Description:
The World Assembly,
COMMITTED to the protection of all human rights;
EMPHASIZING the right to control one's own reproduction;
DISMAYED by this body's inability to maintain legislature on the matter of sterilization;
ABHORRING the use of non consensual sterilization by public and private bodies;
INTENDING to bring to an end to the non consensual sterilization of children and adults, while maintaining protection for transgender persons;
Hereby:
- DEFINES "Sterilization" as a procedure or event which temporarily or permanently removes a person's ability to biologically reproduce, through the alteration, removal of, or damage to the genitals or reproductive organs, or the use of chemicals or other biological agents to render an individual unable to reproduce;
- PROHIBITS the practice of sterilization upon an person below the nation's age of consent, except in the event of a medical emergency which will result in death or significant injury, and in which a procedure which will result in sterilization is the least medically invasive and most effective way of ending this emergency;
- PROHIBITS private and public entities from enacting sterilization upon a criminal as punishment for their crimes;
- PROHIBITS the sterilization of a person on the basis of their race, ethnicity, national origin, or religion, and declares that the practice of such is genocide;
- PROHIBITS the sterilization of a person on the basis of their mental ability or disability;
- PROHIBITS the sterilization of a person on the basis of their employment or unemployment, level of savings, current use of welfare facilities, or number of children;
- PROHIBITS public or private entities from enticing a person to seek their own sterilization through the offering of any legal consideration, including money, food, housing, or as a condition for hire or continued employment;
- PROHIBITS any entity from conducting a procedure that will result in sterilization of a person who has not offered their fully informed, uncoerced, and enthusiastic consent, or a person who is not aware that the procedure will result in their sterilization, or a person who is under duress;
- REQUIRES any procedure which will result in a person's sterilization to be conducted by a licensed medical professional;
- REQUIRES medical professionals to refuse to conduct a procedure which will lead to a person's sterilization if they believe that any of the above prohibitions have been violated;
- CLARIFIES that procedures intended to treat gender dysphoria, including hormone treatment, shall remain available and legal, so long as they are performed with the consent of the individual under treatment or their legal guardian;
- REQUIRES all member nations to criminalize travel to another nation to obtain a non-consenting person's sterilization, and to punish it with appropriate penalties;
- PROHIBITS public and private entities from outsourcing the sterilization of non-consenting persons, or any person whose sterilization is prohibited by this resolution, to a public or private entity in a nation outside the jurisdiction of the World Assembly;
- REQUIRES member nations to regularly audit the records of services which offer sterilization services to ensure that they are in compliance with all regulations, and to interview a random sample of patients who have received sterilization services to ensure the same, and to punish with appropriate penalties any service which has not complied with all regulations surrounding an individual's sterilization;
- URGES member nations to offer medical services to restore reproductive function to those who have been sterilized without their consent, and to offer financial compensation if the restoration of reproductive function is not possible.
