India orders Italian ambassador not to leave, blocks borders

Following the row over the killing of two Indian fishermen - allegedly killed in international waters by two Italian marines on anti-piracy duty - the Indian government has ordered the Italian ambassador to New Dehli not to leave the country, and has also ordered the border guards at the airports to prevent him from leaving.

This comes about a week after the Italian government refused to return the two marines to India after a leave. The courts of the Indian State of Kerala have declared incompetence over the matter because the alleged events took place in international waters; the Italian government argues that this is enough to hand over the trial to international authorities.

Blocking a diplomat, and denying him freedom of movement, though, is an unprecedented move - it's holding a diplomat hostage. It means either that India does not allow the usual treatment of foreign diplomats (in this case, art.44 of the Vienna Convention on diplomatic relations) , or that India does not recognize Italy as a country with which it has friendly relationships. So, basically, it's almost a declaration of war.

What do you think? Is this equivalent to a declaration of war? Should India back off? Or should Italy back off? Should diplomatic relationships be severed? Should Italy apply the same measures to the Indian diplomats in Italy? Should Italy send a ship off the coast of India to pick up the Italian diplomats?
Also, so far the UN have kept out of the issue. Is it time for them to intervene?

Probably not one that would reach Europe. But if, by some miracle, the Italians manage to start winning in India, I don't think they'd hesitate to blow them to hell to save their country.

While I agree with the Indian government's demands that the two marines be returned to India to face trial, this action by India is blatantly illegal on its face. The Vienna Convention is explicit that diplomats are not to be subject to arrest or detention, and that the host country cannot unilaterally revoke diplomatic protection without allowing enough notice for the offending country to recall their diplomats. I don't see any possible interpretation of this action that is not a Vienna Convention violation.

I hope India backs down from this, because if they don't they are jeopardizing their diplomatic relations with every other country in the world.

Italy cannot give their citizens to foreign countries because it is unconstitutional. For cases like this there are international courts and India should go there. End of discuss.

Srsly, I think the eventual escalation could pass through Italy blocking immigration from India and forbidding money transfer from Italy to India. It's quite a heavy leverage, given the number of Indian citizens who have emigrated to Italy.
