COUP D'ETAT IN THE REPUBLIC OF SAN DAVID [IC, OPEN]

The Republic of San David (Spanish: República de San David) commonly called San David, was a military dictatorship in South America. It was bordered on the north by Brazil, on the south by Paraguay, and on the west by Bolivia. The Republic of San David covered 821,174 square kilometers and had an estimated population of 26,264,288. The Republic of San David was comprised of eight regions divided in different provinces.

Background:

In the National Elections of 1961, the socialists candidate for president Alberto Truerbes won. He immediately started to expropriate and nationalize the industry and agriculture, with the pretext that this would eliminate the extreme differences between reach and poor citizen, but in reality, in a few months, this lead to a terrible economic crisis, making the country's citizens even more poorer. Also, Truerbes started to approach to the communist block nations, receiving economic and military support from the Soviet Union and due to the government's leftist position, a strong persecution of the Church began, killing priests and burning churches all over the country.

This where the primary factors that lead to the organization of the military coup, that had been organized since 1962.

Republic of San David Armed Forces Headquarters, Ciudad San David.

Around a long rectangular table, full of maps, telephones and military documents, a group of senior military officers have met to discuss the last preparations for the uprising that will take place tomorrow against the leftist government that has impoverished the country. Among them is General of the Army Francisco Santáguez, the main organizer and the one chosen to take the charge of President once the coup has started. Once the meeting has ended and everyone is ready to leave, e makes an improvised speech to the members gathered there:

"San Davidian comrades,

Tomorrow will be the most important day of our lives, as we will rebel against this tedious government of anti-patriots and traitors, that has led to the near total destruction of our motherland it's people, culture and national identity. We will return to the Republic of San David it's former glory and pride.

Long live the Republic of San David!
Long live the coup!"

THE MILITARY COUP BEGGINS

Today, at about 17:50 pm of the 3 September 1963, made by the Army of the Republic of San David, the Air Force, the Navy and the National Gendarmerie, a coup d'etat has started. In the capital city of Ciudad San David, columns of army tanks and soldiers have started to march on the streets, going to different points of the city. The 1st, 2nd and 3rdArmored Divisions, with about 600 soldiers are heading towards the Ministry District. The 4th Division accompanied with some 350 soldiers is heading to the Congress of the Nation (the parliament) and finally, the 5th and 6th Divisions are heading, accompanied by the best soldiers, to the Presidential Palace, to arrest President Alberto Truerbes. The rest of the army, helped by the National Gendarmerie, is spread through all the capital city, controlling major streets, strategic points and arresting everyone suspicious of being a leftist. The Republic of San David Air Force gives air support to the army with helicopters and fighters flying over Ciudad San David.

THE MINISTRY DISTRICT FALLS

At around 18:21 pm, armed soldiers enter abruptly into the Ministry District. With tanks guarding the street, soldiers break through the buildings. As they enter the different ministries, while shooting to the air they yell: "Hands up! The National Uprising has begun! Collaborate with the Army, or you will be shot!". All ministerial workers are caught by surprise. Some complain, but are quickly threatened. Others, oppose to collaborate, and are taken outside and shot in the head in front of everyone. All ministers in there are immediately arrested by "High Treason against the Motherland" and are transported to military trucks outside the ministerial buildings. Here, the army arrests the minister of communications, the minister of transport, the minister of education, the minister of economy and the minister of culture, among others.

Now, the plotters control the majority of the ministeries, including the Ministry of Comunications, giving them access to the radio, television and press.

THE FIRST OFFICIAL COMMUNIQUÉ:

Haven assumed control of all country communications, army liuthenant José Arraujo, the one in charge of taking control of the Ministerial District gives the first official communiqué of the situation on radio and television:

"Citizens of the Republic of San David,

Youare advised that as of today, our Motherland is under the operational control of the Armed Forces of San David. We recommend to all inhabitants strict compliance with the provisions and directives emanating from the military, security or police authorities, and to be extremely careful to avoid individual or group actions and attitudes that may require drastic intervention from the operating personnel. From now beyond, the country enters on a state of emergency and martial law is applied. It will be not permitted to walk in the street nor leave your house from 21:00 to 07:00. All types of meetings and organizations are outlawed. The old socialist government is no longer having any authority, so, all citizens must now unconditionally obey to the Armed Forces, it's men and all the orders and laws that they enact from now beyond. Anyone who does not respect this statements will be immediately arrested by the military authority.

Long live the National Uprising!
Long live the Republic of San David!"

THE FALL OF THE CONGRESS

At around 19:26 pm military personnel assaulted the Congress of the Nation, headed by Colonel Alvaque. All parliament members where arrested for being "traitors", including the resting ministers, but after some minutes of capture, right wing politicians where released, but secretly kept under strict control by the National Gendarmerie. The rest of parliamentarians (all of them of left ideology) could be seen being led out of the parliament building, bound by hand-cuffs and blinded by sacks, and forced into army trucks, which promptly zipped off to an unknown destination, where they will be awaiting trial.

After the assault and fall of the National Congress, there was only one place and person left to ultimately achieve power, the Presidential Palace and the President.

THE PRESIDENT UNDER ARREST

Taking the Presidential Palace was not as easy for the military as it first seemed, because a big group of radical supporters of the government had surrounded the palace in order to not let the army to entre with the shouting of: "No to the army! Yes to democracy!".

At first, the soldiers tried to entre by passing in the middle of the protesters, but it was impossible. Seeing how the protests continued, and the protester ignoring the advises by part of the army, that if they did not stand aside, they would be shot, the insurrectionists decided to shot the government supporters. After the first shots , the chaos quickly spread between those defending the president, and all of them where killed, or ran away. It is calculed that about 20 protesters have been killed, but the number of casualties is not official. After the "neutralization" of the protest, army soldiers quickly assaulted the Presidential Palace, arresting or killing everyone that showed any kind of opposition or discomfort with the military authority. When they entered into the presidential office, they saw president Truerbes with his wife and two children. At first the president said: "What is all this nonsense, Colonel? I request an explanation." Colonel Prietrio responded to him: "Mr. Truerbes, you are now under arrest by high treason against the San David Motherland and it's people". After this words, two soldiers handcuffed the now ex-president, and they took him to a military helicopter waiting outside in the presidential gardens, to be taken to an unknown location. His wife was also arrested and his two children where taken away.

NEW PRESIDENT OF THE REPUBLIC OF SAN DAVID

4 September 1963

After the detention of Truerbes and the capital and country under control, arrived from the Armed Forces Headquarters, General of the Army Francisco Santáguez gets out of the car and enters, accompanied by other military officers, into the Congress of the Nation that it's filled with reporters and more soldiers. Santáguez is presented with the Holy Bible, and putting his hand over it he says the pledge as he is proclaimed president:

"I swear: as president I will be faithful and obedient to the people of the Republic of San David, to observe the law, serve my motherland and to conscientiously fulfill my official duties, so help me God."
Long live the Republic of San David!"

After his pledge he starts his speech:

"Loyal citizens of the Republic of San David,

On the day of today, we, the Armed Forces of the Republic of San David, have rebelled against the previous government. This action was made with great premeditation and with the San Davidian people's welfare, prosperity and honor always in mind. The previous government, formed by red traitors who have impoverished and devastated and sold our motherland to the european communists has fallen and does not exercise any authority over San Davidian territory. Ex-president Truerbes and all of his government is now under military custody awaiting trial for their crimes of high treason. Anyone who consciously supporting the previous government and trying to overthrow the new one will suffer the same fate.

Due to the extraordinary situation that has taken place in the last hours and to maintain the order and stability, as president I disolve the Congress of the Nation, and replace it with the Military Junta of the Nation. I also illegalize all political parties and abolish the constitution and I apply the state of emergency and martial law. Anyone resisting military authority will be arrested.

Loyal San Davidians, a new era of peace and prosperity begins today. This day will be remembered by future generations as the day in which the true San Davidians rebelled against the tyrannical red government.

Long live the National Uprising!
Long live the Republic of San David!"

Official Statement

The Commonwealth of Zanthion has been informed of the situation in the Republic of San David. Our government treats the situation as an internal affair of San David and therefore we shall not intervene unless circumstances change significantly.

That being said, we do advise travelers to reconsider their plans to San David and reconsider any non essential travel plans due to the political instability in the region.

We are currently not in a position to determine the legitimacy of the new government, however we hope to begin communication and diplomatic ties with the new government of the Republic of San David as soon as possible.

New law approved by the military junta.

LAW FOR THE PROTECTION OF THE REPUBLIC OF SAN DAVID

Article 1.
Due to the recent extraordinary events and in order to mantain order and stability it is therefore permitted to restric personal freedom, the right to freedom of expression, including press freedom, association and assembly rights, interventions in postal, postal, telegraphic and telephonic secrecy, house search and seizure orders, and restrictions on property, even outside it otherwise permitted by law.

Article 2.
If the measures necessary to restore public security and order are not taken in one country, the Republic of San David Government can temporarily exercise the powers of the supreme Regional authority.

Article 3.
The authorities of the provinces and municipalities (municipal associations) must obey the orders issued by the Republic of San David Government pursuant to Article 2 within the scope of their jurisdiction.

Article 4.
Whoever violates the orders issued by the supreme Regional authorities or their subordinate authorities for the implementation of this Law or the orders issued by the Republic of San David Government in accordance with article 2 or who invites or incites to such an offense shall be punished, unless otherwise provided by other provisions with a more severe penalty threatened with jail not less than a month or fined from 150 to 15,000 San David Pesos.
Anyone who brings about a general danger to human life by offenses under para. 1 shall not be sentenced to penalties, mitigating circumstances with imprisonment not less than six months and, if the offense causes the death of a person, not less than two at mitigating circumstances with a penitentiary Years ago. In addition, it can be recognized on asset collection.

Article 5.
At death, the crimes punishable by the Criminal Code in articles 81 (high treason), 229 (poisoning), 307 (arson), 311 (explosion), 312 (flooding), 315
(damage to railway facilities) , 324 (dangerous poisoning) threatened with lifelong prison.
At the death or, as far as not previously threatened with a heavier sentence, with life-long penitentiary or with a penitentiary up to 15 years will be punished:
1. Whoever undertakes to kill the President or a member or Commissioner of the Republic of San David Government or a Regional Government or who asks for such killing, offers himself, accepts such offerings or arranges such a killing with another;
2. who in the cases of article 115 of the Criminal Code (serious uproar) or article 125 of the Criminal Code (serious breach of the peace) commits the offense with weapons or in conscious and deliberate cooperation with an armed man;
3. who commits a deprivation of liberty (article 239) of the Criminal Code with the intention to use the person deprived of freedom as a hostage in the political struggle.

Article 6.
This regulation comes into force on the day of its promulgation.

TERRORISTS KILLED BY SOLDIERS

Today, 34 communist terrorists have been killed. They where found by an army squad, in during the curfew hours. They where painting in the walls subversive messages like: "Down with the military dictatorship!" or "Death to Santáguez". When they found out that a military patrol was approaching, they tried to ran away, but they had already been seen. The soldiers had no other option, and shot directly at them resulting in the death of seven of the integrants. The others tried to ran away, but ultimately they where also killed. Once the bodies had been identified, it has been found that all of them where part of a left wing terrorist group opposing the new government. In their apartment several homemade bombs and subversive propaganda leaflets have been found. 27 of the members where San Davidians, 4 from Zanthion and 3 from Yoannes.

The new government has enacted a new constitution in order to "legitimize" the Military Junta.

CONSTITUTION OF THE REPUBLIC OF SAN DAVID - 1963
Approved by the Military Junta of the Nation, September 6 ,1963

The Military Junta of the Nation of the Republic of San David, in the name of Almighty God decrees the following Constitution.

CHAPTER I
The National State


Article 1.
I. The San Davidian State, constituted as a Republic, is the supreme institution of the national community.
II. The State is responsible for the exercise of sovereignty through the appropriate bodies for the purposes it has to fulfill.

Article 2.
I. National sovereignty is one and indivisible, without being subject to delegation or assignment.
II. The institutional system of the San Davidian State responds to the principles of unity of power and coordination of functions.

Article 3.
The only official language of the Republic of San David is Spanish.

Article 4.
The official religion of the State is Roman Catholicism.

Article 5.
They are fundamental goals of the State: the defense of unity among men and between the lands of San David; the maintenance of the integrity, independence and security of the Nation; the safeguarding of the spiritual and material heritage of the San Davidians; the protection of the rights of the person, of the family and of society; and the promotion of a just social order in which all particular interests are subordinated to the common good.

Article 6.
The Patriotic Movement of San David, communion of the San Davidians, forms the political order, open to the whole of the San Davidians and, for the best service of the Homeland, promotes political life in a regime of orderly competition of criteria.

Article 7.
The capital city of the Republic of San David is Ciudad San David, renamed as Ciudad Santáguez.

CHAPTER II
The Head of State


Article 8.
The Head of State is the supreme representative of the Nation; embodies national sovereignty; it exercises supreme political and administrative power; it holds the National Leadership of the Patriotic Movement and takes care of the most exact observance of the laws, as well as of the continuity of the State and of the Patriotic Movement; guarantees and ensures the regular functioning of the High State Bodies and the proper coordination between them; sanctions and promulgates laws and provides for their execution; he exercises the supreme command of the Armies of Earth, Air and National Gendarmerie; ensures the preservation of public order in the interior and the security of the State abroad; justice is administered in his name; exercises the prerogative of grace; confers, according to the laws, jobs, public offices and honors; it accredits and receives diplomatic representatives and performs whatever acts correspond to it according to the law.

Article 9.
Corresponds, in particular, to the Head of State:
a) Convene the National Military Junta in accordance with the Law, as well as preside at the opening session of each legislature and direct them, in agreement with the Government, the inaugural address and other messages.
b) To extend by the indispensable time, at the request of the Junta or of the Government and in agreement with the Council of the Republic, a legislature when there is a serious cause that prevents the normal renewal of the Junta members.
c) Submit to a referendum of the Nation the bills.
d) Appoint and remove from office High Positions in the manner provided by the Laws.
e) Convene and preside over the Council of Ministers and the National Defense Board when attending their meetings.
f) To preside, if it deems appropriate, the deliberations of the Council of the Republic and of the National Council, provided that those of the Council do not affect their person. In no case shall the voting take place in the presence of the Head of State.
g) Obtain advice and advice from the Council of the Republic.
h) Collect reports from the National Council.

Article 10.
I. The person of the Head of State is inviolable. All San Davidians must respect and comply.
II. Everything that the Head of State has in the exercise of his authority must be endorsed, as the case may be, by the President of the Government or the Minister to whom it corresponds, the President of the Junta or the President of the Council of the Republic, lacking value any provision that does not conform to this formality.
III. The people who endorse them will be responsible for the acts of the Head of State.

Article 11.
The Head of the State needs a law, or, as the case may be, agreement or authorization from the Junta, for the following purposes:
a) Ratify treaties or international agreements that affect the full sovereignty or integrity of San Davidian territory.
b) Declare war and agree on peace.

Article 12.
The Head of State will be assisted by the Council of the Republic, to:

a) Propose to the Junta those acts that, according to the provisions of the previous article, require a law, agreement or authorization thereof.
b) Return to the Junta for new study a law prepared by them.
c) To extend a legislature for serious reasons and for the necessary time.
d) Adopt exceptional measures when the external security, the independence of the Nation, the integrity of its territory or the institutional system of the Republic are threatened in a serious and immediate way, giving a documented account to the Junta.
e) Submission of transcendental bills to a national referendum when this is not mandatory.

Article 13.
During the absences of the Head of State of the national territory, or in case of illness, a successor appointed by him, will assume his functions.

Article 14.
The designation of the successor must fall on a person of San Davidian nationality who professes the Catholic religion and is incompatible with the exercise of the Regency, the Presidency of the Government or the Presidency of the Junta.

CHAPTER III
The Government of the Nation


Article 15.
I. The Head of State directs the governance of the Republic through the Council of Ministers.
II. The Council of Ministers, constituted by the President of the Government, the Vice President or Vice Presidents, if any, and the Ministers, is the body that determines the national policy, ensures the application of the laws, exercises the regulatory power and assists in a permanent way to the Head of State in political and administrative matters.
III. The agreements of the Government will always be endorsed by its President or by the Minister to whom it corresponds.

Article 16.
I. The President of the Government shall be San Davidian and shall be appointed by the Head of State on a proposal submitted by the Council of the Republic.
II. His term will be five years. Fifteen days before the expiration of this, the Republic Council will raise the proposal referred to in the previous paragraph.
III. The position of President of the Government will have the incompatibilities indicated in the Laws.
IV. It corresponds to the President of the Government to represent the Government of the Nation, to direct the general policy and to assure the coordination of all the organs of government and administration.
V. The President of the Government, on behalf of the Head of State, exercises the National Leadership of the Movement, assisted by the National Council and the Secretary General.

Article 17.
The President of the Government shall cease to hold office:
a) Due to the expiration of the term of his mandate.
b) At their own request, once their resignation has been accepted by the Head of State, after hearing the Council of the Republic.
c) By decision of the Head of State, in agreement with the Council of the Republic.
d) On the proposal of the Council of the Republic, for incapacity appreciated by two thirds of its members.

Article 18.

I. In the event of the death of the President of the Government or in the cases of paragraphs b), c) and d) of the preceding article, the Vice President or Vice-Presidents shall assume their functions temporarily in the order established or, if there is no Vice President, the Minister appointed by the Head of State.
II. Within a period of ten days, a new President shall be appointed in the manner established in article 14.

Article 19.
I. The other members of the Government shall be San Davidian and their appointment and separation shall be made by the Head of State at the proposal of the President of the Government.
II. Their positions will have the incompatibilities indicated by the Laws.

Article 20.
The members of the Government will cease in their positions:
a) When changing the President of the Government.
b) On the initiative of the President of the Government, accepted by the Head of State.
c) At their own request, when the resignation has been accepted by the Head of State at the proposal of the President of the Government.

Article 21.
The President and the other members of the Government, before taking office, shall lend to the Head of State an oath of allegiance to him, to the Motherland and it's people, as well as to keep their deliberations secret.

Article 22.
I. The President and the other members of the Government are jointly and severally liable for the agreements made in the Council of Ministers. Each one of them will be responsible for the acts that they carry out or authorize in their Department.
II. The criminal responsibility of the President and of the other members of the Government and the civilian for acts related to the exercise of their functions, will be demanded before the Supreme Court of Justice in plenary session.

CHAPTER IV
The Military Junta of the Nation


Article 23.
The Military Junta of the Nation are the highest organ of participation of the San Davidian people in the tasks of the State. It is the main mission of the Military Junta of the Nation the drafting and approval of the laws, without prejudice to the sanction that corresponds to the Head of State.

Article 24.
I. The Courts are composed of the different members included in the following sections:
a) The members of the Government.
b) The National Councilors.
c) Representatives of the Armed Forces of the Republic of San David and the National Gendarmerie.

Article 25.
To be a member in Military Junta of the Nation, you must:
1. Be San Davidian and of legal age.
2. To be in full use of civil rights and not suffer political disqualification.

Article 26.
The Members in Military Junta of the Nation shall accredit before the President of the same the election, designation or position that entitles them to such investiture. The President of the Military Junta of the Nation will take an oath, give possession and issue the corresponding titles.

Article 27.
Members in Military Junta of the Nation may not be detained without the prior authorization of their President, except in case of flagrante delicto. The arrest, in this case, will be communicated to the President of the Military Junta of the Nation.

Article 28.
The Members in Military Junta of the Nation that are it by reason of the position that they carry out, will lose that condition when ceasing in this one. Those appointed by the Head of State will lose it by revocation of it.

Article 29.
I. The President of the Military Junta of the Nation shall be appointed by the Head of State among the Members in the Military Junta of the Nation who appear in a short list submitted by the Council of the Republic within a maximum period of ten days from the time the vacancy occurs. His appointment will be endorsed by the acting President of the Republic Council.
II. His term of office will be six years, while maintaining his term as Procurator in Cortes. The position of President of the Military Junta of the Nation will have the incompatibilities indicated by the Laws.
III. The President of the Military Junta of the Nation shall cease to hold office:
a) Due to the expiration of the term of his mandate.
b) At their own request, once their resignation has been accepted by the Head of State, after hearing the Council of the Kingdom gathered in the absence of the President of the Military Junta of the Nation.
c) By decision of the Head of State, in agreement with the Council of the Republic in a meeting analogous to that envisaged in the previous paragraph.
d) Due to incapacity appreciated by two thirds of the Military Junta of the Nation, presided by the first Vice President or, as the case may be, the second Vice President, following a reasoned proposal from the Permanent Commission, with a similar presidency, or from the Government.
IV. Vacancy the Presidency of the Military Junta of the Nation, will take charge of it the first Vice President or, as the case may be, the second Vice President, until a new President is appointed within a period of ten days.

Article 30.
The Military Junta of the Nation will work in Plenary and by Commissions. The Commissions are fixed and appointed by the President of the Military Junta of the Nation, at the proposal of the Permanent Commission and in agreement with the Government. The President fixes, in agreement with the Government, the order of the day, both of the Plenary and of the Commissions.

Article 31.
The Military Junta of the Nation meet in plenary session for the examination of the laws that require this competence and, in addition, whenever they are convened by the President, in agreement with the Government.

Article 32.
The Military Junta of the Nation shall know, in plenary session, the acts or laws that have as their object any of the following matters:
a) The ordinary and extraordinary budgets of the State.
b) Large economic and financial operations.
c) The establishment or reform of the tax system.
d) Bank and monetary ordination.
e) The economic intervention of the Trade Unions and all legislative measures affecting, in a transcendental degree, the Economy of the Nation.
f) Basic laws regulating the acquisition and loss of San Davidian nationality and the rights of San Davidian citizens.
g) The political-legal arrangement of State institutions.
h) The bases of the local regime:
i) The bases of Civil, Commercial, Social, Criminal and. Procedural.
j) The bases of the Judicial Organization and the Public Administration.
k) The bases for land, commercial and industrial management.
l) National education plans.
m) The other Laws that the Government, by itself or at the proposal of the corresponding Commission, decides to submit to the Plenary of the Military Junta of the Nation.
Likewise, the Government may submit matters or agreements that do not have the character of a Law to the Plenary.

Article 33.
The bills that have to be submitted to the Plenary will pass previously to report and proposal of the corresponding Commissions.

Article 34.
I. They are within the competence of the Committees of the Military Junta of the Nation all provisions that are not covered by Article 30 and that must take the form of law, either because it is established in any subsequent to this or because it is ruled in that sense by a Commission composed of the President of the Military Junta of the Nation, a Minister appointed by the Government, a Director belonging to the Permanent Commission of the National Council, a Member in Military Junta of the Nation with the title of Legal Counsel, the President of the Council of State and the Supreme Court of Justice. This Commission will issue an opinion at the request of the Government or the Permanent Commission of the Military Junta of the Nation.
II. If any Committee of the Military Junta of the Nation should raise, on the occasion of the study of a bill, proposal of law or independent motion, any matter that is not within the competence of the Military Junta of the Nation, the President of the Military Junta of the Nation, on his own initiative or at the request of the Government, may request the opinion of the Commission referred to in the previous paragraph. In the event that the opinion is deemed not to be the issue of the competence of the Military Junta of the Nation, the matter will be removed from the agenda of the Commission.

Article 35.
For reasons of urgency, the Government may propose to the Head of State the enactment of decree-laws to regulate matters set forth in articles 30 and 32. The urgency will be appreciated by the Head of State, after hearing the Commission referred to in the previous article, which may draw the attention of the Permanent Commission if it notices counterfuel material. Continuous act of the promulgation of a decree-law will be reported to the Military Junta of the Nation.

Article 36.
I. The ratification of international treaties or conventions that affect the full sovereignty or territorial integrity of San David will be the object of a law approved by the Plenary of the Military Junta of the Nation.
II. The Military Junta of the Nation in Plenary or in Commission, according to the cases, will be heard for the ratification of the other treaties that affect to matters whose regulation is of its competence, according to the articles 30 and 32.

Article 37.
I. In addition to the examination and elevation to the Plenary Session of the Government Bill, the legislative Commissions may submit proposals of law to the President of the Military Junta of the Nation, to whom it corresponds, in agreement with the Government, their inclusion in the agenda.
II. The legislative Commissions may receive from the President of the Military Junta of the Nation other tasks, such as carrying out studies, practicing information and formulating petitions or proposals. They may be constituted, for these purposes, in special commissions other than the legislative ones.

Article 38.
The President of the Military Junta of the Nation shall submit to the Head of State, for sanction, the laws approved by them, which must be promulgated within one month of their reception by the Head of State.

Article 39.
The Head of State, by means of a motivated message and after obtaining a favorable opinion from the Council of the Republic, may return a law to the Military Junta of the Nation for further deliberation.

CHAPTER V
Justice


Article 40.
Justice will enjoy complete independence. It will be administered on behalf of the Head of State, in accordance with the laws, by independent Judges and Magistrates, immovable and responsible in accordance with the Law.

Article 41.
All San Davidians will have free access to the Courts of Justice. Justice will be free for those who lack economic means.

Article 42.
The jurisdictional function, judging and enforcing the judged, in the civil, criminal, contentious-administrative, labor and other lawsuits that the Laws establish, corresponds exclusively to the Courts and Tribunals determined in the Organic Law of Justice, according to its diverse competences.

Article 43.
I. The Military Jurisdiction will be governed by the laws and regulations that regulate it.
II. The Ecclesiastical Jurisdiction will have as its ambit the one that establishes the Concordat with the Holy See.

Article 44.
The high inspection of the Justice corresponds to the President of the Supreme Court, which will be appointed among San Davidian jurists of recognized prestige.

Article 45.
Judges and Magistrates may not be separated, suspended, transferred or retired, but for some of the causes and with the guarantees prescribed in the Laws.

Article 46.
I. The Public Prosecutor's Office, the communication body between the Government and the Courts of Justice, has the mission of promoting the action of the Justice in defense of the public interests protected by law and to procure before the Courts and Tribunals the maintenance of the legal order and the satisfaction of the social interest.
II. The functions entrusted to the Public Prosecutor's Office shall be exercised through its organs, ordered according to the principles of unity and hierarchical dependence.

Article 47.
Public authorities and organizations, as well as individuals, are obliged to provide the Courts and Tribunals with the necessary assistance to exercise the jurisdictional function.

CHAPTER VI
The Armed Forces


Article 48.
The Armed Forces of the Nation, constituted by the Armies of Land, Sea and Air and the Forces of Public Order, guarantee the unity and independence of the Homeland, the integrity of their territories, national security and the defense of the institutional order.

Article 49.
A National Defense Board, composed of the President of the Government, the Ministers of the Military Departments, the Chief of the General Staff and the Chiefs of Staff of the Armies of Land, Sea and Air, will propose to the Government the general guidelines concerning national security and defense. To this National Defense Board may be incorporated the Ministers or High Charges that, due to the nature of the matters to be discussed, it is considered convenient.

Article 50.
A High General Staff, dependent on the President of the Government, will be the technical body of the National Defense, with the mission of coordinating the action of the May States of the three Armies.

CHAPTER VII
Rights and Duties of Citizens


Article 51.
The Republic of San David proclaims as a guiding principle of its acts respect for the dignity, integrity and freedom of the human person, recognizing man, as the bearer of eternal values ​​and member of a national community, holder of duties and rights, whose Exercise guarantees in order to the common good.

Article 52.
The San Davidians owe faithful service to the Fatherland, loyalty to the Head of State and obedience to the laws.

Article 53.
The Law protects equally the right of all San Davidians, without class preferences or respect of persons.

Article 54.
San Davidians have the right to respect their personal and family honor. Whoever outrages him, whatever his condition, will incur responsibility.

Article 55.
All San Davidians have the right to receive education and instruction and the duty to acquire them, either within their family or in private or public centers, at their own free will. The State will ensure that no talent is lost due to lack of financial means.

Article 56.
I. The profession and practice of the Catholic Religion, which is that of the San Davidian State, will enjoy official protection.
II. The State will assume the protection of religious freedom, which will be guaranteed by an effective legal protection that, at the same time, safeguards morality and public order.

Article 57.
I. It constitutes a title of honor for the San Davidians to serve the Fatherland with arms.
II. All San Davidians are obliged to provide this service when they are called in accordance with the Law.

Article 58.
By means of laws, and always with a general nature, personal benefits that demand the interest of the Nation and public needs may be imposed.

Article 59.
San Davidians will contribute to the maintenance of public charges according to their economic capacity. No one shall be obliged to pay taxes that have not been established in accordance with the law voted in the Military Junta of the Nation.

Article 60.
All San Davidians have the right to participate in public functions of a representative nature, through the family, the municipality and the union, without prejudice to other representations established by law.

Article 61.
All San Davidians may hold positions and public functions according to their merit and ability.

Article 62.
All San Davidians may freely express their ideas as long as they do not violate the fundamental principles of the State.

Article 63.
Within the national territory, the State guarantees the freedom and secrecy of correspondence.

Article 64.
Spaniards have the right to freely determine their residence within the national territory.

Article 65.
No one may enter the domicile of a San Davidian or make registrations therein without his consent, except with a mandate from the competent Authority and in the cases and in the manner established by the Laws.

Article 66.
I. San Davidians may meet and associate freely for lawful purposes and in accordance with the provisions of the law.
II. The State may create and maintain the organizations it deems necessary for the fulfillment of its purposes. The foundational norms, which shall take the form of a law, shall coordinate the exercise of this right with that recognized in the preceding paragraph.

Article 67.
San Davidians have the right to legal security. All the organs of the State shall act according to a hierarchical order of pre-established norms, which may not be arbitrarily interpreted or altered.

Article 68.
I. No San Davidian may be detained except in the cases and in the manner prescribed by the Laws.
II. Within the term of seventy-two hours, all detainees will be released or handed over to the judicial authority.

Article 69.
No one may be convicted except by virtue of the law prior to the crime, by means of a ruling of the competent court and after hearing and defending the interested party.

Article 70.
No San Davidian may be deprived of his nationality except as a crime of treason, defined in the criminal laws, or by entering the service of arms or exercising public office in a foreign country against the express prohibition of the Head of State.

Article 71.
I. San Davidians may individually address petitions to the Head of State, to the Military Junta of the Nation and to the Authorities.

Article 72.
I. The State recognizes and protects the family as a natural institution and foundation of society, with rights and duties prior and superior to any positive human law.
II. Marriage will be one and indissoluble.
III. The State will especially protect large families.

Article 73.
Parents are obliged to feed, educate and instruct their children. The State will suspend the exercise of parental authority or deprive it of those who do not exercise it with dignity, and transfer the custody and education of minors to whom by law corresponds.

Article 74.

All San Davidians have the right to work and the duty to engage in some socially useful activity.

Article 75.
Work, because of its essentially human condition, can not be relegated to the material concept of merchandise, nor be subject to any transaction incompatible with the personal dignity of the person who provides it. It constitutes by itself an attribute of honor and sufficient title to demand tutelage and assistance from the State.

Article 76.
I. The State recognizes in the Company a community of contributions of technology, labor and capital in its various forms, and proclaims, as a consequence, the right of these elements to participate in the benefits.
II. The State will take care that the relations between them are kept within the strictest fairness and in a hierarchy that subordinates the economic values ​​to those of human category, to the interest of the Nation and to the demands of the common good.

Article 77.
All workers will be protected by the State in their right to a just and sufficient remuneration, at least, to provide them and their families with the well-being that allows them a moral and dignified life.

Article 78.
The Spanish State guarantees workers the security of protection in misfortune and recognizes the right to assistance in cases of old age, death, illness, maternity, work accidents, disability, forced unemployment and other risks that may be subject to social Security.

Article 79.
The State will maintain institutions of assistance and will protect and propel those created by the Church, the Corporations and individuals.

Article 80.
I. Private property as a natural means for the fulfillment of individual, family and social purposes is recognized and protected by the State.
II. All forms of property are subordinated to the needs of the Nation and the common good.
III. Wealth can not remain inactive, be unduly destroyed or applied for illicit purposes.

Article 81.
The State will provide all San Davidians with access to the forms of property most closely linked to the human person: family home, inheritance, work tools and everyday goods.

Article 82.
I. In no case shall the penalty of confiscation of property be imposed.
II. No one may be expropriated except for reasons of public utility or social interest, subject to the corresponding compensation and in accordance with the provisions of the Laws.

Article 83.
The exercise of the rights recognized in this Chapter may not affect the spiritual, national and social unity of San David.

Article 84.
The Military Junta of the Nation will vote the Laws necessary for the exercise of the rights recognized in this Chapter.

Article 85.
The validity of articles 62, 63, 64, 65, 66 and 68 may be temporarily suspended by the Government totally or partially by decree-law, which exhaustively determines the scope and duration of the measure.

Article 86.
Any violation that is committed against any of the rights proclaimed in this Chapter will be sanctioned by the Laws, which will determine the actions that for their defense and guarantee may be used before the competent jurisdictions in each case.

CHAPTER VIII
The State Administration


Article 87.
I. The Administration, constituted by hierarchically ordained bodies, assumes the fulfillment of the purposes of the State in order to promptly satisfy the general interest.
II. The superior organs of the Administration, their respective competence and the bases of the regime of their officials, will be determined by Law.
III. The Administration will be advised by the advisory bodies established by law.
IV. The Council of State is the supreme advisory body of the Administration, and its competence and operation will be adjusted to what is provided by law.
V. The National Economy Council is the advisory, advisory and technical body in matters of importance that affect the national economy.

Article 88.
I. The Administration may not dictate provisions contrary to the Laws, nor regulate, unless express authorization of a Law, those matters that are the exclusive competence of the Military Junta of the Nation.
II. Administrative provisions that violate the provisions of the previous paragraph will be null.

Article 89.
I. The resolutions and agreements issued by the Administration will be in accordance with the rules governing the administrative procedure.
II. Against the acts and agreements that put an end to the administrative procedure, the actions and appeals that proceed before the competent jurisdiction may be exercised, in accordance with the laws.
III. The responsibility of the Administration and its authorities, officials and agents may be demanded for the reasons and in the manner determined by the Laws.

Article 90.
All authorities and public officials must lend, before taking office, the corresponding oath.

Article 91.
The Court of Accounts of the Republic corresponds, with full independence, the examination and verification of the expressive accounts of the acts carried out in the exercise of the Budgetary and Fiscal Laws, as well as the accounts of all the official organisms that receive aid or subsidy charged to the General Budgets of the State and its autonomous Organizations, and perform the other functions indicated in its Constitution.

CHAPTER IX
The Local Administration


Article 92.
I. The Municipalities are natural entities and constitute basic structures of the national community, grouping territorially into Provinces.
II. The Province is circumscription determined by the grouping of Municipalities, at the same time territorial division of the Administration of the State.
III. The Region is circumscription determined by the grouping of Municipalities, at the same time territorial division of the Administration of the State.

Article 93.
I. Municipalities, Provinces and Regions have legal personality and full capacity for the fulfillment of their peculiar purposes in the terms established by law, without prejudice to their cooperative functions in State services.
II. The municipal, provincial and regional Corporations, representation and management bodies of the Municipality and the Province, respectively, will be elected by suffrage. articulated through the representative channels indicated in article 60 of Chapter VII.

Article 94.
The State promotes the development of municipal, provincial and regional life, protects and promotes the heritage of local Corporations and assures to them the economic means necessary for the fulfillment of their purposes.

Article 95.
The regime of the local Administration and its Corporations, in accordance with the provisions of the preceding articles and the guarantees required by the common good in this order, will be determined by law.

CHAPTER X
National Symbols and Anthem


Article 96.
The National Flag is composed of three horizontal stripes: green, white and green; whith the National Coat of Arms in the middle of the white stripe.

Article 97.
The National Coat of Arms consists in a blue oval escutcheon, with Saint David inside, surrounded by two sprigs of laurel vert tied together in base and a star as the crest. At the back of the Coat of Arms, two swords crossed.

Article 98.
The official National Anthem of the Republic of San Davod is: "Mi general Francisco Santáguez".

Article 99.
The official motto of the Republic of San David is "Unity, Discipline, Work".

CHAPTER XI
Modification of the Constitution


Article 100.
This Constitution can only be changed by the Head of State.

Article 101.
If the Head of State is can not exercise his power by any reason, this Constitution can be changed if 4/5 of the Military Junta of the Nation agree to change it.

Final Dispositions

Article 102.
This Constitution enters in force on the day of its approval, September 6 1963.

September 6th, 1963

After the coup d'état on the Republic of San David and the destruction of democratics values, a speech in front of the parliament is setted by the president of the Assembly:

"We strongly denounce the Coup d'état that happen in the Republic of San David and their lack of human rights values.In 2 days,we enact The War Plan called Operation:Pheasent,with the attempt to crush the Coup and instored a democracy,WE WILL CRUSH THEM,WE WILL ERASE ALL THESE FASCISTS!"

Everyone applaused except the extreme right wings party that siege at the parliament

For sure,this was a lie,as Operation:Pheasent is not (only,but in a last desesperate mouvement) about invading the country,but it's about founding terrorists organisations and revolutionaries.

The first step was to arm up these people,for doing this,we open border to all these people and give them Yoannes guns,millitary clothes and equipement,and send them back to San David,The operation of opening border will only begin tommorow.For now,Leaflets are given to any people who want to revolt against this junta with these instructions inside it.

5 of this revolutionnaries created the SDDLF or "San David Democratic Liberation Front" protected by the goverment of Yoannes with the tasks to plans attacks against the Junta

The Eternal Kingdom stands opposed to the illegal overthrow of the Government of San David and the terrorist funding by Yoannes. To that effect, the Cabinet of Sensimillastan has authorized Grand Admiral Mclaughlin of the Great Northern Fleet to put into effect a No-Fly Zone in the of San David. This No-Fly Zone will apply to all Military aircraft San David. Enforcement of the No-Fly Zone will begin at 0800 hours unless President Truerbes and His Ministers are released into our custody by that time. We hope you will cooperate.
