Capital Punishment has been abolished in Agonya since 1980.

In extreme cases, however, or if there is enough public pressure, the President will convene an Extraordinary Judicial Council to decide whether the death sentence is justified.

2010: Julius Gonzalez was sentenced to 30 years rehabilitation for drug offences which resulted in the deaths of five young women.

2012: Giorgio Weiss was sentenced to 40 years for the murder of three young men.
The victim's families and their supporters appealed against the sentence and the case was reviewd by the EJC.
Giorgio Weiss died escaping from police custody before the verdict was announced.

2013: Ruby Malone was tried for the murder and cannibalism of her two children.
Public opinion caused the case to go straight to the EJC who sentenced her to life in a rehabilitation institution despite calls for her execution.
Ruby Malone died before she could be transferred.

Firstly, the person must be convicted of a class 1 felony (Murder, Treason, Rape, Arson, Kidnapping [which includes slavery under an international agreement], Terrorism, etc.) or a third time repeat offender of a class 2 felony or a misdemeanor. Also, a judge may include execution as punishment for DWI-DUI if they see fit, for repeat offenders.

To explain things more, the state does not view itself as having any obligation to address so-called 'crimes' against the individual. If someone gets killed or raped, that's their problem for being weak and not having pledged themselves to someone stronger who could protect them. The state is the personal property of the Witch-Queen, and its only interests are protecting her interests. Sometimes that includes certain individuals, but only as relates to their loss removing their usefulness to Witch-Queen and thereby harming her interests.

At the same time, all treason is the same - whether that treason is leaking secrets to the enemy or knocking over a vase the Witch-Queen liked - and the punishment is death in all cases.
