Except it wasn't, under their system the outgoing Prime Minister sits until selection of a new one by their legislature. The basic issue they are at is that Abbas appointed someone himself, which he isn't allowed to do.

The Palestinians have been there a lot longer than sixty years.

ARTICLE 45
The President of the National Authority shall select the Prime Minister, and task him to form his government. The President shall have the right to remove him, and to accept his resignation, as well as ask him to invite the Council of Members to convene.
So he can, and has. The matter more in question is whether the PLC has (or has been able to given the circumstances) passed a vote of confidence in Fayyad's Cabinets- but I'd assume, given how quick Fayyad was to sack and reform his Cabinet earlier this year, that this either has been achieved, the PLC has been bypassed legally, or they're flagrantly breaching the Constitution.
