Probably not, I would actually say that it is already protected by the Constitution, we just need a judge that is willing to spend the political capital to share in that opinion...

True, but, its precisely those Amendments that I think would extend protection to them...Beyond that, the process of getting an amendment is alot more difficult than simply taking it to the Supreme Court, I mean, look at Prop 8,

last time I checked, prop 8 was supported by the Cali supreme court (rightfully so), and hasn't managed to make its way to the US supreme court, so I can see it taking just about as long as an amendment might.
