[preemptive draft] Repeal Debt Collection Act

Any of the heavy hitters on the forum want to help me tidy this up, it would be greatly appreciated.

I had reconsidered doing it, but having read the comments on the thread, this horse needs shot and fast.

Repeal WA#"x" Debt Collection Act

Acknowledging the positive intentions of the Debt Collection Act,

Recognizing however, that this resolutions passing ultimately hinders legitimate business in their pursuits and opens up several loopholes to abuse and deception.

Noting especially, the poor grammar, the ambiguity of which prevents the resolution from being enforced in any way, and the general lacking of the act itself,

Outraged and disgusted that the passage of this resolution allows for the contravention of the WA mission statement by both regulating issues of a non-international concern and furthermore doing so poorly and putting members at risk through it's poorly thought out mandates ie;

(i) the prevention of entry to a non private residence;

"If the indebted individual is not in a physically healthy state to permit and/or enact the transaction. (as judged by a relevant medical professional"


Which is subject to abuse by both the "afflicted" and the "medical professional" and noting the act itself makes no provision for the same physical health requirements should an individual reside in a private residence.

(ii) the prevention of entry to a private residence

"Via means of force, including the breaking down of doors and windows"


Which inevitably will prevent the entry by police and customs assisting a legitimate "lender" to a premises purposely evading repayment due to the inflexibility of this acts poorly thought out mandates.

(iii) Lenders may not enter private property to receive debt payments:

When admitted by an individual who does not own, or partially own the property


Thereby exempting lease holders, renters and otherwise contractually bound tenants who reside in, but do not "own" the properties in question from due process.

Furthermore sickened that the resolution was hastily drafted and proposed without international consultation or revision, nor a willingness or want to seek council after these points were addressed which ultimately could have prevented the damage this act has done in its passage.

Hereby, repeals WA#"x" the Debt Collection Act.

Needs stronger words than "Disheartened". How about: Seething, Outraged, Devastated, Mortified, Despairing, Vengeful?

On a serious note, I'll look at this later if the proposal actually passes. I feel the time spent working on a draft that may not be needed would be better spent improving or hindering some other proposals. Unless you're going to use this as a threat to make voters vote against the proposal, which seems unlikely.

Nah, the whole "counter campaign" strategy, doesn't really float my boat, nor does the smear campaign etc... etc... but it mightn't do any harm to have this ready to shoot should the unthinkable happen.

Truth be told, as proof readers go, i'd be glad to have you on side, but when you're not tied between a multitude of things of course, many thanks Matthew.

The emotional word suggestions were a joke, by the way. I didn't think you'd actually change the resolution. Normally the most I'd go for in this situation is 'REGRETTING'. :P

We have a suggestion for a point to include:

In the first set of conditions, the proposal effectively shields renters from debt collection because there is no ownership of the property by the renter. In this way they wouldn't be able to admit the lender. Rental does not equal property ownership.

Lenders may not enter private property to receive debt payments:

When admitted by an individual who does not own, or partially own the property.
