Censorship and Freedom of Art in YN

Postby Seppen » Thu Dec 02, 2021 3:12 pm

Seppen's National Regulation on Censorship and Freedom in Arts states that
All forms of artistic expression (painting, sculpture, music, literature, poetry, theater, cinema, comics, videogames, photography, animation,) and in general all works, whether Seppenin or foreign, portraying fictional depictions SHALL NOT be subject to censorship, regardless of the distributing media, and regardless of the illegality or "immorality" of the depicted situations.
Appendix:
1] This also applies to fictionalized depictions of real events (Example: biopics or historical novels);
2] This also applies to documentaries depicting real felonies AS LONG AS they resctrict themselves to only showing them without being directly involved in such felonies;
3] This DOES NOT apply to reality shows UNLESS the participants are expressly actors/performers.

As you can see, in Seppen, art and artists are protected form censorship, and given much freedom.
Now, what about Your Nation? Is there any form of censorship? Or is art free? And how much?

Crossoveria still has serious problems with Freedom of Art and Censorship. Explicit content is still strictly forbidden, but when Marie BonAztire was in power of Crossoveria, censorship was extreme. BonAztire issued decrees that regulated freedom of arts. Most Western cartoons with child protagonists were often forced to convert the child protagonists into animals if they wanted their cartoon to be released in Crossoveria. Throughout the 2010s, depictions of anthropomorphic animals wearing human clothes were edited so that there wouldn’t be any clothes on the anthros.

In short, freedom of the arts is severely restricted in Crossoveria

Section 15 of the Radiatian bill of rights specifically protects freedom of artistic expression, which absolutely cannot be censored in any way, shape or form.

This was further tested in the Supreme Court when the state of Vatfer attempted to impose age restrictions on violent films and video games, with the Supreme Court ruling that even this would be considered a form of censorship and thus struck it down as unconstitutional.

(The result is that Radiatian television tends to be very smutty, but all the same people are proud that freedom of artistic expression is protected absolutely.)

Censorship is generally considered unconstitutional in Tangatarehua, however there are some exceptions to this the prevent the publication "criminal" art - that is art that breaks otherwise existing laws.

The most notorious example of this would be artwork that infringes lese-majeste laws, dishonours the Empress or other national symbols which could still see the creator charged. (The most recent example was in 2004 when an internet cartoon depicted the Empress in certain sexual situations and resulted in the creator being fined $5000.)

Artwork that incites violence or hate could also still be subject to criminal proceedings, although this has not yet been tested in court.

Most censorship in Tangatarehua therefore takes the form of self-censorship, with art in Tangatarehua being divided into 'public art' - that is art that is funded by public money, or shown on license-fee funded broadcasters which therefore have more stringent standards.

Conversely, 'private art' is usually synonymous with 'commercial art' and is often expected to be of lower quality or more 'crass', however some self-censorship still exists such as the Motion Picture Association of Tangatarehua which may refuse to certify certain works for national distribution if they consider it too objectionable - however because it's a volunteer body it is still powerless to completely stop something being distributed but merely acts as a red flag for, say, a movie theatre or television company who may consider not showing it if it's uncertified.

The Lietuvan High Kingdom isn't the biggest believer in free artistic license to produce all that one may please to. However, given the strange quirks of the Free State system, it takes other measures than censorship to disincentivize degenerate so-called art.

Technically, most art is perfectly legal to produce, consume, give, and receive (with the exception being the depiction, by any medium, of a sexually explicit nature of an existing person that has not or cannot properly consent to the art's production). However, it is illegal to "financially profit from or hold copyright over the production or distribution of art depicting any sexual activity, or which insults the Lietuvan monarchy, or which promotes the Jacobin Movement, either Bourgeois or Proletarian Dictatorships, Hatred of Christianity, or violence against existing persons. All who sell ad space on any internet page containing such material or assist in putting such material behind an internet paywall crossable by our citizens, are likewise culpable."

The effect of this is that social media/Porn companies will not send such material through to servers/IPs in our area, in fear of incurring fines. Pornographic film is generally not produced for internet distribution by our citizens because they cannot profit from its publication, though a black-market for hard materials exists, as well as several legal "sharing clubs" for what foreign proprietors would call "pirated copies" of their material (that they don't profit is a win in our book, so we tacitly encourage the piracy... as an "at least" measure, in the case that one cannot resist the temptation to consume such drivel, that is). Political propaganda has more non-profit motive behind its production and distribution and so is not as effectively blocked.

Furthermore, if a foreign producer of artistic material is considered a "promoter of politically or morally disadvantageous messaging that is not immediately illegal to profit from," the government, though not banning it, will often issue a "digital letter of marque" that "all unofficial re-distribution that undermines the producing company's ability to draw profit from Lietuvan eyes on their work shall be permitted, given safe harbor, and algorithmically encouraged." within our digital reach.

Cosnicu has had reletavely free ideas about art. Political, social, economic commentary is a frequent theme in many of Cosnicu's murals (most buildings are usually painted within the first two or so years) and the idea that art carries meanings the government should not intervene in is viewed as essential by most Cosnicu (barring the exception of explicit content). Explicit content is not displayed publicly, but is still legal to produce, distribute, and consume...although its often left behind red tape. This however, came about due to a scandal in one of Cosnicu's substates that has created a stigma most Cosnicu are uncomfortable or unwilling to discuss frequently.

Officially there is freedom of art in Sonakion as outlined in article 7 of the constitution however having any anti-goverment art will probably result in you being accused of breaking article 2 of the constitution which dictates that all citizens must be loyal to Sonakion and its goverment and were very strict for what shows loyalty and what does not

We have a rating board that puts ratings on media including plays for age appropriateness.

There is no censorship of art in Loquillan. Things like movies and video games have ratings to inform the public of their contents, but are never censored.

With the exception of the obivous stuff, there is complete freedom of art in Rosi(c)a with the exception of hate speech, and copyright, unless fair use is applied (fair use covers many things in the URS).

- United Rose States -

A social democratic nation exclusive to Colored/Dead Stars, and maybe its own series as well. Also, the current flag (a slightly edited U.S. flag with a rose) is a placeholder until I can make a better one (if I do make a better one, that is.)
In Dead Stars, the URS stands as a beacon of democracy pitted directly against a world of inherently discriminatory ideologies.

Artists working publicly, i.e. with publicly displayed works, must ensure that their artwork is acceptable to social mores and decency lest they risk criminal prosecution for outraging decency, calumny, &c. Good galleries and museums furthermore will only accept artwork which demonstrates skill, command of the medium and identifiable aesthetic beauty in creation. Works which lack these characteristics are by law deemed not to be “art”. The traditional Nortish schools of painting and music are distinctive yet versatile, and are supported by wealthy patrons, tending to eschew overly ornate or gaudy ornamentation in preference for simpler yet more technically complex work.

There is very little if no censorship of art in Thenu. Artists of many medias are free to do as they wish. We find humans have an odd reaction to nudity, or reproduction, or offended by certain words or such. This largely confuses us, not because these concepts are lost on us, but we never saw them as something to protect others from? It's just another facet of life. We don't understand or see the point in prolonging naivety in our offspring for example. So the arts have always enjoyed considerable freedom.

Under our Citizenship Rules Laws and Censorship Laws, the 'subject' of Art is generally considered open to interpretation (with the exception being in cases that evoke Child Safety Laws). The Laws to put it simply allow most forms of Creative Expression unless they come under the definition of either 'Vandalism' or 'Copy' (there is a Forgery Law) for which there are fines.
If a deal/request/trade cannot be negotiated due to ideological reasons, it would be nice to specify this somewhere. Please reply to Telegram msgs! They help solve a lot of issues.

Art, under the Art and Expression Act of 2008, protects the freedom to express any form of artistic expression, whether that be painting/drawing, music of any other form there may be.

In terms of censorship, Duotona has a ratings board known as the Duotonan Movie Ratings Comittee (DMRC), which gives an age rating to movies, and a separate ratings board for games, known as the Duotonan Games Association (DGA). Both of these boards rate games and movies using the same scale (A for anyone, B for older kids, C for younger teenagers, D for older teenagers, and X for adults only). These ratings dictate what games a person is allowed to buy, but it is also at the discretion of the seller.

Censorship isn't really a thing. Individual emperors and empresses have banned certain art pieces or artists in the past, but suc bans usually died with the emperor/empress. As a whole, Ctarls don't really see banning things as the best solution.

Censorship? Ya' say what? Oh, there was once, but it's no more since the 1982, when we, the revolutionaries have destroyed out former government and wrote a new constitution, which is agaisnt censorship. Cause we used up the previous one for paper to roll up weed joints.

Art of a sexual nature must not be displayed in any public area, or any private area open to public access, nor transmitted or broadcast in any way as to be readily accessible by the public. This includes not only still and moving images but written works as well. Other than that, there are no restrictions on art.

Censorship is a more complex issue.

Any organisation reporting the news or publishing information likely to be taken as factual must adhere to a strict code of conduct drawn up and policed by the Independent Factcheck Bureau. The Bureau, which stands separate from the government and the judiciary, has a raft of powers at its disposal to ensure that news providers do not mislead the public; these include imposing fines, ordering corrections to be published and even closure of news outlets that offend repeatedly. It can also put offending organisations 'on probation', meaning that all of their content has to go through the Bureau before publication. This of course amounts to censorship, but Scymulaecia regards a truthful and factual press to be of greater value to society than a free press could ever be.

However, it is worth noting that the IFB also routinely fact-checks the claims of the government and other public bodies. While it has no legal powers to act in these cases, its investigations have resulted in prosecutions against many political figures and in extreme cases have even brought down governments. The IFB is without doubt the most highly respected public body in Scymulaecia, as well as the largest and oldest, and receives thousands of contacts daily from members of the public requesting it investigate claims or simply asking for advice about whether something a person in authority has told them was true.

Any form of expression which is considered to be a threat to national unity is strictly illegal in The Controlist Ferwerter Union and producing such or other subversive works can land you into reeducation for quite some time (more than 20 years). Censorship is particularly extensive and effective on the internet, with Ferwerter censorship being very comprehensive and sophisticated. Censors are particularly sensitive to the depiction of some past or ongoing events which may harm the reputation of the state or party. Any form of art that you wish to be published or exhibited must be extensively pre-approved by a party committee. When depicting any form of history one must always follow the very strict party line. What is accepted today may land you in prison tomorrow, so it is best to not touch history at all.

Art is whatever the Queen-Empress Von Tussle deems fit. Risqué art is banned and every piece of work is personally presented to Mrs. Von Tussle for her consideration. Art found to offend the Queen-Empress is torched and its artists are imprisoned.

If a piece of art falls in her favor, it is inducted into her personal collection and the artist is given extra rations as an honor - her crabbiness is not without compassion.
