[SCRAPPED] Peaceful Cosmos Act

NOTING that the Earth has been plagued by war for far too long,

ACKNOWLEDGING that acts of war may never cease on Earth,

REALISING that space explorers risk their lives for the sake of scientific advancement;

Hereby defines:
"Space explorers" as any human, animal, or robot launched into space for the sake of discovery.
"Space" as the area outside of the Earth's atmosphere.

Hereby requires that:

    1. No member nations may fire weaponry at rockets, capsules, or payloads heading towards space.
    2. No missions may be sabotaged, by any means, including
      a. Draining fuel tanks prelaunch,
      b. Assassinating members of the crew,
      c. Ransacking cockpits for stashes of food or oxygen,
      d. Causing any damage to vital components of a nation's space travel.
    3. Launching any attack in space, including intentionally crashing any vessel towards another.

Although many nations on NationStates are MT (modern-technology) and set on something very similar to Earth in real life, many nations are also set on other planets, in fantasy worlds, or with intergalactic empires. As a result, any proposal dealing with space needs to take account of the fact that it should apply to Martians, Venusians, and Time Lords as well as humans. Also, take a look at International Aero-Space Administration, which is a resolution covering a similar theme to this.)
My pronouns are he/him. I am from the United Kingdom. I enjoy linguistics, law, and LARPing. The fact all three of those begin with the same letter is a coincidence and not a fascination with that grapheme.
Kenmoria is a corporate semi-dystopia where the mechanism of government has been privatised. It nominally has a Parliament, but it exercises no real power. Although the nation has helped to passed six GA resolutions, and been commended by the WA, nobody in Kenmoria knows of the WA’s existence, apart from a select few.

Sir James Lewitt is my character in the General Assembly. He was fired from employment as ambassador by the Kenmorian Government, but still turns up anyway.

I was thinking of how not all nations are located on Earth, and how not all people are humans. At the time, I was unsure on how to write that. (I now have an idea that i'll publish tomorrow.)

And with that proposal, while it is similar, it focuses more on preventing accidental damage to spacecrafts, while my draft focuses more on intentional harm.

Space is a domain that will be host to conflict, no legislating will ultimately prevent that. As your law currently stands, it would outlaw preventative defense measures against hostile nations. You have made no exemptions for what the cargo of space-bound vessels is. An example of what is meant here; if one were to load a military crew and a sizable cargo of nuclear and/or biological weapons aboard a rocket for the express purposes of destroying a WA nation, it would be illegal for that WA nation to kill any members of that military force or prevent their own destruction from being launched into space - short of them resigning from the WA in order to not face their own extinction. That is to say nothing of other less immediately apocalyptic cargoes that may nonetheless pose a threat to the security of a member nation and present a valid target for military action; such a spy satellites or orbital weapons platforms.

This line specifically prevents any and all defensive measures to be taken against hostile action towards a nation should that action be taken during a space mission. These is no definition of what a "mission" is.

This is required? One would assume that this legislation is designed to prevent such a thing but as written this is a separate clause functioning under "Hereby requires that:". You also define what a space explorer is but never actually mention why you have defined a space explorer in any further clauses.

This resolution would be illegal because it mentions Earth. I advise you read the GA Proposal Rules and General Advice

On that note, you have a fair proposal. Many future-tech nations are members of the World Assembly, and banning the launching of missiles heavily regulates their warfare capabilities. Also, what you're suggesting with Clause 2 can be interpreted as applying to all "missions". I suggest you define what that means. Also, will the American moon landing provoke Clause 2d, because effectively that ended what they and the USSR was capable of doing in the space race?

In summary, your proposal has many flaws. For fellow space empires, we will vote Nay if this manages to reach the voting floor.

I would like to give you this advice: to ignore the burdening that other members of the World Assembly (hopefully accidentally) put on you, and improve from your mistakes. After all, we all have them. :)

Amb. Asgeir Trelstad: "I'm a peaceful guy, so I agree generally with the sentiments of the proposal; however, from a practical perspective I don't think it particularly passes muster. Article 1 bans nations from intercepting Intercontinental ballistic missiles, for example. Article 2 similarly prohibits taking action against military targets - say if a mission is to resupply a military space station. And finally, Article 3 makes it impossible for our intergalactic comrades from fighting the forces of Space Fascists. Unfortunately, I can't forsee a solution to this proposal that both retains the spirit of the bill while also allowing me to support it."

i have scrapped this for the sole reason that I had written it quite badly. There were many issues. I will change the name to more accurately reflect the new points my next one will have.
