[DRAFT] Advertisement Regulation Act

Postby Sorianora » Mon Feb 22, 2021 3:05 pm

Alright here is my first attempt general assembly proposal. Thanks to my co-author Dominioan, this proposal wouldn’t be a thing without them.

Image
Advertisement Regulation Act
A resolution to enact uniform standards that protect workers, consumers, and the general public.
Category: Regulation
Area of Effect: Consumer Protection
Proposed by: Sorianora

The General Assembly,

Believing that false advertisement is a harmful ploy by businesses to fool individuals into buying their products;

Disappointed that this tactic costs large amounts to manipulated customers;

Realizing the need for regulations to prevent this predatory business practice.

Hereby defines “false advertisement” as: blatantly false statements made by a company to promote their product or service

Creates the World Assembly Advertising Standards Board, (W.A.A.S.B) who's primary functions will be to:

i. Create and “advertisement standard document” which all companies in member states must conform to

ii. Review all advertisements created by companies in member states

iii. Decide whether all claims made in the advertisements are true

iv. Approve advertisements for use on the public

Mandates that companies in member states:

i. Make honest advertisements

ii. Be able to prove to the World Assembly Advertising Standards Board any claims made in their advertisement

Forces companies to pay full compensation for damages deemed to be because of a false idea of the product based on the advertisement for it by the W.A.A.S.B

Allows member states governments to sue companies for violating the W.A.A.S.B rulings

Could you, by chance, elaborate on how it’s inefficient?

I suggest you change the definition of false advertisement to "blatantly false statements made by a company to promote their product or service," because right now it bans using technically true statements with disclaimers and such, which I do believe should be allowed. I'm not sure how necessary this is, considering nations already have their own similar restrictions on advertisement. Overall, opposed.

"The proposal seeks to regulate advertisements without regard for whether they cause actual harm. More efficient by far is to give individuals a cause of action when they are affirmatively harmed by inaccurate advertisements. Further, requiring pre-approval for advertisements operates as a serious check on response to market changes and public speech. Frankly, ambassador, I think you should do some serious research before trying to legislate a topic."

Elsie Mortimer Wellesley. We agree with our colleagues that pre-approval is a poor policy choice. However, we disagree as to the need to show actual harm; such a showing would be difficult, rendering enforcement minimal.

If a tree falls in the forest does it make a sound? We say yes. It is the showing that is difficult, not the harm.

"Why do so many proposals reach my desk that are clearly not international issues? Please handle your own advertising standards, the Haven does not wish to amend its constitution to allow for this regulation on our otherwise absolute right to free speech. Opposed."
GVH has a puppet. He uses it to post in regions and on the forums. The identity of this puppet will forever remain a mystery.
