What is the punishment for desertion or defection from the military?

If you have no punishment or do not have an military, I'm not interested in your answer because this is to find out the penalties for desertion. If you don't have a military you can't desert and hence your answer isn't representative nor does it give me an answer at all to my question.

Death. The empire has no use for scum.

This only applies to cases however, where Cadian High Command specifically orders that there be no retreat or surrender. At times when it can save many lives or reduce collateral damage, official orders to stand down for isolated units and pincered formations may be issued, but so far it has never have to come to that yet, thankfully.

To be specific, defectors, if caught, are hanged from the gallows or executed via firing squad, no chance for pleas. Deserters are shot on sight.

If someone deserts, he or she is tied up and stabbed to death, then buried in an unmarked grave.

The punishment for treason. Perminent exile and banning. If you try to enter Kalaspia-Shimarata, even if you are flying over in a plane but did not study the flight path, you will be arrested and suffer coperal punishment...

In Kalashi language considers light blue and dark blue to be different colours. Labour because if the can't use their muscle for war then they must still use their muscle to help the community. If they are weak then community service, if they are dangerous then highly secured imprisonment.

Deserters are given a dishonorably discharge, fined and imprisoned for 2 months.
Defectors lose citizenship, go on an enemy aliens list and have their property seized. They are killed if found.
Unlike in some nations, families are kept out of the matter entirely and simply sent a letter about it.

Anyhow,

Well, it would depend on the circumstance.

For delectation of duty, the severity of the offense would be taken into account. A solider who fell asleep on watch at a minor or low-security post may be subject to an oral or written reprimand, with repeated offenses finally resulting in time in the stockade, more than likely no more than 6 months, and a dishonorable discharge from military service. A solider guarding a high security facility would face the upper end of the punishment spectrum in fewer offenses, resulting in a lengthy jail sentence, and dishonorable discharge. For gross delectation , to wit, an action (or inaction) that endangerment the lives of others, the military reserves the right to execute the offender, generally preferring hanging or fire squad a the method, though this is uncommon. A good example of gross delectation would be the helmsmen of a naval vessel being asleep on watch, or operating the ship under the influence of alcohol or narcotics.

For desertion, again, this varies. A person terminating their government service contract before it is completed would have a warrant for their arrest issued, and would not be able to open a checking account, obtain a driver license, state ID, passport or credit card. They would have no choice but to disappear into the less-regulated neighborhoods of the nation, or turn themselves in. Punishment is generally prison time, exceeding the remaining time in the contract by a factor of 10. As an example, a person with 7 months remaining in their contract would be sentenced to 70 months, or 5 years, 10 months, in prison.

Desertion in non-combat situations is considered absence without authorized leave, and carries a penalty of jail time, and possible extra duty, service term extension, demotion and/or dishonorable discharge.

Desertion from a combat situation would result in an enlisted solider being returned to his unit if found, subject to corporal punishment, and/or incarcerated, depending on circumstance. If mass desertion is prevalent, penal units may be formed, and executions may be carried out. Officers who desert in a time of war will more than likely be executed if they are located. If not executed, the officers commission would be revoked, and he would be dishonorably discharged in addition to facing lengthy incarceration.

Edit: Misread. As for defectors, that would be considered treason, and would automatic carry the death penalty if the subject was located. However, let it be known that defectors are always welcome to return to Transnapastain when they've seen the error of their ways. We promise. no, not really, you'll be killed if you come back...fool

Desertion and defection are both covered by the section of the Uniform Code of Military Justice known as the Punitive Articles, which are Articles covering specific kinds of actions which, if committed, may result in trial before the Courts Martial.

Article 85 covers desertion.

Desertion is regarded as similar, but not alike to being AWOL, as a person charged with being AWOL is assumed to have intended to return to "military control" in time by his own accord, regardless of how long he was away.

That said, once a person has remained AWOL for more than thirty days, the Court Martial Board is allowed by UCMJ regulation to assume he was actually a deserter, meaning he actually intended to "remain away therefrom permanently." In such a case, the burden of proving that he did intend to return is upon the defendant.

Desertion may be punished in peacetime by "any punishment, other than death, which the Court Martial shall direct." In times of war, death is on the books as well.

Defection is regarded as Treason and Espionage, as covered in Article 106. Any punishment less than death is possible, unless the act of the offender(s) concerned any of the following.

1). Nuclear weapons.

2). Satellites and EW systems.

3). Defense plans.

4). Blueprints, components, etc... from classified materials.

In such a case, death is permissable.

Deserters face corporal punishment, where they are stripped naked, tarred and feathered in front of the public, and the other members of their unit are allowed to pelt the soldier with non-lethal objects (such as rotten fruit), then they are dishonorably discharged. In severe cases of desertion i.e. leaving equipment and/or tactical documents behind which could be seized by the enemy, they can face the previous punishment and then chemical castration. Deserters have all their property seized by the state and are banned from free healthcare and education, unless they have families.
Defectors are relocated to experimental facilities and are used as test subjects for chemical or biological weapons, or face experimental surgery techniques; once they have completed their testing phases, they are executed by hanging and their corpses used for cadavers or organ harvesting. However, disfigured defectors (as a result of experimentation) are executed by firing squad in a private military camp as to not shock the public over the state's scientific programs.

Any Legionary who shirks his duty has proven himself unworthy of the title of citizen and as such will have himself and any others he was serving for (usually a spouse) stripped of their citizenship.

During wartime however punishments are much more severe, deserters will be brought before a trial of his fellow legionaries and made to explain himself for his cowardice, he will be defamed as a soldier and made to brand himself with a "Coward's Mark", a person with such a mark will find it hard to gain citizenship in any Republic, even the one's which do not require military service. Extreme cowardice or mass cowardice may even warrant decimation, though Centurions are of course apt to use such punishments conservatively, lest they be called before a Senatorial Tribunal.

Defection tends not to be a problem, as few of our enemy have anything worthwhile to offer Legionaries, we are richer, more cultured, have far more beautiful women and just plain more free than any other nation we would ever have reason to fight. However a defected Legionary will be tried for treason against the Celestial Republics, for which the most severe punishment is death by gladiatorial game.

Both are considered treason and punished with death, but there are differences in enforcement.

Deserters -

In peacetime, attempts to find and kill deserters are sometimes not very motivated. There are a few reasons for this. First, the main reason for desertion in peacetime isn't cowardice. It's that there is rotating conscription which forces people into the service every few years - and the deserters would rather be out raiding. Raiding is where the money and excitement are, while sitting around the base or doing drills is boring. So most of our deserters have said fuck it and gone back to raiding.

Agents are always sent to execute them, but for the average deserter we don't use the best of our personnel. Therefore the chance of avoiding being killed are fairly high - if the deserter is sufficiently wily. The deserter is still constantly deprived of peace of mind, since an agent may come up on them at any time, anywhere - and once even a newbie agent finds his target, he is quite capable of deactivating it.

Needless to say, deserters aren't welcome to return to Victorious Decepticons, and one of the best ways for them to survive is to go far, FAR away. Like a few galaxies away. Far enough that it'd cost the government way too much Energon to finance many missions against them.

IN WAR, deserters are shot on sight with energy blasters by whoever is within range. If they escape the blaster fire, truly dedicated efforts will be made to find and kill them.

Defectors are always hunted down and killed as enemies of the state. The best agents are used to find these, and long-term escape is almost impossible. Efforts to find them will be very motivated and dedicated regardless of peace/war status.

We find that often, deserters don't want to leave the country forever. Some of them don't even want to leave the country at all. They want to leave the military, yet still have the privilege of living in the nation and using its services and resources.

Banning them is therefore a good punishment to be used by nations who don't want to kill deserters outright.

We have legislation to deal with such events:

Court Marshall Act


This Act shall outline the crimes and punishment of military personnel via Court Marshall trial.
Article 1- Grade 1 Offences
1.1) Deserting the Armed forces in favor of an allied force.
1.2) Leaving the Armed Forces without permission.
1.3) Repeated abuse of fellow servicemen and women.
1.4) The minimum penalty for these crimes is immediate discharge.

Article 2- Grade 2 Offences
2.1) Abuse of allied and enemy casualties.
2.2) The denial of human rights to any person as guaranteed by the constitution
2.3) Crimes against the state as laid down in Civilian Law.
2.4) The desertion of the Armed Forces in favor of an enemy force.
2.5) The minimum punishment for one of the above offences is dishonorable discharge and a 12 month prison sentence.

If any member of the armed forces deserts they are used as organ donors and are kept conscious during the surgeries and prevented from dying til it's no longer possible to sustain them.
These surgeries are shown to every member of the armed forces to discourage desertion...

Death.

The standard manner for execution follows.
They are captured, returned to our homeworld, imprisoned for some time until their death date; at which point, their organs are harvested while still alive, as much blood as possible is drained from their bodies and then sent to the prison incinerator.

Give us your punishment...

Kouralia checks it on a case by case basis: the minimum punishment is dishonourable discharge if it was found that the unit was in a situation where retreat was becoming the only viable way out, but they routed and ran. If it was found that through incompetence of officers they weren't ordered to fall back, no punishment as long as they remained in good order. If they just pissed off, execution. Defection is an executable offence.
