Postby Quelesh » Sat May 01, 2010 7:31 pm

OOC: copied and pasted from another thread, since it's basically the same stuff about age restrictions. Also tl;dr.

IC:

Quelesh is largely unstratified on the basis of age, and there are no formal age limits set in law. Private institutions occasionally discriminate on the basis of age (against either older or younger individuals), but this is looked down upon.

Voting - no age limit. Quelesh has universal suffrage for all citizens, and voting is not restricted on any basis.

Working - no age limit. Anyone who wishes to is able to work for money, and young people entering into apprenticeships to learn a trade is very common. (Note that Quelesh is a member of the World Assembly, but since our "age of majority" is statutorily defined as the moment of birth, and we have no "age of consent" as such enshrined in law, GAR4 "Restrictions on Child Labor" does not apply to us.)

Alcohol - no age limit. Alcohol is legal for all people, and there are no restrictions on its manufacture, sale, distribution, possession or consumption. The government runs a public education campaign of sorts, distributing information about the chemical and physiological effects of alcohol and the potential dangers of overuse. Alcohol is generally used moderately in Quelesh, though there are plenty of isolated incidents of irresponsible use. The only restrictions on alcohol use are for some people on post-release supervision (the equivalent of probation) for criminal offenses committed while intoxicated, but even then restrictions are rare.

Smoking - no age limit. Smoking is quite rare in Quelesh, due to a public education campaign distributing information about the effects of tobacco and nicotine, but there are no restrictions upon who can smoke. However, smoking in an enclosed area is only allowed if everyone in that area explicitly agrees that you can smoke there (thus prohibiting smoking in enclosed areas where there are people who cannot explicitly agree to it, such as infants, comatose people, etc.)

Drugs - no age limit. All drugs are legal for everyone. The principle of bodily sovereignty is held sacrosanct in Quelesh; every person has the inviolable right to decide what to do with his or her own body, including what substances to consume. The only legal restrictions on substance use are for certain people on post-release supervision, similar to such rare restrictions on alcohol use.

Military enlistment - no age limit. People of any age may enlist in the military or (with the appropriate training) become officers. There are relatively few restrictions on military enlistment in general, though the armed forces has policies prohibiting enlistment by those who have committed certain crimes (though for most crimes, the ex-convict can enlist after a certain length of time has passed). There are also testing requirements, so those under a certain level of physical prowess or intellectual capacity will not be able to enlist. There are no minimum terms of enlistment, so people can leave the military at almost any time (with obvious exceptions during battle or in a war zone), though they must return all military property.

Legal contracts - no age limit. Anyone may enter into a legally binding contracts, though there are restrictions on which kinds of contracts can be legally binding in the first place (usually those involving payment for services rendered). Contracts can be nullified if a party or his or her attorneys can show that he or she was not capable of understanding the contract at the time of signing.

Marriage - no age limit. There is no institution of legal marriage in Quelesh, so, as far as the government is concerned, no one is married at all. People (in romantic relationships, or business partners, or for other reasons) sometimes enter into contracts regarding property transference, next-of-kin rights, power of attorney, etc. And some romantic partners have public ceremonies of commitment similar to marriage, though these have no "official" consequences.

Sex - no age limit. Sexual activity is generally not considered to be sacred or taboo in Quelesh, though there is a philosophical school that postulates that sexual pleasure is the ultimate human experience in life and the primary gateway to a wider understanding of the world. It is illegal to engage in sexual activity with any person who does not consent to it, and "consent" is defined in such a way as to allow for the conviction of a person who engages in sexual activity with someone who, while not resisting or objecting, does not understand what is going on. This is determined on a case-by-case basis. (The age provisions of WA GAR16 "Sexual Privacy Act" do not apply to Quelesh; there is no "age of consent" in the law, though the "age of majority" is statutorily set as the moment of birth, so that is the legal age for the purposes of that resolution. GAR19 "Child Protection Act" also does not apply, since, under the definitions of that resolution, there are no "children" in Quelesh.)

Driving - no age limit. There are various land-based transportation vehicles in use in Quelesh. Most people either do not need to drive because they live within walking (or bicycling) distance of everywhere they need to go or because they primarily use public transportation, but anyone is able to drive so long as they have a license. The only requirement to get a license is that one passes the driving test, which is relatively difficult. Some slow, low-powered vehicles, though, do not require a license.

Flying (piloting) - no age limit. Piloting is treated in a similar manner to driving, though all aircraft require a license to operate. The training and testing requirements to get a pilot license (there are various graduated levels) are more stringent and extensive than for driving land- or sea-based vehicles.

Gambling - no age limit. There are no legal restrictions whatsoever on gambling in Quelesh, though most gambling is done for small stakes.

Medical consent - no age limit. Any person of any age may freely choose to have medical procedures performed on them or refuse consent for any procedure. Neither parents nor anyone else can force anyone or prohibit anyone to have any medical procedure done or take any medical drug - the principle of universal bodily sovereignty applies here.

In general, Quelesh is a "non-ageist" nation that does not make a distinction between one class of individuals called children and another class of individuals called adults.
