Oh, they should just try to use it. At least, that will be up to the prosecutors to do. They would call upon it before a judge, and then the judge can decide whether it applies or not. The International Court of Justice in the Hague has already cited it with effect, so I think it would be agreeable to use the DARS. Especially since it's common international law, which means it's universally accepted.

And, of course, they are the victors. They can decide whatever the hell they want. In historical wars, the legality of actions has never been questioned that much after great wars. In my opinion, the Nuremberg trials were for a large part illegal actions, for a large part not based around actual legal principle. They violate some of the core principles of legality, but when dealing with Nazi war criminals, people really didn't seem to care that much.

Character Biography: Born in 1947, Estavan was a military man all his life, and ascended to the rank of general by the time of the coup against Noriega, joining two higher ranking officers in their storming of the Palacio de las Garzas where Noriega resided. The two higher ranking officers betrayed one another and a shootout left both of them dead, leaving Estavan to take command of the country.

Vladimir Vladimirovich Putin, born 7 October 1952), has been the President of Russia since 7 May 2012. Putin was Prime Minister from 1999 to 2000, President from 2000 to 2008, and again Prime Minister from 2008 to 2012. During his second term as Prime Minister, he was the Chairman of the United Russia Party, the ruling party. He a very popular leader, even in the face of the economic decline that came with EU and UN sanctions. His near godlike status has taken off with victory in WW3 and the success of "Operation Apocalypse". The Russian economy has grown tremendously after this, and now at the coming Tribunal he is eager to see the western powers punished for their crimes against humanity.

However, Putin has little experience in a courtroom, although he did study law at Leningrad State University. He specializes in international law, which should help him in the coming tribunal.
