[DRAFT] Banning Doxing

The World Assembly,

Hearing of one of this digital age's newest and often most destructive misdemeanours, doxing,

Defining this doxing as when someone leaks the living address, legal or real-life name, appearance, or any other private information the victim does not want shared (in such a manner as the doxer shares it)

Defining' private information' as information not related to the online activities of the doxed,

Understanding that it can often destroy the lives of innocent video, article and other content creators or online influencers, or put them in great danger either through exposing them to violence from rogue parties, as online grudges and rivalries are common and can sometimes escalate, and also those who talk about controversial subjects often make enemies who can be intent on destroying them, or because some content creators/influencers need anonymity to protect them from an oppressive state

Understanding how the internet is in general a chaotic and sometimes toxic place which no one deserves to have unleashed on their offline lives,

Believing that doxing also violates various human rights, including the rights to privacy and anonymity, and, through the above effects, the right to feel safe

Recognizing, however, that in some cases doxing can be to the benefit of public safety,

Hereby requires that all nations part of the World Assembly must make doxing a crime and subject all those in their nations who dox others to legal consequences, of which they have a choice of either fining the doxer, mandating they spend some amount of time in a correctional facility, or some other criminal punishment that is commonly utilized in their nation, UNLESS the doxing was done to an individual who was continually perpetuating, with help from their anonymity, activities criminal in their jurisdiction of residence, the doxing was done by law enforcement authorities, and the individual's private information was only leaked to the other relevant agencies and individuals, not to the public in general

First of all, there aren't any other resolutions which ban doxing, are there? Also, does anyone know if any resolutions about privacy have been passed?

Not part of the WA, but having it phrased as a declaration
"Hereby declares that all nations part of the World Assembly must subject all those in their nations who dox others to legal consequences, which they can choose the type and severity of, and make doxing an illegal activity in their jurisdictions"
Doesn't actually require a nation to do anything - you should change the wording to "Hereby requires all nations subject to the WA... et cetera."

Just a few things:

  1. Pretty sure it is spelt ‘doxxing’?
  2. And it doesn’t really enforce anything: if nations can choose the severity of the consequences, then they can just.. ignore it by giving no punishment at all.

The thing with punishments is every nation uses different punishments, so I think it would be hard to find an appropriate one that all nations use. Will what I added suffice?

(OOC: What has been done in the past has been to mandate prohibition without specifying penalty. Because punishments do have this variance, it is impossible to fairly specify a universal sentencing guide, so it is better to just mandate member-nations to criminalise a certain conduct.)

Does 'doxxing' consist only of 'leaking' otherwise private information about a person? It was my understanding that while some incidents do involve the abuse of access to proprietary or confidential information about a person, many others involve linking an anonymous identity to already public information about a person that identifies them. If someone writes '... as the only woman in this office... ' in one post, and '... while working at the largest personal-injury firm in this city'... in another, and then 'Had a great time at the Federal City Mallards game tonight!' in a third, any observer might reasonably cross-reference those three points of data by looking at a list of specialized law firms and licensed attorneys in Federal City and identify the author. Is that doxxing?
