Alabama to ban marriage licensing to stop gay marriage licensing.

Instead couples will enter marriage as a contract and file it with the state and no state employee signs off on it.

I think if this is the compromise needed to make the right comfortable with gay marriage then I think it is something other states should consider.

I think the problem arises in the question of whether these quasi-official documents are as viable as an actual marriage certificate. Damn, Alabama, did San Francisco steal your lunch money as a fledgling state?

Alabama can't decide what they want to do with marriage. First the allow gay marriage, but only a few counties will actual give homosexual couples marriage certificate, so they decide to put gay marriage on hold. Frankly, at this point, I'm not surprised. Just makes me want to move away even more.

Supreme court is about to legalize gay marriage. I give it 90%.

This actually helps those in those counties where probate judges are refusing to issue the license.

Seriously, the state that produced Bull Connor and George Wallace, this isn't a very progressive state. Not that being conservative is bad, but it's obviously a crappy situation for Alabama's gay community. Banning marriage clearly shows that they aren't ready to deal with gay marriage yet. As for them enforcing federal civil rights laws... well nobody hold your breath. For the simple fact that history shows the south is reluctant (Alabama in particular) and many do not adapt quickly to socially progressive ideas. I.e. slavery, civil rights etc.

Regardless of its motives, this legislation was probably one of the most enlightening of the 21st century. It doesn't ban marriage, that's completely false. It simply makes marriage a contract between two consenting people, like it should've always been. Why should government be involved in marriage and decide who or who you cannot marry? Why should you require a government license to get married? You shouldn't. This bill doesn't discriminate and it simply replaces the function of marriage licenses with a marriage contract with identical legal standing. I'd like to see this happen worldwide.
