be elected from the OEN member-states every two months.

The Swilatian delegate took a seat behind the desk marked "Swilatia". After taking a quick glance around the room, he immediately took out his mobile phone, and started playing games as he waited for the other delegates to arrive. Every so often, and idea popped into his head for a new resolution that would spread his ideals far across Esquarium, even to the darkest corners of Luziyca and Nevanmaa, but once he reached the game over screen, all he could think about was to play another round. He barely even noticed the room filling up with more delegates after every round. Maybe it was time to finally get to work on that resolution.

After about twenty minutes, the delegate of Unolia rose.

"Delegates of the nations of Esquarium, I am alarmed by the breaching of the rules that we see today. We are approaching the end of March and the Security Council has yet to relinquish their seats and open elections in their respective ridings. But I don't blame the Security Council seats, nor do I blame the Secretariat for this error. I blame the rules themselves.

The terms are too short to get anything done and then organize legitimate, timely elections for both the Secretary General and the Security Council. I intend on fixing this problem, lest we forget the elections and any diversity of nations in the most powerful organs of this body.

I rise to amend the Charter before a problem such as this arises. Although it is no secret that the government of Unolia would like to see the Security Council lineup changed sooner rather than later, we realize that we, as a deliberative body, must make the rules more efficient so that all nations can have equal say in the long run."

The Holuse delegate took a seat in the H section, fairly close to the Ghantish and Iglesian delegates. She watched in disgust as the Ghantish delegate took a bite of his chocolate donut.

He looked at the Ghantish delegate devouring a donut and thought to himself, "Ghantarbarian," and passed a note to the Holuse delegate to ask if she was free for lunch later.

"Seeing as we have so much support from several power players in the region and literally no opposition besides the Honorable Vyvlander delegate offering a friendly suggestion, the Unolian delegation motions for this resolution to be put to vote."

The Ghantish delegate, previously unaware of a seating arrangement, gets up and walks over to the G section. He noticed some odd looks from the Bretian and the Holuse. As he walked away to the G section, he looked back, raised his glass and smirked.
