KINGS AND LORDS CONVENTION



This is the thread to discuss the constitution and the Charter (Bill of Rights)! Members are encouraged to propose items for the Charter, and to voice any concerns with both documents.

I. Preamble

We, the collective nations of the region Kings and Lords, do declare this the Constitution of the region, and the highest law of the land. It is through the cooperation of all our member-states that we are able to accomplish such a document. From this moment henceforth, we establish this Constitution of the region in effect.

II. Regional Declaration

Being a member-state of this region, Kings and Lords, you do agree to abide by all tenets of this document. All aspects of the Constitution are in effect for all members of the region, as well as any extraneous entities that interact with our region-mates. By signing this document, you agree to the previous statements, and will uphold the Constitution to the best of your ability.

III. Executive Governance

This region shall be governed by a President, and this office will oversee the region, and govern it as they see fit.

IV. The Cabinet

The Cabinet shall consist of five positions, all to aid the President and Vice President in the fullest capacity that they can provide. These positions are henceforth named: The Minister of State, The Minister of Defense, The Minister of Foreign Relations, The Minister of Immigration, and The Minister of Economy.

V. Powers of the President
The Powers of the President are as follows:

1. To govern the region, as he sees fit.
2. To update the World Factbook Entry, as necessary.
3. To establish and maintain the Regional Flag
4. To host polls as needed.
5. To accept or eject members when necessary.
6. To meditate issues between region-mates.
7. To govern the Roleplay world in a OOC sense.
7a. The President will assist member-states in their Roleplay endeavours.
7b. The President will encourage the creation of iiwiki pages.
7c. The President will not, however, be the highest authority in a IC sense. This is only determined by the Roleplay scene in a IC sense.

VI. Powers of the Cabinet

The Powers of the Cabinet are as follows:
1. The Minister of State

1a. The Minister of State will be the highest Advisor to the President, giving valuable advice and information to them.
1b. The Minister of State will assist the President in regional decisions.
1c. THe Minister of State will assist the President in facilitating Roleplay projects and discussions, as well as conflicts (OOC).

2. The Minister of Defense

2a. The Minister of Defense is charged with the protection of the region, and preventing capture by the R/D kind.
2b. The Minister of Defense is also charged with compiling a list of all military forces of all nations.
2c. The Minister of Defense is also responsible for maintaining a current list of all alliances and their members.
2d. The Minister of Defense is to work jointly with the Minister of Immigration to monitor troublesome members.

3. The Minister of Foreign Affairs

3a. The Minister of Foreign Affairs will be responsible for all inter-regional contacts.
3b. The Minister of Foreign Affairs will hold the Delegate position, to represent us in the World Assembly.
3c. The Minister of Foreign Affairs is charged with proposing and establishing embassies with other regions.

4. The Minister of Immigration

4a. The Minister of Immigration is responsible for recruiting members to the region.
4b. The Minister of Immigration is to monitor troublesome members, with the eventuality of putting them up for ejection.
4c. The Minister of Immigration is also responsible for updating the member-list on the Sign-Up thread, as well as maintaining a map.

5. The Minister of Economy

5a. The Minister of Economy will monitor all trades from all nations, and keep an updated list of them.
5b. The Minister of Economy will compile a list of all economical data provided by the nations' owners. This will ensure better RP.
5c. The Minister of Economy will establish a regional Bank, and manage regional funds.


VII. Elections

1. Electing the President

1a. The President will be elected by the members of the region as a whole, with each member receiving one vote.
1b. The President shall serve a one month term, beginning when the elections are called.
1c. The sitting President shall not endorse any other candidate for any position.
1d. Members cannot vote for themselves for the Presidency.
1e. In the case of a tie, the newly-elected Cabinet shall determine the winner.

2. Electing the Cabinet

2a. The Cabinet shall be elected by the members of the region as a whole, with each member receiving one vote.
2b. Each office of the Cabinet shall serve a one month term, beginning when the elections are called.
2c. The sitting Ministers may endorse whomever they wish for any position.
2d. Members cannot vote for themselves to an office.
2e. In the case of a tie, the candidates will participate in a run-off election, taking 24 hours, or until the majority of voters have cast their ballots. This election shall be held in the form of a regional poll, to be voted on at the Regional Page.

VIII. Regional Assembly

1. All members of the region are automatically members of the Regional Assembly.
2. The Regional Assembly is the legislative branch of the government, charged with creating the laws.

Charter of Fundamental Rights and Freedoms

Nations that reside in Kings and Lords region (from here on known as the “region”) shall be afforded all rights contemplated in this article. All citizens shall have:
  1. The Right to Freedom of Residence-
    The freedom to reside in the region of and the right to not be ejected or banned without reasonable cause and due process of law.
    The right to apply for citizenship and have such an application promptly accepted, subject to requirements of citizenship, or otherwise denied under reasonable causes, with the right to an appeal to the appropriate officials.
    Any immigrants/expats have the ability to request citizenship after 2 weeks of consecutive stay. Your case will be brought into review by the cabinet or an authority created from the cabinet and the presidency. If all factors considered these members become citizens they will be granted all rights outlined in this charter, regardless of length of stay. If citizenship is denied, a longer period of stay and good behaviour may allow for appeal as explained in ‘The Right to a Fair and Equal Trial’.
  2. The Right to Freedom of Speech-
    The freedom to voice their opinions on all matter of their interest, including all forms of criticism of any other citizens, subject to reasonable restrictions established by the General Rules of Etiquette and Privacy Laws as well as any texts that violate the spirit of this constitution or any rights that a citizen may hold.
  3. The Right to a Fair, Equal, Equitable and Rightful Government-
    The right to be governed by a government put in place through a democratic election, or other means of election that the people recognize. This government consists of a cabinet of ministers and an Executive branch headed by the President and Vice-President.
    This cabinet has the right and duty to formulate, debate, review and propose any edits to existing laws and those still in the making. They will allow any member of the public to provide expertise and insight, and with careful consideration add the aforementioned expertise or insight to the bill.
    If majority is reached on a final vote, the bill passes and becomes regional law. The President has the ability to veto any law that has less than 60% of the cabinet’s support.
    The rights and duties of the elected (those holding office) are outlined and described in the charter.
    The right to be heard by this government, and responded with a debated and deliberated answer. Any concerns may be brought forth to the cabinet and presidency’s office without fear of repercussion(s), and receive answer from an elected representative in a reasonable time span.
    If the government is in any form held up, handicapped or prevented from acting it is the citizen’s foremost right and duty to act according to the laws and conditions set forth in these articles and help put in place a new democratic government capable of leading.
  4. The Right to a Fair and Equal Trial-
    Right to fair trial, presided over by a peer jury. Any trial that is presumed to be biased or having pre-prejudices towards the defendant, may be dissolved by a third party representative on the advice of the defendant. This trial and jury will take into account both the convicted story and the other party’s story.
    The right to take any other citizen to court over an issue, and have them face justice as explained in these articles.
    The right to a fair trial of entry and re-entry consisting of peer evaluation and a final verdict coming from the leadership (cabinet, president, King and Lord).
    The right to apply once for appeal and re-evaluation after the hearing, to present more arguments for entry/re-entry/innocence. The sentence and verdict will not be carried out during this stage of trial. This applies for all banned or perma-banned members, even if they still reside within the region. This appeal must be made within 24 hours of the original trial.
    A citizen or government is only allowed to bring or appeal an issue to/in court once, and the verdict reached is final. This counts for all decisions, thus a member nation may only be tried and convicted once by the rightful government, unless a new incident occurs that overrules the previous decision(s).
    In the case of the region being overrun by enemy raiders, all members previously granted citizenship will be allowed direct re-entry unless held under suspicion/contempt by the rightful government.
    The right to be presumed innocent until evidence is brought forth proving the guilt of the defendant. The verdict will take place only after proof of guilt. The verdict will be carried out immediately, however it is not final until after a minimum of 24 hours between trial and appeal trial (period that allows for appeal request). If the appeal is accepted the citizen will have full rights returned and be considered innocent.
    The right to remain silent, as anything they say can and will be used against them. However whilst the trial is in order, remaining silent will only add to the defendant’s guilt. Not responding to anything at all will result in immediate verdict and the most severe punishment for the crime.
  5. The Rights of Mobility-
    The right to move in and out of the region of Kings and Lords at their own free choice and will, without factors like blackmail and/or extortion. All citizens are free to go and leave without fear of repercussions, in any form.
    The right to request aid from other region citizens and members and expect to receive, no matter location or other transgressions. Anyone who has joined recently has the ability to request aid from the government and receive it.
Finally and furthermore, all citizens have the following duties and responsibilities. These rights and responsibilities will be interpreted and acted upon with honour, dignity, patriotism and a sound mind. These duties and responsibilities consist of the very spirit of this Charter and thus failure to follow these duties and responsibilities will follow in charges of the highest order. These duties and responsibilities are as such:
  1. 1 All citizens will abide by the constitution of the region
  2. 2 All citizens will uphold the sovereignty of the region
  3. 3 All citizens will respect the flag of the region
  4. 4 All citizens will respect the existence of other states and their spheres of influence
  5. 5 All citizens can evaluate the government, region and members critically but will avoid personal and abusive remarks as outlined in the charter aforementioned.
  6. 6 All citizens will support each other and strive to create a just and safe region
  7. 7 All citizens will strive to create region where exploitation or harassment of the weaker nations does not take place

I thought 2 would suffice - do you think the terms should be shorter, longer?

And I think Saturdays would be the best election days, since it's a weekend, people are more likely to be active on that day, and terms can begin on Sunday. Opinions?

i propose for establishment of the fundamental duties in our constitution-
1 all citizens should abide by the constitution of the region
2 all citizens should uphold the sovereignty of the region
3 all citizens should respect the flag of the region
4 all citizens should respect the existence of other states and their sphere of influence
5 all citizens can evaluate the government ,region and members critically but must compulsorily avoid personal and abusive remarks
6 all citizens should support each other and strive to create a peaceful environment in the region
7 all citizens should strive to create region where exploitation or harassement of the weaker nations does not take place

i think we should keep the elections monthly
and period for election can be from ist to 5th
if we go for weeks then it will be a rush kind of situation every time

I'm thinking that's a more charter kind of thing - it will define each member's freedoms, duties and responsibilities.
The constitution is more a government/regional/interregional thing.

Well, I'll tell you, it's forever from month to month. And if we're all used to having them two weeks apart, then we should be able to expect these elections without a problem.

for the ministry of defence we should make an army of every nation in the region and let the defence minister be its head
also defence minister can act on the accordance of the government
and resolutions relating to the defence can be bought up by the defence minister only

for the ministry of economy we should make a trade cooperation for our region consisting of all the states of the region so that we can tackle the other leading trade organisations i propose for kings and lords trade organisation headed by minister of economy or minister of commerce and also they should represent the region on trade forums
and the resolution work for trade also should be given to minister of economy and commerce
KLTO -KINGS AND LORD TRADE ORGANISTION
OR - kings and lord regional trade cooperation ( KLRTC)

Citizenship Act

This act aims create better control of citizens that fall under the provisions of the charter.
All persons applying for citizenship must have been in the region for at least 1 day.
All persons applying must not have any sort of history of betraying their region
All persons applying must be able to comprehend and have read the charter and condition
All persons applying must have no proven history of bullying
All persons applying must have no history of infringing the rights seen in the charter

If one of these applies to them, then a full court meeting with all ministers and president must be held.

We need to find a different election for the president and other elected members. If we do it based on the count of WA votes we'll merely have a WA delegate and and a president all in one... yes, it's practical, but not necessary. Instead why not make the WA delegate automatically the minister of state, they have administration of the region and be an advisor for the president all in one (without having ultimate power).

Yeah he's right, the president can't be WA delegate and President all it once! ;P Instead we have the current administration choose a leader from their midst. Ministers we then have people 'race' for (like a campaign). Like this it's more a democratic republic, but a lot fairer (< is that even a word xD).

Thanks man, I love the idea! I like the fact that we're focused on being fair and doing the right thing! However we do need to make sure that we don't have a permanent cabinet that doesn't rotate through ministers... Or we do allow this and make sure things actually get done... (which isn't democratic or fair at all, but it is efficient)... Anyways keep up the good work!

Well, i thought it would coincide well with the Minister of Foreign Affairs - since the WA delegacy is pretty much a foreign affairs type thing.

I have already given the role for minister of defence and economy and commerce are you going to consider that?
And the elections should be fair in a democratic way and for every posts the nation wants to apply and there also should be a campaign period as well and plz reply me about my recommendatios for the role of various ministeries i suggested

As for the elections, I think we should have mandatory requirements for each role, like the minister of state has to have experience in other positions to become chief advisor and the minister of foreign affairs has experience setting up embassies etc. Just an idea... but while we're on the topic, all of the 'founding fathers (or mothers)' should try and grab positions for ourselves, not like power positions just recognition for our work.
