Nepotism in YN

Postby Pinochetist Shark Hunters » Sat Mar 18, 2023 8:59 am

nep·o·tism
/ˈnepəˌtiz(ə)m/
noun
the practice among those with power or influence of favoring relatives, friends, or associates, especially by giving them jobs.

-------------------------------
How common is this practice within your nation? Do they have any laws or regulations pertaining to its practice? Why or why not?

In Pinochetist Shark Hunters it's incredibly common. In fact, the leader Mikey Casal has appointed his husband to a high government position despite not even sharing the same ideology. He is also known to promote friends and close associates to certain positions regardless of qualifications. The main criteria he is known to follow is whether the candidate is anti-communist enough. The one exception to this rule is Alfonso Leviss, Mikey Casal's husband, who is the leader of a Hoxhaist party present in the nation (it is the only communist party legally allowed in the nation as it is run by Alfonso Leviss). Mikey Casal is also considered to be an honorary member of said party.

How common is this practice within your nation?: Very common.
Do they have any laws or regulations pertaining to its practice?: Yes it is forbidden in the public sector but not in the private sector.
Why or why not?: Because the government is mostly not responsible for the running of businesses but is obviously responsible for the public sector, to a great extent.

Uncommon and strictly illegal. The President may not appoint anyone related to him within the fourth degree of consanguinity or second of affinity as Minister or Vice Minister of State, presidential secretary, or any other appointed position; nor, of course, may anyone related as such be Vice-President. The Chief of the Armed Forces cannot be a relative of the President, Vice-President, President of Congress, or Minister of National Defense within the fourth degree of consanguinity or second of affinity. Two judges who are related to each other within the fourth degree of consanguinity or second of affinity may not serve on the same court.

It's uncommon, not necessarily illegal (sometimes it can be). But by most considered unethical and clearly unpopular.
Appointing someone, unless can you prove that your appointee is the best candidate, because consanguinity or being couple of someone closer to you would bring you at least a lot of criticism by opposition parties and press.

So most politicians avoid apoint someone that can make them have to resign.

Not only is nepotism legal but is frequent within the government. High ranking politicians can appoint anyone they personally know, including their own family, into national government positions. Politicians like governors and representatives also use this practice frequently

We do not see it often. While it isn't illegal to work in the same place, you must sign a form telling the government that, if you are a person of power, and have a relation to anyone in the same company lower down, that you are in that relation. You have to apply in the same way to give that person a raise or promotion.

Nepotism is usually illegal, especially in government, but it is still practiced very frequently, especially among the nobility.

There have been notable legal cases involving nepotism however - for example, in 2022 former Prime Minister Tamati Kahurangi was sentenced to 40 years in jail for using his influence to financially benefit members of his family (such as by giving government contracts to companies owned by family members).

Technically there's no law that strictly makes it Illegal however despite that it's highly uncommon in most public and private sectors. The only exception would be small family ran businesses in this case.

Of course Government wise it's highly frowned upon unless the family member has a credible resume

While His Philippine Majesty’s Crown Government officially values merit in its ranks, it is established practice for non-inheriting children of the nobility, a noble's inner circle, and promising commoners often groomed for leadership roles by the general elite to formally serve in the upper ranks of the government.

Where most nations value the nuclear family, the TurtleShroomian family structure instead focuses on parents and children, but also grandparents, great-grandparents, nieces, nephews, and so on. The idea of just a nuclear family is seen as bizarre. A family is a bigger thing than that, all tied by blood, and they are all supposed to look out for each other.

Nepotism is not seen as an act of corruption, but rather, an act of honor. Nepotism, the rewarding of family with appointed or employed positions, is a cultural byproduct of the promotion of deep clan and familial ties in TurtleShroom. In fact, a person who comes into wealth or power who does not use that to better the quality of life for their family is seen as dishonoring those for which he is charged with caring.

However, while nepotism as an act of appointment is encouraged, it is not permitted to oversee issues within the same family. In situations where a person who was appointed by nepotism (called a neptocrat in TS law) has to oversee a case with his family involved, he is required by law to recuse himself or face termination of employment and removal from office. In TS law, a judge cannot legally oversee, preside over, or audit any case or contract where he is related to another party. As such, if any party in the case is related to the judge as a first or second cousin, niece or nephew, aunt or uncle, parent, child, ancestor, or descendant, be it by blood or marriage, the judge must recuse.

Likewise, in the private sector, a professional auditor cannot audit the finances or records of anyone related to him, by the same definition as above.

Nepotism is not illegal in the United Realms; legislation to prohibit it has been proposed several times, but there were never enough votes to present the bills to the president and Crown. It is somewhat common in the private sector, although mainly within companies run by members of nobility. And political "dynasties" have become more common.

Nepotism is not exactly illegal in Lisander, but it's a frowned upon practice in the biggest cities and for the higher echelons of government, when there's more qualified people to public service jobs.

For the smaller cities and local governments, it's fairly common, for lack of personnel. Each city in Lisander is ran by a Commune Council that must have a minimum of eight people, so in smaller cities like Rista, Moria, Montferrand, Sunion or Aurissa, where's hard to find someone that isn't related to a Council Member at all, it's common that cousins, nephews, in-laws and friends' relatives occupy positions in public services.

Example: Marina Verdi, currently the First Councillor in the commune of Rista and a prospective candidate for Parliament, is the granddaughter of the late Martin Verdi, that was himself a Councillor and a MP. She started her career in public service as school secretary and part-time council typist ten years ago, by the age of sixteen. By the time, she was appointed by Luis da Ros, another councillor and a longtime friend of Verdi family.

The main political units of Lho Theno are the Nine Houses, a collection of nine dynastic and semi-tribal (i.e: denoting a subnational identity above mere familial relations), and all Thenoiuli (i.e: the Thenu Ieteco/blue elves of Lho Theno) are part of at least one House. The Law of General Heritability, a statute passed in the very early days of Lho Theno's existence, states that any Thenu Atali may inherit ties to both their father's and mother's House, though it is generally expected of them that they become tied to one by the time they reach a century of age (with those who don't often accused of attempting to play both sides). As the Nine Houses are, by their nature, familial, and various houses hold sway over different city districts, nepotism is expected within the City. However, given the nature of the elven work ethic, this generally takes the form of allowing family to perform more service than non-family, as service is a prerequisite for political status in Lho Theno.

None (Technically): Everyone is forced to believe the same way and work the same way, and the government always is forced to have the same beliefs, therefore creating a cultist hyper-authoritarian ideocracy instead of a Nepotist Dictatorship, as Nepotism would likely be less effective than choosing the most hyper-dedicated party members.
