[ABANDONED] Legal Divorce Rights

Legal Divorce Rights

Proposed by: Northern Slatavia

The World Assembly,

Recognizing that marriage is a legal relationship that should not become an involuntary lifelong obligation,

Acknowledging that the ability to legally end a marriage is an important aspect of personal liberty and equal treatment under the law,

Concerned that in some nations individuals are prevented from obtaining a divorce or face barriers that leave them trapped in unwanted marriages,

Believing that fair and accessible divorce laws strengthen justice while protecting the dignity and legal rights of all people,

Hereby:
  1. Defines "divorce" as the legal termination of a marriage through procedures recognized by the state,
  2. Affirms that every legally married individual has the right to pursue a lawful divorce without discrimination,
  3. Prohibits governments from imposing arbitrary restrictions that prevent a person from obtaining a legal divorce,
  4. Ensures that both parties are entitled to equal treatment and due process throughout all legal divorce proceedings,
  5. Clarifies that this resolution does not regulate the distribution of child custody or child support, which shall remain subject to applicable domestic law, and applies solely to the dissolution of marriage by government,
Declares that nothing in this resolution shall be interpreted as limiting any person's right to obtain a civil divorce under the law or regulating religious marriage or religious divorce.

All for, but those against would likely claim this is an attack on religious freedom. Specifying this does not address religion and only legal recognition of marriage would address this.

Meraud does not recognize marriage as anything other than a long-term sexual contract. It is up to the signatory parties to determine the terms of their own contract.
Meraud does not have civil courts, and any 'divorces' must be done through privatized arbitration.
Meraud is a fictional underwater nation set 20 years into the future which is a utopia (or dystopia depending on your worldview).

Urcea will not support this legislation on the grounds that it impedes national sovereignty in the area of family construction. We would also note that there is conflation of religious and legal marriage, though we understand there are efforts to remedy this. I would note that Urcea probably would adopt the resolution if passed on the grounds that it apparently seeks to only cover legal separation.

The Delegation of the Several States opposes this resolution. There is a back door created to requiring allowance for divorce if the marriage is recognized by the state.

So this proposal has no effect on nations who only recognize religious marriages even if religious marriage in that nation includes all the legal aspects of a civil union?

My guess would be a mix of the sovereignty first crowd and the fact marriage, while possible to split into religious and civil versions, is often considered as one being inseparable from the other by the more theocratic nations. Hence this proposal could be seen as an attack on religious expression to some.
