Ratification of New Constitution

The General Assembly of the Federation of the Eight Republics has come to agreement that a new system of government must be put in place, as the current system has quickly come unraveled in the wake of both the War of Broken Shackles and the recent incidents which have been dubbed "The War of the Bleeding Republics." Several delegates have assembled from each of the Eight Republics, and have drafted a new constitution in the hopes that some stability can be restored to the region, which has historically only been held together by the strength of central personalities.

Attached are the original document, written in the national language (Reppiblieksduts, translated roughly as 'Republican German' or 'Republican Dutch,' though not fully intelligible with either German or Dutch) and translated into English.

DOCUMENT TRANSLATED INTO ENGLISH:
We, the people of the Republican land, in want for Justice and for Peace, now establish and ordain this constitution of the Sovereign Nation of Saxony, now and forever.

Section I

All powers of legislation herein granted shall be vested in a Congress of Saxony, which shall consist of a Senate and a House of Representatives.

Section II
The House of Representatives shall be composed of members chosen every second year by the populace of each respective state. No person of less than twenty five years shall become a Representative, nor any person who has not been a citizen less than ten years (or a citizen at the time of this document's ratification). A representative must, at the time of their election, be a resident of the state in which they are elected.

Representatives shall be apportioned among the states according to their residencies. For each one hundred-thousand residents, one representative district shall exist, and each state shall be guaranteed at least one representative. This apportionment shall be adjusted with each census, on every tenth year.

When a vacancy shall occur in any State, the executive authority thereof shall hold an election to fill such vacancies immediately.

The House of Representatives shall choose their speaker and other officers, and shall have the sole power of impeachment.

Section III
The senate shall be composed of two senators from each state, chosen by the populace for five years, and each senator shall have one vote.

No person of less than twenty-eight years shall be a senator, nor any person who has been a citizen less than ten years (or a citizen at the time of this document’s ratification.) A senator must, at the time of their election, be a resident of the state in which they are elected.

The Second Minister of the Republic shall be the head of the Senate. They shall have no vote unless the Senate is equally divided.

The Senate shall have the sole power to try all impeachments. When the Minister of the Republic is tried, the Minister of Justice shall preside. No person shall be convicted without the concurrence of two thirds of the members present.

Judgment in cases of impeachment shall not extend further than to remove from office and to hold any further office, but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment, and punishment, according to law.

Section IV
The Congress of Saxony shall assemble at least once in every year, and that meeting shall be on the first Monday in December, unless they shall by law appoint a different day.

Section V
Each house shall be the judge of the elections, returns, and qualifications of its own members, and a majority shall be present to do business; a smaller number may adjourn from day to day and may be authorized to compel the attendance of absent members.

Each house shall keep a log of its proceedings, and the yeas and nays of the members of each house shall be entered into the log.

Section VI
The Senators and Representatives shall have a payment for their service, to be paid out of the treasury of the Saxon Republic.

Section VII
The Congress shall have the power to:
• Collect taxes, duties, and excises, but all duties and excises shall be uniform throughout the Republic.
• Borrow money on the credit of the Republic.
• Regulate commerce with foreign nations and among states.
• To coin money and fix the standard of weights and measures.
• To establish post offices and roads.
• To constitute tribunals inferior to the Supreme Court.
• To define and punish piracies and felonies committed on the high seas, and offences against the law of nations.
• To declare war, and make rules concerning captures on land or water.
• To raise and support armies.
• To provide and maintain a navy.
• To make rules for the government and regulation of the land and naval forces.
• To provide for calling forth the militia.
• To suppress insurrections and repel invasions.

Section VIII
No money shall be drawn from the treasury unlawfully, and a regular statement of receipts and expenditures of all public money shall be published.

No title of Nobility shall be granted by the Republic, and no title of nobility shall be recognized.

Section IX
The legislative powers shall be held by a Minister of the Republic. They shall be chosen by the people at large for a term of four years.

Section I
  • The congress shall make no law with respect to the establishment of religion, or prohibiting free exercise thereof.
  • The congress shall make no law abridging the freedom of speech, of the press, or the right of the people to assemble peacefully, and to petition the government for a redress of grievances.
  • The law shall define ‘person’ and ‘people’ to include all sentient beings within its jurisdiction.

Section II
  • The right of the keeping of arms shall not be encroached.

Section III
  • No soldier shall, in peacetime, be quartered in any house, unless the homeowner’s consent is had.

Section IV
  • The right of the people to be secure in their persons, houses, papers, and ownings from unjust search and seizure shall not be encroached.
  • No warrant shall be made unless upon probable cause, supported by oaths.
  • Warrants must explicitly describe that which is to be sought/seized.

Section V
  • No person shall be made to answer for a crime unless on the indictment of a grand jury.
  • No person shall be tried two times for the same crime.
  • No possessions shall be seized for public works without just compensation.

Section VI
  • In all trials, the accused shall have the right to a timely trial.
  • In all trials, the accused shall have the right to be tried by a jury of his peers.

Section VII
  • In suits of common law, the right to a trial by a jury shall be upheld.

Section VIII
  • No cruel and deviant punishments shall be administered.
  • No person shall be made a slave, or a serf, neither by their birth or by punishment.
  • No person, which comes into the Republic, which is a slave or a serf, shall further be a slave or serf.

En representer moet, oan 't tied van hems bekesning, moet 'n eenwonner wiesen van 't staat 'n welk hie is bekoust.

Representeren zou bedeelt noar 't staaten wiesen met respect til hun befolkning. For jeder hondertuzend personen, een representersdistrict zou wiesen, en jeder staat zou garantierde wiesen mienstens een representer.

Als ’n vacanthed gebeurt in elke staat, ’t executersegezag doarvan zou ‘n bekesning heffen for te foll welken vacantheden onmiddellyk.

Het Representershus zou hun dictaater en hun ondere officieren bekous, en zou ’t eenlyksmacht van afzettning heffen.

Sektion III
Het Senaat zou van ut twee senaateren van jeder staat, bekoust by ’t befolkning for vyf joare, en jeder senaater zou een ballot heffen.

Gien person van meinder acht-en-twentig joare zou 'n senaater worden, nog gien person welk heeft net wiest 'n citizen meinder ten joare (of 'n citizen oan 't tied 'tte dokuments bestaatning). En senaater moet, oan 't tied van hems bekesning, moet 'n eenwonner wiesen van 't staat 'n welk hie is bekoust.

Het tweedeminister van ’t reppibliek zou ’t hoofman van ’t senaat wiesen. Hie zou heffe gien ballot, denzy ’t senaat is equalbedeelt.

Het senaat zou ‘t eenlyksmacht te berecht alle afzettningen heffen. Als ’t is ’t Minister van ’t Reppibliek dat is ’t defendant, ’t gezetsminister zou praesidier. Gien person zou beordeelt wiesen zonder ‘t eenvernemmen van twee-dretelen der personen inhier.

Het Saksenskongresse zou miendst eenmal verzammen in elke joare, en ’tte verzammning zou oan ’t eerste mondag in Dezember wiesen, denzy zy zou, met respect til ‘t gezetz, bestaat ‘n forskillyk dag.

Sektion V
Jeder hus zou ‘t rechter van ’t bekesningen, terugkommningen, en ’t evenheden van hun personen wiesen, en ’n merhed zou inhier wiesen for affairen te doen; ’n miendster nummer kan verzammen van dag til dag, en kan wies for te dwingen ’t verzammning van absente personen bemachted.

Jeder hus zou ’n journel houden van hun verzammningen, en ’t ”Ja” en ’t ”Nien” van ’t personen van jeder hus zou in ’t journel beschryven wiesen.

Sektion VI
Het senaateren en ‘t representeren zou ‘n betalening for hems bedieningen heffen, dat is te wies betalte van ’t Groote Bank van ’t Saksensreppibliek.

Sektion VII
Het kongresse zou ‘t macht heffen te:
  • Verzammen belastingen, tolden, axcynsen, howeel alle tolden en axcynsen zou equal wiesen in alle ‘t Reppibliek.
  • Lenen geld oan ’t Reppiblieks credit.
  • Regulen ‘t handel met utlandsnationen en tussen ’t staaten.
  • Maaken geld en festen ’t standaard gewichten en moaten.
  • Stichten posteryen en gaden.
  • Bilden tribunalen onder ’t Landsgezetzrecht
  • Bepalen en bestraffen pirateryen en felonyen begaat oan ’t hoge zieen, en fornermningen van ’t nationsgezetz.
  • Maaken oorlog en gezetz welk belang hechten oan ’t vangheden oan ’t land en ’t zee.
  • Opheffen en stunnen heeren.
  • Providen en stunnen ’n marine.
  • Maaken gezetzen for ’t overhedning van ’t heeren en ’t marinen.
  • Providen for ’t opheffning van ’t Militye
  • Onderdrukken opstanden en invasionen.

Sektion VIII
Gien geld zou beneemt wiesen ungezetzlyk, en ‘n regular journel van ontvangningen en uthandningen van alle staatlyksgeld zou wies publisiert.

Gien edelstitelen zou uthandet wiesen van ‘t Reppibliek, en gien edelstitelen zou wies erkennt.

Sektion IX
Het legislaatsmachten zou in ‘n Minister van ‘t Reppibliek behoudt. Hie zou bekoust wiesen van ‘t befolkning for ‘n tied van vier joare.

Sektion I
  • Het kongresse zou gien gezetzen maaken met respect til ‘t stichtning van ’n religie, of ’t forboadning ’t vrye verrichtning doarvan.
  • Het kongresse zou gien gezetzen maaken te beroof ’t vryhed van ’t spraak, vryhed van ’t presse, van ’t befolkning te verzammen fredlyk, en te verzoeken ’t regering for ’n rechtsmaakning van klageningen.
  • Het gezetz zou bepalen ’person’ en ’befolkning’ te envougen alle sentienteren in hun gezag.

Sektion II
  • Het recht van ‘t heffning van wapenen zou niet kraenkte wiesen.

Sektion III
  • Gien soldat zou in ‘t fredstieden wies enquartiert in enig hus, denzy ’t eenwonners instemmning wies hefft.

Sektion IV
  • Het recht van ‘t befolking te sikker wies in hun personen, husen, papelen, en eigningen van onrechtlyke zoeken en inndragen zou niet kraenkte wiesen.
  • Gien warranten zou wies maakt, denzy oan sanslyk gronden, stunnte van eiden.
  • Warranten moet beschryven dat welk is zoekt/inndragt te wies.

Sektion V
  • Gien person zou wies heft te antworden for ‘n misdoening, denzy oan ‘n beschuldning van ‘n groote jurie.
  • Gien person zou wies berechtet twee-tieden for ‘t zamme misdoening.
  • Gien eigningen zou wies inndragt for publicswarken met gien rechtlyke compensatening.

Sektion VI
  • In alle berechtningen, ‘t defendant zou heffen ‘t recht til ‘n snelle berechtning.
  • In alle berechtningen, ’t defendant zou heffen ’t recht van ’n jurie van hems gelyken.

Sektion VII
  • In berechtningen van ‘t civiliensgezetz, ‘t recht van ‘n berechtning by ‘n jurie zou wies stunnte.

Sektion VIII
  • Gien grausom en affwykendlyk bestraffning zou wies behingt.
  • Gien person zou wies maakt ’n slaaf, of ’n landslivigner, gien van hems borning nog van hems bestraffning.
  • Gien person, welk kommen in ’t Reppibliek, welk is ’n slaff of ’n landslivigner, zou verder dat wiesen.

The current draft of the Constitution looks like it just outlines the workings of the government of the Eight Republics, but it does not include anything resembling a bill of rights, or any provisions for general sapient rights really. The current draft seems sound but we strongly think that the constitution should also provide for the basic, unalienable sapient rights and thus we shall withdraw our final opinion on the draft until some kind of a bill of rights is amended into it.

We would support your new constitution, and congratulate you on your step towards stability, but that possibly amendments could be made for a broader bill of rights, perhaps by looking at the required freedoms of the IUEF, or the UN Declaration of Sapient Rights.
