Looking at the Whoopi statement, I don't think a lawsuit against her would have a chance in hell.
TYT it might - they made demonstrably false and defamatory statements that had a reckless disregard of the truth when they declared his chased Rosenbaum down and shot him in the back.

And then when he loses he can cry oppression for cash.
Unless the reason for the out of state filing is because he’s shopping around for a state with favourable laws regarding SLAPP suits.
Plus given all the right wing and white supremacist groups queuing up to throw money and air time at him he’s going to have a hell of a time proving that the statements were damaging to him.

I personally have sympathy for the plight of someone in those shoes - particularly given the extreme level of evidence of his innocence and the complete disregard of it by so many people.
But… if we are going to have a free exchange of ideas and protections for speech, that means even bad ideas are protected, and uninformed opinions are protected. We just all hope that the facts will win out in the end in the public space.

It is protected but in America you can sue anyone he can sue them for defamation.
