1) This thread is OOC. The issue has gotten too hot to have a respectable RP with the subject. Keeping this thread OOC will help keep things brief, to the point, and on-topic.

2) This thread is Closed. Kázmér Doctrine members only.

3) The objective of this thread is to discuss whether the IC actions of Libertarian Governance lately are acceptable or not for a member of the Kázmér Doctrine organization. If the actions are found to be unacceptable, then the discussion will, at that time, turn to what to do about it. Anything else is off-topic, and should be discussed elsewhere.

4) Keep it civil. We're not here to discuss how we OOCly feel toward each other as players, which for some the relationship is pretty poor at this time. Disregard of this provision from any player will be grounds for Moderator intervention. If you do not feel that you can have a mature and rational discussion, then you're not welcome to participate in this thread.

5) The order of the proceedings are as follows:
--1: Per Kázmér Doctrine principles, the quorum of 5-or-more must be formed. They can't include the accuser or the accused. Two of those spots are for FU members, three of those must not be FU members. Beyond that minimum of 5, it will also include any other KD members who announce that they intend to participate.
--2: Monavia posts his case against Libertarian Governance's IC actions
--3: Libertarian Governance posts his rebuttal
--4: Discussion by all participants, to be left open for 3 RL days to give every participant a chance to speak their peace
--5: Vote by KD members, to be left open for 24 hours.
--6: If the result of the vote is that LG's actions were unacceptable, discussion will be open for another 24 hours to discuss courses of action, and then another 24 hours to vote on them.

6) The conclusion and courses of action decided here will be ICly binding, and canon.

For the purposes of consistency, I request that the scope and focus of these investigations are limited to the misconduct committed by the LGDF and those sanctioning its actions. Objectionable conduct on the part of other national parties in the war against Drackonisa shall be dealt with at a later time if at all.

I will state each charge separately, including information that is quoted from posts that shall serve as evidence of said charge and a link to the post from which the quoted material was derived.

THE CHARGES

Charge 1: Deliberate attacks on civilian transportation with the intent of killing masses of civilians.

The websites of government ministries were targeted to display misinformation. Leading that effort was a fake letter signed by Emperor Dracos and blaming several members of the High Command with attempting a coup while ordering their arrest. The hacking attacks grew in intensity and force with every passing minute. News outlets came under denial of service attack as did the entire banking system. A dedicated attack was made against the nations AI controlled subway system with a viral subroutine designed to crash subway trains into each other. The cyber attack would continue for hours and then stop as suddenly as it had began.

This conduct is objectionable because there is no regard for collateral damage, there is no regard for the possibility that neutrals may be on board these trains, because these targets have questionable military value at best, and because they are indiscriminate in that there was no effort made to determine if the people to be killed were even guilty of any crimes.

This conduct resulted in the following:

The subway system was one of the key targets, the AI, a LEGION variant, had nearly succumbed to the attackers. It had managed to clean out the viruses in time to prevent a major accident though not before 4 trains had collided and killed 800 passengers. Being a variant of LEGION, the AI still possessed much of its self learning capabilities, albeit in a more restricted manner. Adapting to the attacks and locking out any further intrusions, the AI announced the return to normal services and began organizing a clean up of the trains that were hit during the virus attacks.

Charge 2: Indiscriminate and unjustified attacks on fleeing unarmed neutrals.

Heaven's Gate
The evacuation was still ongoing, with the multitude of civilian jets ferrying the millions of tourists and foreigners out of the orbital elevator. War was coming, and Drackonisa has little intention of involving foreign civilians in this conflict. Riots and protests were now starting to form, as those who had investments and homes here for years now began voicing their discontent at being forcibly evicted. Several had made claims of wanting to stay and protect their homes. However, for the coalition government there, there was no room for negotiation. The emperor had already made it clear for the innocent to be sent packing to their country of origin, and dissenters were being handcuffed and tossed on board the first flights or ships home.

As the Libertaian Government fleet now blockaded the Northeastern exit, the Drackonisians finally made an official request for the hostile fleet.

Ceasefire on ships and planes on approach to your location, they are civilian vessels now leaving the region to their home countries. Any attempt to fire upon these vessels will result in a retaliatory strike on your fleet.

The elevator now began its preparations for war, built in SAMs and tactical lasers along the length of the elevator was being deployed alongside the various defenses of its surrounding islands to defend it while the fleet stationed there received reinforcements in the form of Fort Ulna, now dispatched to ensure the survival of the elevator. With still 100 over million foreigners trapped in the elevator, the evacuation efforts was a logistical nightmare. With the millions of lives at stake here, the repurposing of the elevator's massive railguns out in orbit was being considered for use for the first time against surface targets. Usually utilized for clearing of dangerous space debris and objects, they possessed enough power to defend the elevator if necessary.

Enforce the blockade.

The Libertarian Fleet was spread over hundreds of kilometers of ocean. It had AWACS airborne and the over the horizon radar of the fleets two SuperDestroyers. The outer most edge of the fleet was patrolled by small, fast littoral combat ships. While underneath the waves Krakon attack submarines lurked with their sensors on passive.

The first ships and planes fleeing Heavens Gate were some 800 kilometers away when the the Free Republic struck. A simple message was broadcast across thousands of frequencies which begin with those frequencies used by civilian traffic in the area.Drackonisa is under quarantine, immediately return to port. As the radio broadcast went out each of the Fleet's 40 cruisers fired a dozen Tigershark stealth cruise missiles into the air.

The anti-ship Tigersharks were fired at the nearest ships with one missile aimed at each ship. Additional volleys were ready to fly should the ships refuse to turn around. At 600 kilometers long range anti-aircraft missiles would begin to fire on aircraft that did not comply with the LGDF order. Across the fleet carriers, Chimera ATF were launching into the air. Each Chimera was equipped with extra fuel tanks on each of its external hardpoints.

Armed with 4 Spike AMRAAM, 2 Spectre BVRAAM and 2 ASP HARM, each of the Chimera was ready for a variety of air or surface threats. As the Tigersharks closed on their targets, platoons of soldiers were readied on board helicopters among the amphibious assault ships. The troops would be charged with taking control of ships and removing any slaves on board.

Manzano flicked over to the latest aerial imagery provided by Project Black, viewing the area around Heaven's Gate. Surrounding the islands were a mass of naval vessels, probably of Allanean or Libertarian origin. He switched to a real-time aerial tracking system. Casualty chimes sounded through the speakers at around the same time that civilian vessels - YellowApplan civilian vessels - started disappearing from view with a red blink, replaced by ominous X markings.

To the Respective Military Leadership of the Libertarian Governance, Allanea, and Drackonisa:

We are aware of an armed conflict involving your forces that seems to be revolving around the Heaven's Gate Orbital Elevator in Drackonisan territory. Our security reports also indicate that multiple YellowApplan civilian vehicles have been targeted and destroyed by one or more of the involved naval forces.

Collectively, the Nomadic Peoples of YellowApple request that further aggression against YellowApplan civilian and military craft be avoided. We are a neutral and non-hostile faction, and wish to remain so. Further attacks on our people will be seen as an act of war by all parties involved.

We look forward to peace among our nations, and hope that this conflict may be resolved with minimal civilian casualties.

Back in the palace, emperor Dracos issued a statement regarding the blatant targeting of civilian ships fleeing the warzone.

Today is a dark day, for both Drackonisa and the foreign guests staying in the country. The barbaric atrocities committed by the LG forces today has led to the deaths of nearly half a million innocents. I, as emperor pledge that no more needless lives shall be lost. We will defend all foreigners currently staying in the nation. However, I beseech those capable of bearing arms to do so, and contribute to the defense. The invaders have proven their intentions of killing everyone, regardless of whether they are Drackonisians or not. If you wish to survive through this ordeal, then stand with us. We will not allow their actions to set a precedent for destabilizing this world any further. We shall show their attempt to upset the established order and plunge the world into an endless cycle of bloodshed and slaughter will not succeed. Citizens, foreign guests, I beseech you once more for your support in this war. You fight not only for your homes, but for your very lives as well.

Charge 3: Seizure of neutral transport ships and the employment of excessive force against crews against whom no formal charges were ever filed.

Armed helicopters swooped down on to the decks of the transport ships. Archangel Gunships escorted swarms of Wwyvn helicopters at 500 kilometers a hour. Each Archangel sported a case-less 30 mm optically guided cannon that could spit death at 10,800 rounds per minute. Rockets hung on fold out wings.

The Wwyvn disgorged a platoon of heavily armed infantry behind a flurry of flashbangs and stun grenades. Get down, down on the ground, on the ground! The young Red Targa troops assaulted each ship. Firing into the air to promote fear and panic they advanced brutally putting down each person standing. Kicks, punches, elbows and the butt of rifles or use of hand to hand skills. At the slightest hint of resistance troops hosed the passengers with 6.3 mm rounds from their Shrec AWS case-less rifles.

You are under arrest for violation of our Crimes Against Humanities Acts! Soldiers shouted war cries as they ruthlessly moved forward in an effort to take control of each ship.

Tourist Ships

Gunshots rang out as troops stormed ship after ship. Menacing and brutal the soldiers moved with audacity to secure each vessel. As the heavily armed troops assaulted ship after ship, gunships and the armed transports provided cover from above.

Occasionally mini-guns and high rate of fire case-less weapons barked at those not complying with the orders of the LGDF forces quick enough. The Littoral combat ships continued their own envelopment of the fleeing transports, using their rapid fire deck guns to disable the bridges of the ships at times.

Minutes later 6 UH-5 Wwyvn helicopters hovered over the deck as heavily armed Red TARGA troops rappelled to the ship. Flash bangs exploded repeatedly sending terrified passengers scrambling for safety. The hellish cracking of case-less 6.3 mm rounds fired with quick burst of death at 1800 rounds per minutes door gunners fired occasionally into the crowd of passengers.

Since the missile attack on the passenger ships the LGDF had followed a familiar plan in assaulting and capturing With the helicopters the LGDF was able to land its initial troops on the ships superstructure, controlling the high ground and deck with sharp shooters. Subsequent helicopters landed more soldiers who used firepower and violence to subdue the vessel.

22 year old Corporal Marcus Shipley stood on a deck awash in blood. Bodies lay everywhere as he moved forward from his chopper. AWS held for point shooting. Without a word he brought his weapon up and squeezed the trigger sending a three round burst into a man about 20 meters away. Hit in the chest the man crumpled to the deck.

Continuing to advance Corporal Shipley entered a hatchway behind a teammate with a automatic shotgun. They advanced down the hallway, Shipley to the left and Corporal Martin on the right. Bodies of the dead were intermingled with those prisoners cuffed with plastic restraints.

The LGDF had the intent of capturing as many of these vessels as possible. Surviving crews and passengers were to face crimes against humanity trials as an example to all who trade and cavort with slavers. Though the use of TARGA troops instead of commandos meant that firepower and force were first with enemy casualties expected to be high. And they were high as LGDF troops preferred hand grenades and automatic fire to clear rooms while just the look of hesitation was often enough to get a passenger shot dead.

Smoke, blood, shouting, screaming and crying conspired to invoke the most horrific scenes of punishment and torment. The LGDF was merciless in its advance. Seizing ship after ship while conducting precision missile strikes on those ships deemed too far away to capture. Those fleeing burning vessels were often subject to strafing runs by gunships. The messages sent over the radio waves were clear, surrender or die.

Charge 4: Charging individuals with crimes using only their presence in a conflict zone as evidence.

Move and you will be shot! Sergeant Montague pointed a vicious looking platinum plated and jeweled submachine gun at a group of passengers currently being held at gun point. You are all charged with aiding and abetting slavery. The troops meant to take each ship into LGDF custody.

Further back and moving at 60 knots Littoral Combat Ships moved towards the vessels fleeing Heavens Gate. On board the troops would be very thorough, searching the passengers, cuffing them where possible, searching and securing the ships. The Littoral Combat Ships were extra firepower for the Free Republic, equipped with both rapidfire guns and cruise missiles. In time the LGDF would separate out any slaves though now they took everyone into custody to face trial under the LG Crimes Against Humanity Acts and then hanging if convicted.

Underneath the waves Krakon submarines continued to move forward but now increased their speed to 45 knots. While it will take the ships considerable time to catch up to the swarms of helicopter borne troops, the subs would form a perimeter and the surface ships depth.

Over the Libertarian Governance fleet, Chimera ATF formed up as they prepared to move as one on Heavens Gate. The aerial strike force was configured from pilots of 20 Supercarriers. They were 5000 kilometers out.

Charge 5: Attacking foreign neutrals on Drackonisan soil.

Administrative Suite, Capitol Component, Manzanopolis Prime

Administrator Manzano looked on at his workstation's screen in disappointment. He had already broadcasted multiple bulletins warning all air traffic to avoid Heaven's Gate until the conflict was over, and for those attempting to escape to not do so. Now he stared blankly at the geolocation signals of various YellowApplan aircraft vanishing entirely. Whoever was doing the shooting was not letting up, despite him personally making YellowApple's neutrality and pacifism clear. Not even the courtesy of a reply to explain why whatever faction was responsible was so hell-bent on not letting anything through, no matter the intentions. Drackonisa's most recent Imperial bulletin was no more comforting, although not quite discomforting, either, as it clarified that Drackonisa was certainly not the one gunning down unarmed passenger craft.

Manzano estimated somewhere around 500,000 YellowApplans in Heaven's gate, mostly vacationers, and hopefully armed with at least handguns. He brought up the messaging system once again, typing away at the transparent keyboard, the keys lighting up as he typed.

With the ships and aircraft forced to turn back, the ports were bursting with the thousands of passengers disembarking from the evacuation ships and herded back to their homes. The officials were swamped to their necks with work cancelling the entire evacuation plan. With the blockade on the northeast and the fleet still engaging Allaneans in the south, there was no place to flee. With no alternative, the administration began enlisting any able-bodied citizens willing to defend themselves and assigned them posts in the defence. Every citizen and foreigner had a part to play in the invasion, be it as logistics staff or manning one of the many anti-aircraft batteries setup around the city.

Charge 7: Using weapons of mass destruction against civilian targets.

Arville Command Bunker - Libertarian Governance

Reaper, a constellation of leading edge satellites that the Libertarian military used for reconnaissance, communication, satellite warfare, missile defense and if needed strategic nuclear and biological strikes, had been activated with the initial attack on Drackonesian satellites. Libertarian Governance kept a large number of fusion weapons and many said biological weapons on orbital strike platforms. While, the government refused to acknowledge specific strategic systems it was oft spoken that any attack on Reaper would result in a full scale nuclear strike.

No one had ever tried to take on the satellite network, which like many Libertarian weapon systems was built on cutting edge technology. The Reaper satellites used movable radar and IR absorbent balloons to hide themselves from tracking. Though nothing was perfect attacking a nuclear armed satellite that could place a fusion weapon on a target in a matter of minutes was evidently a risk most nations had decided not worth the gamble.

Arkady Korabelnikov finished speaking and watched the second of three green lights, light up on the observation screen. Chief Executive it is now time for your code.

Robert Stratton looked at Arkady a moment then to the card he held in his hand. Reaper. I am Chief Executive Robert Wilhelm Stratton. Code is Delta, Mike, Echo, one, seven, one, kilo, kilo, fiver, nine, zero, zero, kilo.

Voice print confirmed, code confirmed. Strategic systems are now armed

Robert stood and walked around the conference table. Arkady, you are authorized to initiate Operation Archer.

The Supreme General spoke into a headset mic and moments latter, several hundred 100 kiloton dirty fusion weapons laced with the weapon's tamper of ordinary cobalt metal, which the explosion then would transmute to the radioactive isotope cobalt-60, which would produce deadly nuclear fallout that would keep killing for years. The weapons would not fall like ballistic missiles. Instead their rocket motors would place them into a decaying orbit, similar to a FOBS weapon making them extremely hard to intercept. Using nightmarish speed and pinpoint accuracy the warheads would home on the tethering cables air bursting for maximum damage.

Over the next 10 minutes warheads begin tracking to the tethering cables away from Drackonesia first. Those anchor islands holding the cables passing through the Imperial Reich and British Prussia districts would be hit first with the last weapons attacking the base of the tower itself. Each warhead is a master piece of killing utilizing counter measures equipment to avoid interception as well as speed.

IC: The nukes impacted, destroying large swathes of the artificial islands which supported the massive tower. As the nuclear bomblets from Allanea impacted the structure, the orbital elevator gave way and began toppling towards the ocean. The choking dust clouds from the collapse wrecked jet engines and sent tsunamis racing towards Drackonisa, sending yet more waves of destruction. Drones spiralled out of the sky alongside other aircraft, their jet engines ruined by the thick clouds of dust tossed into the air.

Out in space, the tower's pinnacle station detached as the tower below snapped nearly into two. Dragged by earth's gravity, large chunks of station parts sent hurtling towards the defenders and invaders alike. The surviving UAVs were the first to react, desperately trying to dodge chunks of debris hurtling at them and firing off their onboard munitions in a vain attempt to stop the manmade meteor shower. Defenders on ground aimed their weapons skyward, seeking to destroy as much of the falling chunks as possible.

At the Drackonisian fleet, the invincible class dreadnoughts received clearance and launched their nuclear tipped apocalypse ICBMs, 50MT warheads sent racing towards the Allanean fleet in reprisal for the nuclear strike. In space, the orbital weapons platforms fired their last munitions at the LG fleet, railguns sent slugs racing towards the enemy fleet in a reprisal strike. With no further means of resupplying themselves with the loss of heaven's gate, the satellites simply went silent as their last ammunition stores were used up.

The Drackonisian death toll now rang up to the millions.

Drackonisa suffered a deadly orbital nuclear bombardment and along with strikes by Allanea was broken and forced to surrender its position. The wrath of the Republic's strategic weapons destroyed Heavens Gate and facilitated a giant tsunami that overran Drackonisa causing unparalleled destruction and casualties. Still the loss of life to the LGDF was considered unacceptable to Robert and virtually everyone else in Libertarian Governance.

Charge 8: Unethical judicial abuses and the stretching of the definitions of what should be considered capital offenses.

Now, having been transferred to Libertarian Westphelia, a colony far from the Libertarian continent, those prisoners faced trials under universal jurisdiction and under laws that made it a capital crime to conduct any sort of business with a state practicing slavery.

The start of trials had somewhat appeased the Libertarian population who had seen trials for years that had stretched the necks of slavers. For a country that demanded vengeance for their dead sons and daughters the prospect of hanging hundreds of thousands of slavers and their supporters fit the bill perfectly.

Streamed across the airwaves were video images of large groups of prisoners held in open air camps. Judges arraigned hundreds at a time from remote locations.

Your are charged with conspiracy to commit a crime against humanity to with you're accused of providing aid and comfort to slavers. All who plead guilty so state! Hundreds of hands went up, people who decided it was better to plead guilty and accept the five year sentence offered then to fight the case and face the gallows.

All who plead not guilty raise your hands.

I object! Kennington Brewer one of the nations foremost defense lawyers defending a group of 250 prisoners sternly rebuked the court. Your honor this is an outrage! these people were simply vacationing in Drackonisa when war broke out and there is no evidence, not a shred of evidence offered that any of them participated in the slave trade. There are 62 children here!

1. The LGDF had maintained a blockade against a country engaged in hostilities. Said, vessels that you are speaking of left a base used by the Drackonesian military and proceeded towards LGDF vessels. I do not recall reading anywhere that the ships were radioed anything specific to this effect. I recall reading that ships were fired upon without any such notice.

2. Boarding was done in accordance with standard procedures against slavers and vessels coming from slaver waters. These actions are conducted daily by nations around the world. Troops utilized flash bangs to bring the crews under control and only executed deadly force when LGDF personnel were in life threatening situations. Your claims of summary executions are outrageous and patently false. 3. All persons on trial are on trial for their participation in and aid to the Drackonisa slave trade. Unlike their victims we have accorded said prisoners full due process rights. Again, please note that Monavia's official position on the effort to end slavery is that national sovereignty is a legitimate defense for keeping the practice legal within a country's borders. Monavia is against slavers violating sovereignty and international law in order to perpetuate their business. In other words, Monavians do not mind if slavers "keep it in the closet" but mind quite a lot if they "bring it out of the closet." At no point was national sovereignty stated to be an absolute or blanket defense.

4. We don't recognize any organization as the Kázmér Doctrine.

Signing a treaty signifies recognition. Since LG did not withdraw from said organization, they are still bound to recognize it. The attempted retcon does not cover this because it was issued after this statement was made.

6. Your claims against Libertarian Governance Judges is ludicrous. Any meritorious claim of defense made in a LG court will be considered by our judges. Judges are charged with zealously protecting the individual and inherent rights of the accused. The conviction rate in LG courts is less than 50% due to our judges adherence to their Constitutionally proscribed duties. To see the ridiculousness of your claims one only has to look at the recent ruling by Judge Christiania Tucker on Permanent Indentured Workers found to have been mistakenly taken prisoner. That ruling, rightfully, has led to hundreds of dismissed cases and there are several thousand more cases pending review for possible dismissal.

7. Regardless of the nations flag, any ship or crew suspected of involvement in the slave trade will be seized. We care not whether the vessels nation acquiesce to that seizure or not. We also refuse to give any quarter to those cavorting with slavers or to those aiding and abetting slavers in the commission of crimes against humanity.

Charge 11: The judiciary of Libertarian Governance released captured slaves which were actually convicted felons serving penal sentences.

The request from LG for the records of those sentenced to the permanent indentured workers program has been received and approved.
