CHOPINBURG CRITERIA

The following document presents the set requirements required to be considered for Democratic League candidacy for full membership which has been signed and ratified by the present members in conjunction with signing the Triumvirate Treaty at Ekaterinberg in June 23rd, 2015 by the Federal Republic of Eslovakia, United states of Euro Asian Republics and The Federal Republic of Nueva San Cristobel. The CHOPINBURG CRITERIA applies to all nations applying for candidacy as of August 1st, 2015.




1. CANDIDACY AND MEMBERSHIP PROCESS

(a.) All Triumvirate members must unanimously agree to the membership process of the candidate nation.
i. All members regardless of Triumvirate have say in the nation’s candidacy application.

(b.) All candidate nations must receive two thirds of the vote for membership.
i. If candidate receives less than two thirds, candidate nation may appeal for DL individual partnership alliance status.
ii. Intensified Dialogue talks may be pursued amongst member states if appeal for DL individual partnership alliance status is successful.

(c.) All candidate nations applying for membership status must submit reasoning of membership containing, political, economical and defence reasoning.
(d.) Once accepted, candidate nation must accept the responsibility of collective mutual defence of all member states contributing in any shape or form of appropriate measure.


2. POLITICAL REQUIREMENTS

(a.) All applicants must have a fully functioning stable democratic government.
(b.) All applicants must make sure that their political system is in line with the Charter of Fundamental Rights of the Democratic League


3. DEFENCE REQUIREMENTS AND RESPONSIBLITIES

(a.) All candidate nations must ensure that a policy of peaceful diplomatic talks are established amongst any parties involved in an international or significant civil dispute that may pose as a danger to the international community and /or the candidate nation withholding the use of force unless absolutely necessary.
(b.) All candidate nations will ensure cohesion and cooperation of the existing armed establishment representing the candidate nation with other Democratic League member states to ensure that the combat effectiveness and joint partnerships to run in the interests of peace and mutual defence.
(c.) All candidate nations will be will be informed and consult other member states regarding any issues of interests that would require the use of arms, national territory, humanitarian mission or thereof which in turn are to democratically vote on the issue at hand.
(d.) All candidate nations’ must agree on the mutual defence pact of the Democratic League recognizing that an attack on one is an attack on all exercising the powers of the Democratic League to act in mutual self defence utilizing the forces of all member states to restore or maintain the Leagues members sovereignty and collective security.
(e.) All candidate nations’ are eligible to vote on issues non-essential to the principles of the Democratic League.
(f.) The Democratic League recognizes that candidate nations may apply for membership whilst in direct/indirect administrative control of overseas territories which will be recognized as part of the Democratic Leagues’ mutual defence pact.
(g.) If candidate nations makes any attempt to exercise its powers or undemocratically exercise the powers of the Democratic League with the intention of infringing the rights of a foreign territory militarily or civil will be subject to membership review of all member states determining the outcome and consequences.
(h.) All candidate nations must resolve conflicts or disputes internationally or domestic before application submission into the League exploring all diplomatic channels to prevent conflict escalation or provocations of foreign relations of other states in the international community and in the interests of peace.

CHARTER OF FUNDEMENTAL RIGHTS OF THE DEMOCRATIC LEAGUE

The following document presents the charter of fundamental rights of the Democratic League which works in conjunction with the ‘Chopinburg Criteria’ signed and ratified on August 1st, 2015. The document serves as part of the basic principles of the Democratic League for which all member states are subject to adhere to and the for the candidate nations to submit to during the time of application submission to the Democratic League. Member states under individual partnership alliance status are also to adhere to the principles set forth by this document. Nothing in this Charter shall be interpreted as implying any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms recognised in this Charter or at their limitation to a greater extent than is provided for herein.



SECTION I

DIGNITY OF THE PEOPLE


Article 1

Human dignity


1. Human dignity is inviolable. It must be respected and protected.

Article 2

Right to life

1. Everyone has the right to life.

Article 3

Right to the integrity of the person


1. Everyone has the right to respect for his or her physical and mental integrity.
2. In the fields of medicine and biology, the following must be respected in particular:
     the free and informed consent of the person concerned, according to the procedures laid down
     the prohibition of eugenic practices, in particular those aiming at the selection of persons,
     the prohibition on making the human body and its parts as such a source of financial gain,
     the prohibition of the reproductive cloning of human beings.

Article 5

Prohibition of slavery and forced labour


1. No one shall be held in slavery or servitude.
2. No one shall be required to perform forced or compulsory labour outside of lawful judicial proceedings..
3. Trafficking and trade of human beings is prohibited


SECTION II

FREEDOMS OF THE PEOPLE


Article 6

Right to liberty and security


1. Everyone has the right to liberty and security of person.

Article 7

Respect for private and family life


1. Everyone has the right to respect for his or her private and family life, home and communications.

Article 8

Freedom of thought, conscience and religion


1. Everyone has the right to freedom of thought. This right includes freedom to change religion or belief and freedom, either alone or in community with others and in public or in private, to manifest religion or belief, in worship, teaching, practice and observance.
2. The right to conscientious objection is recognised, in accordance with the national laws governing the exercise of this right.

Article 9

Freedom of expression and information


1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.
2. The freedom and pluralism of the media shall be respected.

Article 10

Freedom of assembly and of association


1. Everyone has the right to freedom of peaceful assembly and to freedom of association at all levels, in particular in political, trade union and civic matters, which implies the right of everyone to form and to join trade unions for the protection of his or her interests.

Article 11

Freedom of the arts and sciences


1. The arts and scientific research shall be free of constraint. Academic freedom shall be respected.

Article 12

Protection in the event of removal, expulsion or extradition


1. Collective expulsions are prohibited.
2. No one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the inhuman or degrading treatment or punishment.



SECTION III

EQUALITY OF THE PEOPLE


Article 13

Equality before the law


1. Everyone is equal before the law.

Article 14

Non-discrimination


1. Any discrimination based on any ground such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation shall be prohibited.

Article 15

Cultural, religious and linguistic diversity


1. The Democratic League shall respect cultural, religious and linguistic diversity.

Article 16

Equality between men and women


1. Equality between men and women must be ensured in all areas, including employment, work and pay.
2. The principle of equality shall not prevent the maintenance or adoption of measures providing for specific advantages in favour of the under-represented sex.

Article 17

Prohibition of child labour and protection of young people at work


1. The employment of children is prohibited that are still under the duty of care of their parents. The minimum age of admission to employment may not be lower than the minimum school-leaving age, without prejudice to such rules as may be more favourable to young people and except for limited derogations.
2. Young people admitted to work must have working conditions appropriate to their age and be protected against economic exploitation and any work likely to harm their safety, health or physical, mental, moral or social development or to interfere with their education.


SECTION III

CITIZENS' RIGHTS


Article 18

Right to vote and to stand as a candidate at elections to the nation’s national assembly or similar institutions


1. Every citizen of the Democratic League has the right to vote and to stand as a candidate at elections to their national assembly or similar institutions in the Member State in which he or she resides.
2. Members of the national assembly or similar institutions shall be elected by direct universal suffrage in a free and secret ballot.

Article 19

Right to vote and to stand as a candidate at municipal elections


1. Every citizen of the Democratic League has the right to vote and to stand as a candidate at municipal elections in the
2. Member State in which he or she resides under the same conditions as nationals of that State

Article 20

Right to good administration


1. Every person has the right to have his or her affairs handled impartially, fairly and within a reasonable time by the institutions and bodies of the Democratic League.
2. This right includes:
     the right of every person to be heard, before any individual measure which would affect him or her adversely is taken;
     the right of every person to have access to his or her file, while respecting the legitimate interests of confidentiality and of professional and business secrecy;
     the obligation of the administration to give reasons for its decisions.
3. Every person has the right to have the Community make good any damage caused by its institutions or by its servants in the performance of their duties, in accordance with the general principles common to the laws of the Member States.

Article 21

Freedom of movement and of residence


1. Every citizen of the Democratic League has the right to move and reside freely within the territory of the Member States with prior consultation if required with the recipient state.

Article 22

Diplomatic and consular protection


1. Every citizen of the Democratic League shall, in the territory of a third country in which the Member State of which he or she is a national is not represented, be entitled to protection by the diplomatic or consular authorities of any Member State, on the same conditions as the nationals of that Member State or better.


SECTION VI

JUSTICE OF THE PEOPLE


Article 23

Right to an effective remedy and to a fair trial


1. Everyone whose rights and freedoms guaranteed by the law of the Democratic League are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article.
2. Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Everyone shall have the possibility of being advised, defended and represented.
3. Legal aid shall be made available to those who lack sufficient resources in so far as such aid is necessary to ensure effective access to justice.

Article 24

Presumption of innocence and right of defence


1. Respect for the rights of the defence of anyone who has been charged shall be guaranteed.

CANDIDACY OF THE MIDDLE EASTERN COALITION FOR ENTRY INTO THE TRIUMVIRATE
(Proposal 0001)


The following document presents the proposition set forth by the MIDDLE EASTERN COALITION for the entry into the Democratic League Triumvirate through all present legal procedures stated on the Democratic League charters. The candidacy of applicant nation is void if one Triumvir votes against the proposition. On such account, all non-Triumvirate members states must achieve two thirds of the vote to override the Triumvirate proposal blocking.



1. REASONING OF PROPOSED CANDIDACY

  • Desired higher influence on the high DL command due to perceived ineffectiveness that should result in financial, human and material loss for the MEC should it get involved in future DL conflicts
  • Desire for higher clearances to ensure the quick and decisive resolution of any conflict that should destabilize the MEC's own debtors.
  • Increased representation of oil-producing nations in DL politics
  • Desire for influence to further structural change to make the DL faithful to its ideology
  • MEC's international standing is more conductive for (quoting the DL charter) "Desired increased self-reliant participation in military matters" policy of peaceful diplomatic talks are established amongst any parties involved in an international or significant civil dispute that may pose as a danger to the international community"

The following document presents the application presented by the candidate nation THE FEDERATED STATES OF CALIFORNIA for its application submission into the Democratic League. This document provides the information that is provided by THE FEDERATED STATES OF CALIFORNIA in order to complete a successful application where therein is voted upon by all members of the Democratic League through all present legal procedures stated on the Democratic League charters. The candidacy of applicant nation is void if one Triumvir votes against the proposition. EXPULSION OF THE UNITED STATES OF EURO ASIAN REPUBLICS FROM THE DEMOCRATIC LEAGUE
(Proposal 0003)


The following document presents the proposition set forth by the FEDERAL REPUBLIC OF ESLOVAKIA for the expulsion of member state; UNITED STATES OF EURO-ASIAN REPUBLICS through all present legal procedures stated on the Democratic League charter and Chopinburg Criteria. The motion of this proposal is void if one Triumvir votes against the proposition. On such account, all non-Triumvirate members states must achieve two thirds of the vote to override the Triumvirate proposal blocking.



1. REASONING OF PROPOSED EXPULSION

  • Negligence in the handling of Democratic League assets and lives evident by the handling of the invasion by the Russo-Spanish Empire which has cost the lives of many member states. [1]
  • Violation of the Chopingburg Criteria; Section 3; Article a; by the signing of the Treaty of Chopinburg without prior consent to the parties directly involved in the conflict at hand thereby jeopardizing the Democratic League's military and political stability.
  • Violation of the Chopingburg Criteria; Section 3; Article b; by the signing of the Treaty of Chopinburg which left the lives of Democratic League troops in immediate danger because of reckless and undiscussed action which relinquished the The United States of the Euro-Asian Republics into Russo-Spaniard administration through its new devolved government.
  • The dissolution of the United States of the Euro-Asian Republics no longer being the sole representative body of the said nation which has been transferred to the Russo-Spanish government; recognizes the need to expel USEA from the DL as continued admittance would mean Russo-Spanish influence within the Democratic League.
  • Failure to take accountability of governments financial debts taken from member states by intentionally dissolving government to relinquish sovereign debt thereby posing a direct financial threat to the Democratic League.
  • No longer possessing a 'fully functioning stable democratic government' as determined by Chopingburg Criteria; Section 2; Article a.

ELECTION OF A NEW TRIUMVIRATE MEMBER
(Proposal 0004)


The following document presents the proposition set forth by the FEDERAL REPUBLIC OF ESLOVAKIA to elect a new member into the Democratic League Triumvirate through all present legal procedures stated on the Democratic League charters after the expulsion of previous seat holder in the Triumvirate on proposal 0003. The candidacy of nominee nation is not void if one Triumvir votes against the proposition following the circumstances. Nominees must receive a majority of the vote in order to become members of the Triumvirate .



1. REASONING OF PROPOSED CANDIDACY

1.2 MIDDLE EASTERN COALITION

1. REASONING OF PROPOSED CANDIDACY

  • The The Unified States of Daemyrs expresses intent on candidacy to the DL with the intent of establishing and building bonds in the interests of mutual defence of like-minded governments.
  • The The Unified States of Daemyrs is a small nation, willing to help supply allies with equipment in order to fulfil the defence requirements and responsibilities of the Chopinburg Criteria.

The following document presents the application presented by the candidate nation THE 9th MAIFIA OF ACRIUM for its application submission into the Democratic League. This document provides the information that is provided by THE 9th MAIFIA OF ACRIUM in order to complete a successful application where therein is voted upon by all members of the Democratic League through all present legal procedures stated on the Democratic League charters. The candidacy of applicant nation is void if one Triumvir votes against the proposition. On such account, all non-Triumvirate members states must achieve two thirds of the vote to override the Triumvirate proposal blocking.



1. REASONING OF PROPOSED CANDIDACY

  • Acrium stands by Archon Maura Evelin and the Evelin Maifia for their goals of curbing back Imperial crown power and replacing it with more accountability to the people. These same ideals and more are held by the Democratic League and our membership could not only solidify our standing, but also help put pressure on the Throne at home.
  • Acrium is small and as such, so are her resources. Membership in the League would help cut alot of red tape and help us open new trade relationships, hopefully unhampered by our current embargo of the RSE.
  • As mentioned in the top part, we are small and surrounded by probable enemies. DL membership would allow us to permit construction of DL bases and stations in Acrium and also deter any assaults on our soil. Hopefully.

On such account, all non-Triumvirate members states must achieve two thirds of the vote to override the Triumvirate proposal blocking."
  • Acriumian candidacy still an application.

4. NOTES

  • Ameriqué delivers the vote of nay on the grounds of "The Twin Amanitte Empire of Italia is an autocratic absolute monarchy and its colonies are no different, we refuse to allow the entry into an organization dedicated to the freedom and liberty of peoples of an autocracy. It is not only detrimental to our cause it is entirely hypocritical of our goals."
  • Both Eslovakia and Acrium present the counter argument of "Acrium is one of the three Maifia's that for all intents and purposes is as democratic as it can get with elections for every single position even up to it's ruler. Colonies unless hostile towards the Throne are given near complete autonomy and all except two run full democratic elections."

  • Politically, we espouse the principles of a liberal democracy, and have done so for more than a century. We advocate the meritorious worth of every man, regardless of creed or color, belief or race, orientation or disability.
  • Militarily, we stand positioned between two nations who are closely allied or directly participating in the Democratic League, and our membership would not only make the most sense diplomatically in our current position, but it would also further increase the League's presence in southeastern Rostil and provide key defensive support through a wide sphere of projection.

The following document presents the application presented by the candidate nation THE 9th MAIFIA OF ACRIUM for its application submission into the Democratic League through contesting teh Triumvir veto after the Ameriquan block on proposal 0006. This document provides the information that is provided by THE 9th MAIFIA OF ACRIUM in order to complete a successful application where therein is voted upon by all members of the Democratic League through all present legal procedures stated on the Democratic League charters. The candidacy of applicant nation is not void if one Triumvir member vetos the application of the candidate nation. The candidate nation must ensure to collect two thirds of the vote in order to be recognized as a fully fledged member state within the Democratic League.



1. REASONING OF PROPOSED CANDIDACY

The following document presents the proposition set forth by the MIDDLE EASTERN COALITION for the entry into the Democratic League Triumvirate through all present legal procedures stated on the Democratic League charters. The proposition at hand is entered following the withdrawal of Ameriqué from the Democratic League thereby leaving the position vacant for all to apply.   • Desire for higher clearances to ensure the quick and decisive resolution of any conflict that should destabilize the MEC's own debtors.
  • Increased representation of oil-producing nations in DL politics
  • Desire for influence to further structural change to make the DL faithful to its ideology
  • MEC's international standing is more conductive for (quoting the DL charter) "Desired increased self-reliant participation in military matters" policy of peaceful diplomatic talks are established amongst any parties involved in an international or significant civil dispute that may pose as a danger to the international community"

    SPECIAL ADMINISTRATIVE CHARTER AMENDMENT RIGHTS TO THE UNIFIED STATES OF DAEMYRS
    (Proposal 0010)


    The following document presents the proposition set forth by the THE UNIFIED STATES OF DAEMYRS for request of special administrative amendments from the DL charter regarding section 3.d through all present legal procedures stated on the Democratic League charters. The proposition at hand is entered at the behest of the Daemyrs Government regarding DL foreign operations and internal government foreign policy making. The proposition is void if one Triumvir votes against the proposition. On such account, all non-Triumvirate members states must achieve two thirds of the vote to override the Triumvirate proposal blocking.



    1. REASONING OF PROPOSED SPECIAL ADMINISTRATIVE CHARTER AMENDMENT RIGHTS

    • The Unified States of Daemyrs has held long standing relations with the Russo-Spanish Empire before previous RSE belligerency against the DL in Operation Rubicon.
    • Commitment to maintain such relations without implications to both parties
    • Thereby request the possibility of maintaining a Non-Aggression Pact with the RSE if conflict is triggered against either parties (DL/RSE) by declaring neutrality by both parties.
    • Section 3.d thereby declared void to the Unified States of Daemyrs if the DL is engaged in direct conflict against the RSE

    1.1 CONDITIONS OF SPECIAL ADMINISTRATIVE CHARTER AMENDMENT RIGHTS

    • The Foreign Ministry of the Oriental Republic of Asera Maiwa, pursuant to the Daemyrs-Asera Maiwa Pact lays down that:
      ◦ Daemyrs is permitted to remain neutral in any offensive military action engaged in by the Democratic League towards the RSE. However, defensive military commitments should be respected in as much as an attack on a Democratic League state without provocation must by the letter of the law be construed as an attack on Daemyrs proper.

    OOC: Due to consistencies in lack of responses hampering planning and development IC-wise. There will be an OOC rule in place where if a vote is not recieved within 3 days, it will be counted as an 'Abstain'.
