US Judge Laments Inability to Jail Man for Unmown Lawn

Postby Forsher » Sat Jan 15, 2022 4:20 am

(CBS DETROIT) – A cancer patient has had a difficult time maintaining his lawn since being diagnosed, but a Hamtramck judge showed no sympathy.

In a Zoom court hearing, Burhan Chowdhury, the 72-year-old defendant, explained that he has been too weak to maintain his lawn.

Judge Alexis G. Krot told the defendant that he should be ashamed of himself and said, “if I could give you jail time, I would.”

During the court hearing, Shibbir Chowdhury, the defendant’s son, explained that his dad is sick, and after receiving the citation, they cleaned his property.

source different source

As someone in the Reddit thread I found this in (though, I won't link to it because the abuse directed at the judge in it is honestly horrific) observed "I thought that video was part of a sketch satirising justice in this country". Presumably, they were thinking of this Illinois judge who's been booted off criminal trials due to reversing the sentence in a rape trial.

It's actually interesting (in addition to being horrific) because I finally got around to watching 99 Homes yesterday and one of the defining moments of that movie is right at the start where the judge basically goes "shut the fuck up, I've got another three thousand cases so I'm skimping on all of them, you're getting evicted tomorrow and you have thirty days to file an appeal, bailiff!". And this is then repeated later on in the movie where Michael Shannon's character is able to get forged documents into evidence since he knows no-one's going to check the index numbers in the record logs.

I think also of Rake, where the main character, a coked up lawyer who literally goes to prison for conspiracy to commit murder (a charge he's guilty of), finally gets disbarred only when he accidentally insults a judge on camera. Or Boston Legal which, like Rake, had several recurring judges, most of whom were dingbats. And who can forget the trial in Blackadder Goes Forth?

Oh, and then there's The Wire where you can only find justice when the judge isn't up for re-election... and also if you fake a serial killer in order to defraud the city so that you can fund an investigation into literally dozens of connected murders from a year earlier...

These are fictional examples but they cut to a deeper truth... if you've got judges, the quality of justice is dependent largely on the quality of the justices. However, a fairly standard operating practice is to treat justices, much like referees, as a class that may be protected... I believe the theory is/was that if you let people be mean to judges, the whole house of cards is liable to collapse on itself. The logic is something like a dissed judge lacks the credibility to make stuff work.

So... what say, yes, NSG? To judge or be judged?

Probably some kind of local ordinance violation. In a lot of places you've got to keep your property cleaned up for appearance, health, or safety reasons. Judge definitely went overboard, though. Not really sure what was going through her mind there.

I hate mowing lawns as much as the next person, but it does cause problems if ignored for too long.

If you don't want to tend to a yard anymore, you can usually cover it up and you can have just a big old patch of dirt and weeds. But most people don't want to do that for obvious reasons, prevents some soil erosion from having plants to hold it together and boosts your place's curb appeal. Astroturf is no good either, it absorbs and traps too much heat.

There's definitely valid reasons to have some yard keeping standards for a neighborhood. If a property is overgrown with weeds and things, it's an eyesore and could become a fire hazard.

That said the way that the judge talked to the old man was unnecessary. I would have shown more leniency or compassion towards him.

Republicans do. Especially since Trump encouraged it.

HOAs are supposed to be beneficial for those people who don't mind following their rules or can tolerate the conditions it imposes. You don't have to worry about any bad/nuissance neighbors generally speaking, like you do with a non-HOA locale; or their neglected property/habits negatively impacting your real estate's equity because they'll be run out or forced into compliance. It has at least some merits which is why those exist.

You get more free reign without an HOA, but this also results in there being at least some neighbors who do stupid stuff like have their yard become a junkyard lot for broken down cars/personal crap or having a bunch of barking dogs every morning/evening. I hate it.

You can't have it both ways though. An HOA is a pain, but without one your neighbors are often a pain instead. There is some satisfaction to be had in ensuring that someone who is more trouble than their worth, can be forced out for good.

People who're slobs or live as if they're poor should have to live in the poor part of town, if they can't be bothered to adopt richer or more responsible habits/maintenance, if the community at large wants to maintain a higher valuation or standard.

Judge deserves all the abuse heaved at him. At best he should be removed from the bench.

Avoiding HOA'S is easy, don't buy into a community with one.

And cooperatives by definition require a HOA to pay for community services

Why has his son not mowed the lawn of his father? It seems that it is the son who should have been threatened with jail time, and not the father.

Ah, so that does excuse the lack of filial piety if he was out of country. Perhaps he could have been required to hire a lawn crew for his dad? Depending on part of country, that may not be a ridiculous expense.

That is the part where I get the HOA 's position. Hire a kid for 20 bucks to cut it.

Its the judge's comments I find unprofessional and worthy of him being removed from the bench.
