Leave from Work in Your Nation

Postby Drongonia » Thu Dec 01, 2022 5:43 pm

Sick leave, unpaid leave, bereavement leave, mental health leave - there are plenty of different types of leave your employer might have to give you.

The topic of this thread is, how does the leave system work in your nation?

You can use the template below to answer the question/s, or just post from the heart.

Are employers expected to cover the costs of paid leave, or does the government do this?
This is dependent on the type of leave. Vacation, sick, bereavement, and administrative leave are to be covered by the employers, and minimum leave accumulation rates are enshrined in employment law. Parental leave and furlough, however, are covered by the unemployment insurance system (75% of salary/wage).
How does the allocation/usage of sick leave work in your nation?
The minimum vacation leave accumulation is a quarter day for every standard work week (1.75 hours for every 35 hours worked), regardless of FT/PT or work term status. Sick leave is one-half the vacation rate. Bereavement leave is 5 days for full-time workers and 2 days for part time workers on long-term/indeterminate contracts.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
Yes, as per the calculation outlined above. Vacation hours roll over to a maximum of 280 hours (40 days) before a mandatory payout. Bereavement can be "banked" up to 15 days and is not subject to a payout. Sick leave can be banked and roll over to an indefinite amount, but are not subject to a payout.
Are employees entitled to paid (or unpaid) bereavement leave?
Yes, as per the stipulations outlined above. Bereavement leave is paid.
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.
Yes, under the banner of sick leave. Some employers offer specific types of family or sick leave (i.e. taking family members to an appointment)
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
Yes, but lengths are subject to employment/operational requirements or specific negotiation. Paid leave banks are not accumulated during unpaid leave.
If your nation does random jury selection, do those selected get paid time off work to serve?
Yes, and it is paid by the government. The rate of pay is essentially what the worker could expect from unemployment insurance (75% of salary or wage)
Any other worthwhile information you feel like sharing:
Further to the above, Aristoria has 15 statutory holidays where employees are paid. Working on those days entitles workers to double wage/salary for the hours worked. Recalling a worker from approved vacation or sick leave entitles them to double pay and a per-hour "inconvenience" stipend, currently set at 210 Lira/hour (approximately $42)

Are employers expected to cover the costs of paid leave, or does the government do this?
The Thermodolian paid leave system is a mixture between the federal government, the provinces and the employers. The federal government and employers both cover 33% while the provinces cover 34%

How does the allocation/usage of sick leave work in your nation?
Thermodolians get a base of 3 weeks of paid sick leave each year. The sick pay is to be used only when an employee or their next of kin is sick.

However if there is a major medical issue that requires more than three weeks of leave and the annual and emergency leave is not enough to cover it then the emergency sick leave kicks in which lasts as long as the needed recovery and paid by the Thermodolian National Health System

Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
Employees are entitled to a base of 4 weeks paid annual leave. The leave can roll over to the next year but this is not a federal requirement and depends on the employer.

Are employees entitled to paid (or unpaid) bereavement leave?
Yes, Thermodolian workers are entitled to a base of one week of paid bereavement leave.

Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.
Yes. Employees are entitled to one week of paid mental health leave, and two weeks of emergency leave that can be used for emergencies that other types of leave don’t cover.

Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
Yes, there is no limit to the amount of unpaid days but they must be taken in good faith, failure to do so can result in termination

If your nation does random jury selection, do those selected get paid time off work to serve?
Yes. Paid leave for jury service is paid at 3/4th of the rate of the regular paid leave, unless the trial lasts for longer than a week and half at which point it will be paid at the full rate for the entire trial. This is fully covered by the provincial and federal governments and is not a liability of the employer.

In addition all persons are paid for jury service which amounts to employees effectively being paid a full day leave for jury service

How does Paid Parental Leave work? Also, who pays for this?
There is a base of 4 months of paid parental leave that is offered in a block to the new parents. This amount can be split between either parent or just taken by one parent.

Like all other paid leave, parental leave is paid by the federal government, provincial governments, and employers

Any other worthwhile information you feel like sharing:
The above rates are only for full time employees. Employees that are considered to be part time only qualify for 3 weeks sick pay, 1 week each of bereavement, mental health, and emergency paid leave, and 2 weeks of paid leave.

In addition there are a total of 13 federal holidays, 11 of which are paid at time and half for all those who work those days and for two of those days (Labor Day and Election Day) all but the most essential of employees are required to have the day/s off. If an employee is required to work those day/s then they must be paid double and half their normal rate.

(Election day is only held once every three years)

Are employers expected to cover the costs of paid leave, or does the government do this? Only on Christmas Day and Boxing Day and the Queen's Birthday on July the 8th is paid leave given by law.
How does the allocation/usage of sick leave work in your nation? They can have sick leave but it's unpaid.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused? See above.
Are employees entitled to paid (or unpaid) bereavement leave? No.
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details. Not normally.
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
If your nation does random jury selection, do those selected get paid time off work to serve? Yes,£100 a day, paid by the court.
How does Paid Parental Leave work? Also, who pays for this? There is no paid parental leave. A boss can sack a woman for getting pregnant unless it is as the result of a rape.
Any other worthwhile information you feel like sharing: Strikes are banned if they drag the innocent into it. Technically, feminism can get the death penalty but in practise that is very, very unlikely. Most feminists only get convicted of being soverign citizens and the penalty is a small fine or at most, a few lashes or a week in prison. To get executed for feminism, a feminist would have to try really, really hard to get executed and cause real trouble. It has been more then 150 years since a feminist was executed, unless you count one who recently did a murder which is what she was executed for, not her feminism. Strikers can be jailed if they drag innocent people into the mess.

Are employers expected to cover the costs of paid leave, or does the government do this? The employer pays it, but it's usually subsidised by tax breaks - this is for official public holidays only. Additional paid leave is negotiated in the contract.
How does the allocation/usage of sick leave work in your nation? It depends on the negotiation between the employer and employee - there's no law guaranteeing sick leave, though the standard contract is 5 days.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused? Sort of. There are four week-long public holidays which employees are entitled to have off by law, or have in lieu if forced to work (e.g. an essential service). Most people also get an additional week off at their disposal, but this is not mandated by law, only by contract.
Are employees entitled to paid (or unpaid) bereavement leave? No, but most employers will allow employees a week off to attend a tangi.
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details. No
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken? Yes - this is the most common form of leave. Generally people will save up part of their salary and then use it to pay for, say, a two week vacation with no pay from their employer.
If your nation does random jury selection, do those selected get paid time off work to serve? Juries will usually receive a small stipend from the government
How does Paid Parental Leave work? Also, who pays for this? There is no paid parental leave. Children are usually raised by their grandparents or other extended family, it's actually uncommon for a biological parent to raise their child. Most employers however will offer six months maternity leave so the mother can give birth and nurse the infant in the early months - but this is not guaranteed by law. Usually if you choose to be a mother, you quit your job to do it.

Are employers expected to cover the costs of paid leave, or does the government do this? It depends on the leave for leaves, honeymoon and vacations is the employer. Paternity, sick leave from the first week (75% of wage as unemploying) is the Government as administrative leaves.
How does the allocation/usage of sick leave work in your nation? Is required a doctors certificate from ICS (the national healthcare provider or the employers insurance.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused? the minimum paid leave are 30 days year and have 3 more days for unexpected reasons (as funerals), or 15 days in case of marriage, if the employee ends contract before paid leave he get's the a pay equivalent to the paid leave not done.
Are employees entitled to paid (or unpaid) bereavement leave? No. The employers can fire employees if they faked sick leave. In any case it would be taken from the firing indemnity.
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details. Yes. Any other paid leaves and permits are included in the sick leave. And are paid 75% of wage in case of lasting more than one week.
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken? It requires a justification, as if they have to accompany a close relative to the doctor. They must contact the employer. If is programmed normally the employer changes shifts. If not, they can pact with the employer and union, if the leave is unpaid or they can change shift or do extra time to compensate or use one of days available for unexpected reasons.
If your nation does random jury selection, do those selected get paid time off work to serve? Yes, in that case is paid by the Government with 100% pay, as for people selected to check election procedures, reservists or volunteer firemen called into service. In those cases the worker gets 6 hours rest time.
How does Paid Parental Leave work? Also, who pays for this? the Government 100% wage and a 40% notification to employers ICSS to hire a substitute to cover the leave. Both parents have 6 months is not necessary to took them simultaneously but yes during the first year life or adoption. The mother initially can get sick leave

Are employers expected to cover the costs of paid leave, or does the government do this? Considering the government is the only legitimate employer in the country, the answer is technically both
How does the allocation/usage of sick leave work in your nation? If the government decides that you are sick, you lose the right to work.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused? Most of the population don't work as the country is permanently in lockdown - only 'essential workers' and the government are allowed to work. Most people are given a ration of essential goods based on their Social Credit rating.
Are employees entitled to paid (or unpaid) bereavement leave? Yes
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details. Yes, employees who do not hold the correct opinions are often put on permanent 'mental health leave' and are never seen again.
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken? You don't get paid in money, but sometimes dereliction of duty can result in a lowering of your social credit rating which amounts to a loss of pay.
If your nation does random jury selection, do those selected get paid time off work to serve? N/A there are no juries in the DPRA
How does Paid Parental Leave work? Also, who pays for this? You can take as much time off as you like if you have children, indeed this is actively encouraged.

Are employers expected to cover the costs of paid leave, or does the government do this? If it is a Sertian-registered company then the government will provide leave to the employees, however if it is a franchise of a foreign company they must give leave to their employees, using their own finances, or face penalties.

How does the allocation/usage of sick leave work in your nation?
Do not go into work if you are sick. If you lose your job due to an illness, you can apply for Personal Insurance.

Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
7 days each month is the minimum paid leave employers must provide.

Are employees entitled to paid (or unpaid) bereavement leave?
There is no entitlement for employers to do this. However, you can claim Compassionate Leave credits which will pay for you to stay home from work up to 20 days at a time over a period of 12 months.

Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.
These all fall under Compassionate Leave.

Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
No and no.

If your nation does random jury selection, do those selected get paid time off work to serve?
Gadalland and Aspern does not run juries.

How does Paid Parental Leave work? Also, who pays for this?

26 weeks in a Sertian company (paid for by the government) and 26 weeks for a foreign franchise (paid for by the firm)

Are employers expected to cover the costs of paid leave, or does the government do this?
The employer would be mainly covering the paid leave and will likely pay the full amount, but the government will subsidize the small or start-up firms.

How does the allocation/usage of sick leave work in your nation?
It is a plausible cause to take leaves with pay. Yet the employer may terminate the contract with the employee if the employee is no longer capable of their occupation.

Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
Yes. The full-time worker in most occupations may have at least 2 full days off per week and a minimum (and mandatory) of 3 weeks of paid annual leave per year. The Worker's Benefit Bureau (AwB) of the Ministry of Labour and Welfare (MAW) is the overseer of such rights, and the companies will only be responsible for 1/3 of the regular leave wage and the MAW is responsible for the remaining 2/3.

Are employees entitled to paid (or unpaid) bereavement leave?
There is no regulation on the national level, however, the leave is widely considered a right, thus the company may not deny the leave in most situations. However, bereavement leave does not require the employer to pay the worker who decides to take it.

Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.
Yes.
Domestic Violence Leave will come with domestic violence investigation conducted by the police and other welfare agencies, and at least 90% amount is paid by the MAW.
Mental Health Leave is considered Sick Leave as Canvalland has an existing program regarding its residents' mental well-being since 1985, and the regulation is similar to the Sick Leave clauses.
The Civil Duty leave, including jury duties, cooperating with police or other bureaus in investigations, natural disaster militia draft (to aid the disaster relief operations), etc. are paid in full by the government, and the natural disaster militia draft also comes with a wage for being a drafted militia along with the regular leave payment.

Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
Yes, they are entitled to take unpaid leave. Once they decide to take unpaid leave, they will be protected by the MAW which prohibits their employer from firing them for half a year while the employees' welfare will be subsidized by the AwB during the period. The unpaid leave is technically unlimited but after 6 months the employer may terminate the employment.

If your nation does random jury selection, do those selected get paid time off work to serve?
Yes, see the above Civil Duty Leave clause.

How does Paid Parental Leave work? Also, who pays for this?
The MAW pays the full amount for Parental Leave and the Firm can pay additional regarding their own policy.
The first four months are mandatory leave for Mother and the first 14 weeks are mandatory for Father. The mother can take up to a year of maternity leave fully paid with the addition of 100 days of partially paid leave and the father can take up to 6 months of fully paid paternity leave.
The mother's benefit for giving birth could be taken even if they start home-officing, which means the mother can take benefit while working distantly and it is NOT considered welfare fraud.
The employer may NOT terminate the new parents during the Parental Leave. If the employee is terminated during the parental leave, they can sue the company for reparations and illicit terminations.
Besides that, the parents of pre-adolescence (before 12 years old) children may take 2 weeks of additional annual leave during the children's school breaks, which is partially (20% to 60%) subsidized by the government.

Are employers expected to cover the costs of paid leave, or does the government do this? The government technically funds all businesses, so the government.
How does the allocation/usage of sick leave work in your nation? Estabanians must get a mandated 3 weeks of sick leave of year, or more depending on an illnesses severity, although this must be approved by a doctor. If the employee is no longer able to work, their employer is able to terminate their employment, and the employee will go on disability pay from the government.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
Estabanians are entitled to at least 3 and a half weeks of paid annual leave yearly, or more depending on place of work. It does not extend over to the next year.
Are employees entitled to paid (or unpaid) bereavement leave?
Employees are entitled to 1 and a half weeks of paid bereavement leave.
Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.
Employees can take leave during a period of extended mental health treatment, if they have been the victim of a crime or are in court, or some other unexpected emergency circumstance. The employee is entitled to at least one week of paid leave, and more depending on the circumstance.
Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
Employees can take unpaid leave, but are liable to be fired if they do not work at least two weeks a month, although some businesses will allow longer. Most people however, are fine with the already generous paid leave they get a year.
If your nation does random jury selection, do those selected get paid time off work to serve?
Yes and yes.
How does Paid Parental Leave work? Also, who pays for this?
Parents are entitled to up to one year of paid parental leave to each parent, and this time is transferable from parent to parent. This time can be used up until a child reaches the age of 13. For payment method, see question one.

How does the allocation/usage of sick leave work in your nation? Employers are expected to cover the costs of paid leave. By default, the government is the ultimate employer of Wochaysteiner-based enterprises. For joint-ventures or private enterprises given permission to operate in the dieresis, expenses incurred by the private employer can be reimbursed.
Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused? Yes and yes

If your nation does random jury selection, do those selected get paid time off work to serve? Yes. There is no limit to the amount of unpaid leave an employee can take.
How does Paid Parental Leave work? Also, who pays for this? There are two types of parental leave available in Wochaystein: maternity and family care. Maternity leave is for the birth and first year of a child's life, paid through social insurance contributions made by both employers and employees. Family care is available for children older than a year, but younger than 18 years old, who have been adopted or given guardianship by their parents; this can be taken until the child turns 20 if they are still enrolled in full-time education at that point. The government pays for this system in the same program as sick leaves.

In most cases, the employer will cover the cost of paid leave. However, if the company is too small to do this, then the government will help out. For pregnancy, we don't want the mother to have to stress about money when they are raising a newborn, so either way the cost of paid leave has to be sure to get done.

Are employers expected to cover the costs of paid leave, or does the government do this?
Employers and the government split the costs of paid leave. However, when the employer's Worker Provision Fund runs out, the government is obliged to step in and pay all leave costs until the employer saves enough money to pay for those themself.

How does the allocation/usage of sick leave work in your nation?
Employees are entitled to two weeks of paid sick leave and two weeks of unpaid sick leave a year. Employees are obliged to notify their employers that they are taking sick leave. Paid sick leave is only credited when the employee shows proof of medical treatment.

Are employees entitled to a minimum amount of paid annual leave yearly? If yes, does this roll over to the next year if unused?
Employees are entitled to a minimum of a week of paid annual leave. Employees doing up to 1000 workhours a year are entitled to a week of annual leave, with every 450 hours above it adding another week of leave. This amount of paid leave time does not roll-over to the next year.

Are employees entitled to paid (or unpaid) bereavement leave?
Employees are entitled to two weeks of bereavement leave a year. Employees are obliged to present proof of bereavement to their employers. Paid bereavement leave is only credited when the employee shows proof of psychological therapy or of bereavement expenses.

Are employees entitled to family violence leave, mental health leave, or other 'special' paid leave? If so, please give details.

Are employees entitled to take unpaid leave? If so, is there a limit to how much can be taken?
Employees are entitled to a minimum of two weeks of unpaid leave. Employees doing up to 1000 workhours a year are entitled to two weeks of leave, with every 450 hours above it adds another week of leave. This amount of unpaid leave time does not roll-over to the next year.

How does Paid Parental Leave work? Also, who pays for this?
Employees are entitled to a year of paid parental leave. Parents are given the first year totally off work, which is paid by the government. After this, parents have to work for half of their contracted work hours for the next four years, with the employer and government sharing the costs.

Any other worthwhile information you feel like sharing:
Employees are obliged to provide proof when using their entitled leaves. When an employee neglects to provide proof, it is credited as unpaid leave. Leaves are non-transferable: employees must use it or lose it. If an employer is suspected to not give their employees the right leave time amount or pay, the employee can complain to the Courts' Labour Tribunal.
