The matter more in question is whether the PLC has (or has been able to given the circumstances) passed a vote of confidence in Fayyad's Cabinets- but I'd assume, given how quick Fayyad was to sack and reform his Cabinet earlier this year, that this either has been achieved, the PLC has been bypassed legally, or they're flagrantly breaching the Constitution.

Nice selective sighting there. They are talking about the issue relevant to Article 79-4. There's no question that the president may select a PM, it's the issue that that selection is only applicable to presentation and approval of the legislature. The President did not do that. In fact, lacking the confidence vote, the President should dismiss his appointee and select another.
