The 2nd Great Tribunal of Cavirfi [DISSOLVED]

After the dissolution of the 1st Great Tribunal of Cavirfi in April 2022 in accordance to de facto conventions on the term length of the Great Tribunal, Cavirfi held exams in May to appoint the 2nd Great Tribunal. Results were published on May 21 and the opening of the 2nd Great Tribunal was originally scheduled for May 28 however due to multiple delays, that never happened.

The 2nd Great Tribunal was officially opened on June 8, 2022 and will be dissolved around April 2023 to prevent the cycle from going too far off from the original schedule.

The Great Tribunal of Cavirfi is the highest court in the Free Land of Cavirfi and is responsible for having the final say on the constitutionality of a resolution or executive order and is also responsible for holding trials for people accused of war crimes, genocide, or any other crimes against humanity.

In the Iuris Concilli method, the second method of legislation along with the Iuris Rex (rule by decree), the Great Tribunal is generally considered the first check on the Chancellor's powers, with the Technocratic Council (legislature) being the second check, and the Wolf Pack (cabinet) being the third and final check before a resolution made by the Chancellor is ascended into law.

Speaking of the Iuris Rex method, if the Great Farmer signs an Executive Order that may seem unconstitutional, the Great Tribunal is in charge of investigating and deliberating on the order to keep the Great Farmer in check. Due to the independent nature of Great Tribunal appointments, this check and balance on the head of state's power (which is de facto dictatorial) is strong and effective.

Other than that, this is the 2nd Great Tribunal of Cavirfi

The Opening Ceremony



(OOC: We will be following the old color codes from the 1st Great Tribunal)

After the appointments to the 2nd Great Tribunal were made, multiple delays took place in order to decide on a proper date to open the Great Tribunal. After days of decision-making, June 8 was decided to be the day that the Great Tribunal was to be opened. With that, the ceremony shall now begin.

A few people enter the chamber of the Great Tribunal to act as the spectators to the ceremony, while some media crew from Cavirfi One arrive to record live the event.

10 soldiers of the Cavirfite Sovereign Guard are sent to THE Barn to act as the ceremonial guard for the day, they arrive at the chamber of the Great Tribunal and surround the seats for the ceremony.

Soon enough, Great Farmer Margeaux Tortune arrives in the chamber and one of the guards proclaim.

May everyone, come and welcome, the Right Honorable, Her Excellency, and Her Sire of the White Knight Order, Margeaux Tortune.


The spectators clap.

Slowly, Tortune walks down the hall, greeting and shaking the hands of every soldier present in the ceremony.

Unlike with the First's ceremony however, she decides to simply say her greetings silently. She then heads to the main seat facing the seats of the justices and sits down.

Abbigail Roach, the Chief Justice of Cavirfi during the 1st Great Tribunal arrives.

May everyone, come and welcome, Her Honor, Chief Justice Abbigail Roach.


The spectators clap as Roach walks to the throne of the Chief Justice which she will hand over to Mayson Turner, her appointed successor.

Soon enough the appointed Justices arrive to prepare for their inauguration.

Turner enters the Chamber and is greeted with applause by the spectators as he heads to the part of the hall in the middle of the seats of the justices and the seat of the witness (which for this ceremony, the "witness" will be Tortune) as part of secretly given guidelines for inauguration ceremonies of any post-1st Great Tribunals.

The Justice of Edgebol, Corben Francis, who is reappointed to a second term arrives in the Chamber.

To the Honorable Chief Justice, the Honorable Chief Justice appointed, and the Justices of the Municipality of this Land,

It is of honor to say that we Cavirfi have made it a year into our sovereignty, considering the political instabilities of 2 of the 3 sections of the triworld in the modern era. It is really impressive how our nation has been able to function and develop within this quick timespan so with that we have proven that the Cavirfite nationstate can survive and it can survive with serving its good people and not follow the conventional route of manipulative and malicious politicking that the modern world order has based itself on since the turn of the latter half of the 20th Century.

With the 22nd year of the 21st Century now on our midst, I now assign to you a new responsibility, to preserve what progress we have made. To protect the rights of the people, to uphold human rights, the rule of law, and the goodness of our nation. Do what it is you can to prevent any forces whether it's me, the Council, yourselves, the people, the Chancellor, the military, or any being that is capable of leading this country from backsliding our liberties and bringing us back to our dark age before 2021.

I said it here last year and I will say it again. We have a Constitution, your main job is to uphold it to prevent abuse, to prevent illegality, and to keep alive the flame that warms our people.

If you swear to the rights and responsibilities assigned to you on this day and keep your promises dearly, then your appointments were not in vain.

The Rights and Responsibilities for the New Land of Love.



Preamble

We, the Wolf Pack and the new people solemnly swear to create a new land that will expand the realm of value, in a world where that kind of opportunity is continuously being rotten under the banner of "progress".

Details

The article in which the creation of this land is ratified is divided into 7 amendments and 25 articles, the amendments of this article are meant to act as sub articles pertaining to the certain rights and responsibilities of the government, the people, and the military, as well as the values that Cavirfi as a nation is built upon.


AMENDMENT I - THE CAVIRFITE VALUES

The foundation of this new nation is based on the 4 key rotting principles: Chivalry, Loyalty, Love, and Peace.

Article I - Chivalry

Chivalry, in which the medieval military orders were built on has changed over the years, as the saying goes: Chivalry Is Dead!

But with the creation of this new land, chivalry shall be revived, it's definition remodeled, and it's usage institutionalized.

Now, with the creation of Cavirfi. 17 Key Rules must be followed in order for chivalry to be valued:

1. A man must respect women, as he would respect other men.
2. A man must recognize that women, like him, are human beings. With a great sense of autonomy in thinking, sociability, and behavior.
3. A man must respect the decisions of women.
4. A man must respect other men, as he would respect women.
5. A man must recognize that other men, like him, are human beings. With a great sense of autonomy in thinking, sociability, and behavior.
6. A man must respect the decisions of other men.
7. A woman must respect men, as she would respect other women.
8. A woman must recognize that men, like her, are human beings. With a great sense of autonomy in thinking, sociability, and behavior.
9. A woman must respect the decisions of men.
10. A woman must respect other women, as she would respect men.
11. A woman must recognize that other women, like her, are human beings. With a great sense of autonomy in thinking, sociability, and behavior.
12. A woman must respect the decisions of other women.
13. A man must protect women
14. A man must protect other men
15. A women must protect men
16. A woman must protect other women.
17. Everyone shall see each other indifferently on the basis of the color of their skin, the gender they prefer most romantically, the language they speak, and lastly the gender they identify with. Everyone must see each other differently on the basis of the content of their character and must act accordingly so.

One must follow the rules of chivalry to call themselves men or women in Cavirfi, otherwise they can call themselves boys and girls instead.

Article II - Loyalty

Loyalty, be it, an essential value, crucial to diplomacy. It is the second value that Cavirfi must stand by.

For one to be worthy of calling themselves loyal they must follow 7 rules

1. One shall not betray their friends, family, and people they hold dear by accusing them of misdemeanors or felonies they never committed.
2. A man in love with a woman shall not be with another.
3. A man in love with another man shall not be with another
4. A woman in love with a man shall not be with another
5. A woman in love with another woman shall not be with another.
6. One shall not help others with the intent of reward, only to harm them (others) when such reward is failed to be presented to them (one).
7. One shall practice Chivalry while they practice Loyalty.

These rules must be followed in order for one to call themselves loyal, otherwise they can call themselves naive.

Article III - Love

Love, it is an underrated value, it moves bridges, it builds societies, it brings peace. Yet with societies that shall not be named abusing such value, no wonder they have descended into chaos.

In order for stability to remain in the new land, 4 rules.

1. One shall love his neighbor, as they would love their family, friends, and other people they hold dear.
2. One shall not hate another person as a human being, but rather one shall hate another person as a wrongdoer.
3. One shall help others in times of need, regardless of the benefits they will receive.
4. One shall practice Chivalry and Loyalty as they would practice Love.

The individual shall follow these 4 rules to call themselves a loving person, otherwise they can call themselves a poser instead.

Article IV - Peace

Peace, the fourth value, it is what builds society, without it, the average life a person would be cut short. The world and the multiverse recognizes the importance of peace.

In order for one to call themselves peaceful they must follow 4 rules

1. One shall not enter into dispute, if they are in a position where that isn't necessary. If one needs dispute to live life, they must either solve it or agree-to-disagree.
2. One in a dispute, shall solve it with words rather than fists.
3. In fact, one shall not use their fists against another, unless the other directly threatens their life. This is the right to self defense.
4. One shall practice Chivalry, Loyalty, and Love while practicing peace.

One must follow all 4 rules, to call themselves peaceful, otherwise they are in a state of neutrality.

Now that the 4 values of Cavirfi have been defined, this constution shall conclude the 1st Amendment, and begin the 2nd Amendment



Amendment II - The Rights of the State


Article V - The Rights of the Wolf Pack

The Wolf Pack shall be recognized and legitimized as the true and sole government of Cavirfi. They have powers that they can use to manage the country, the Wolf Pack shall not be recogonized as FALSE, as for this government has founded this new land, and therefore has the first Rights to use and control it.

The Rights of the Wolf Pack are as follows:

  • The Right to have total control of the land in times of crisis
  • The Right to approve or veto bills passed by the Technocratic Council and/or petitioned by the people.
  • The Right to declare Martial Law without Technocratic Council approval.
  • The Right to monitor suspicious assemblies for suspicions of terrorism and/or organized crime.
  • The Right to set up regulations without Technocratic Council Approval.
  • The Right to control government spending

These rights are permanent and can only be changed if more than three-forths of the the Technocratic Council wishes so.

Article VI - The Rights of the Great Farmer

The Great Farmer shall be recognized as the sole head of state of Cavirfi. No one can identify as head of state but the Great Farmer. Any claims otherwise are FALSE, for the Great Farmer is also the leader of the Wolf Pack, and therefore has every right to it.

The Great Farmer's position can only be appointed by the Wolf Pack and any other modes are not legitimate.

The Rights of the Great Farmer are as follows:
  • The Right to block proposals for the Technocratic Council if it contradicts their vision for what Cavirfi should be.
  • The Right to dissolve the Great Tribunal
  • The Right to appoint Juries to the Great Tribunal
  • The Right to appoint the Chancellor
  • The Right to appoint the Commander-In-Chief of the military
  • The Right to merge and create administrative divisions.

These right are permanent, and can only be changed by approval of more than 3/4 of the Technocratic Council and the approval of the Chancellor.

Article VII - The Rights of the Chancellor

The Chancellor shall be recognized as the Head of Government of Cavirfi, they shall be in charge of the ministries and domestic affairs of the nation.

The Chancellor is appointed by the Technocratic Council and approved by the Chancellor.

The Chancellor is also the leader of the Technocratic Council, therefore the position of Chancellor is also the position of House Speaker.

The rights of the Chancellor are:

  • The right to appoint and dissolve Technocratic Council members
  • The right to open and close Technocratic Council sessions
  • The right to make proposals for the Technocratic Council
  • The right to appoint the various ministers of the government
  • The right to approve and veto petitions

These rights are permanent and require the approval of more than 1/2 of the Technocratic Council and approval by the Wolf Pack for modification.

Article VIII - The Rights of the Technocratic Council

The Technocratic Council shall be recognized as the legitimate legislature of Cavirfi. As they are led by the Wolf Pack and as the Wolf Pack makes the law, the Technocratic Council shall represent them in making the laws of the land.

The Technocratic Council shall have 80 members, 10 for each municipality established in the charter code for this land. They shall be appointed by the Wolf Pack and approved by the Great Tribunal.

The rights are as follow:
  • The right to make proposals
  • The right to veto laws made by the Wolf Pack
  • The right to pass petitions on the people's behalf
  • The right to appoint and depose the Chancellor
  • The right to appoint and depose the municipal governments.

These rights are permanent and can only be changed with a decision of more than 1/2 of the approval of the Wolf Pack.

Article IX - The Rights of the Great Tribunal

The Great Tribunal shall be recognized as the highest judiciary in all of the land. As they shall review each and every law and resolution, to see if it is in accordance to this Constitution. The Great Tribunal shall not represent the Wolf Pack or the people, but the articles in which they have written.

The Great Tribunal shall have 8 members, 1 for each municipality recognized under the charter code. The Great Tribunal shall be appointed by the Wolf Pack and approved by the Minister of Justice.

The rights of the Great Tribunal are as follows:

  • The right to veto laws passed by the Great Farmer or the Wolf Pack, if they deem it unconstitutional.
  • The right to cancel depositions if they sense any bias.
  • The right to cancel Martial Law if declared during peacetimes.
  • The right to appoint the Minister of Justice (who shall be approved by the Chancellor)
  • The right to carry out penalties for crimes committed during war times. (Like genocide or killing medics)

These rights are only permanent and must be approved for modification by a unanimous decision by the Technocratic Council and more than 1/2 of the Wolf Pack.

Now that all 3 branches of the government's rights have been clarified, we declare the 2nd Amendment Legitimate.


Amendment III - The Rights of the People

The people of Cavirfi, like the state, shall have inalienable rights. That, just like the state's rights, must be respected in all due regards (see: Article I - Chivalry).

Article X - The Right to Free Speech

The people of Cavirfi shall have the right to criticize the government, as well as criticize each other's opinions, freely. Without interference from the state. For as long, as it doesn't incite violence directly against a certain group. Speech critical of certain communities and identities or speech in support of said communities and identities, shall be protected by the State.

Article XI - The Right to Free Press

The people shall have the right to report on anything they deem important, without state approval. Whether that be exposing the flaws of the state, creating propoganda for the state, or even sharing the stories of other people. Anything that doesn't infringe on the rights of others, can be reported, without interference of the state.

Article XII - The Right to Free Assembly

The people of Cavirfi shall have the right to form their own groups whether political or apolitical without government interference, for as long as it respects the values of Cavirfi.

Article XIII - The Right to Identity

The people have the right to identify with any ethnic group, political ideology, religion, sexual orientation, or gender. Without discrimination from the state in terms of benefits, punishments for crimes, or taxation rates.

Article XIV - The Right to Petition

The people shall have the inalienable right to make their own suggestions for laws of the land. In which if the movement is large enough, the Technocratic Council shall look into such proposal.

The rights of the people have been ratified and therefore concluding the 3rd Amendment


Amendment IV - The Rights of the Military

The fourth amendment shall recognize that the military and its members are individuals like the people as well. Therefore, deserving of rights and a say in how the society functions as well.

Article XV - The Right to a Coup

The military has the right to use force against the civilian government, should they feel that the State isn't obeying by both the Constitution and Cavirfi's value. Therefore, recognizing that the Military has the right to legally initiate a coup d'etat if the government is abusing their power and is on the verge of becoming what it sought to not become.

Article XVI - The Right to Conscientious Objection

A soldier, a squad, a corps, or even the whole military have the right to oppose serving in war if they reason that the goal of such a war is either against the core values of Cavirfi or forcefully pushing Cavirfi to commit war crimes (which in itself is against the core values of Cavirfi).

The Rights of the Military have been ratified, therefore concluding the fourth Amendment


Amendment V - The Duties of the State

The Government, as it has rights, also has responsibilities, responsibilities they must follow to consider themselves "Constitutional".

Article XVII - The Duty of Respecting the Constitution

The state shall recognize that, though they might have power, those powers have limits, and such limits need to be respected in order for a healthy balance between Authority and Freedom is observed.

Article XVIII - The Duty of Upholding the Law

As with great power, comes great responsibility. The state shall recognize that with their power, they must create and enforce law that act as the driver of society, otherwise it shall be recognized as Anarchy rather than Meritocracy.

Article XIX - The Duty of Respecting the Rights of the People and the Military

As with having power not upheld by the people or the military, the state shall respect the rights given to the people and the military, by this constitution.

The duties of the State have now been ratified, concluding the 5th Amendment


Amendment VI - The Duties of the People

The people, like the state, shall have duties that exist with their rights. Duties they must follow to claim a foothold in deserving their rights.

Article XX - The Duty of Paying Taxes

The people shall give the state whatever taxation it requests, no matter the rate (for so long as the State can promise a return). Refusal to do such will result in punishment (in which the form depends on the scale of the tax evasion).

Article XXI - The Duty of Obeying Law

The people shall follow whatever law or resolution in which the State enforces, refusal to do so will lead to dependable punishments.

Article XXII - The Duty of Upholding the Cavirfite Values

The people shall follow, observe, and believe in the 4 Cavirfite Values, as for they have come here, they shall follow our values.

The duties of the people have been ratified, therefore concluding the sixth Amendment


Amendment VII - The Duties of the Military

With the military having the right to initiate a coup and the right to conscientiously object. The duties they have are only fair.

Article XXIII - The Duty of Defending the Country

In times of war, the military shall have the right to refuse offensive strikes, however they must be prepared to initiate defensive strikes. Refusal will lead to punishments ranging from corporal punishment to the deposition of all officers.

Article XXIV - The Duty of Upholding the Cavirfite Values

The military shall strike against the enemy if the cause is upholding the Cavirfite Values, for which they must defend at all costs. Refusal will lead to punishments ranging from corporal punishment to the deposition of all officers.

Article XXV - The Duty of Leading the Country in times of Martial Law

The military shall be in charged of advising the Wolf Pack during times of Martial Law and Political Instability, to help the country get back to a fully-civil state. For it is their purpose to defend the land from exterior forces and defend the land from interior forces.

With the duties of the military ratified, Amendment Seven has now been concluded.


With the values of the land, the responsibilities and rights of the state, people, and military now ratified. The New Constitution shall now be concluded, and the Free Land of Cavirfi, now, a sovereign state.

Great Tribunal Case for Technocratic Council Resolution No. 1



After over a month, the Second Great Tribunal will finally have its first session after its opening on June 8. The main concern for today's session will be a proposal by the fourth member of the Technocratic Council for Ostry, Jonska Fretsburg. This proposal concerns the infrastructural policy of the Free Land of Cavirfi. The Great Tribunal will be hearing on this case as part of standard procedure for the Iuris Concilli method.

The Justices of the Great Tribunal assemble in civil fashion, they sit down on their respective benches and wait for Fretsburg to arrive. A few minutes later, Fretsburg arrives with a paper on his hand and walks to the bench facing the Justices and takes a seat there as mandated by protocol.

The Chief Justice opens the case

Good evening, ladies and gentlemen.

I am Chief Justice of the Free Land of Cavirfi, Mayson Turner; and I will be opening the first session of this Great Tribunal to set up a case to examine a proposal made by the honorable fourth member of the Technocratic Council for Ostry, Jonska Fretsburg. I will now open the session, let it begin.

We, the Technocratic Council, in cooperation with the Ministry of Economics and the Ministry of Logistics. Understanding that the electrical and public transportation infrastructure in the Free Land of Cavirfi needs improvements in order to develop better economically. Hereby create a resolution needed to commence such improvements with authority dispensed by the Government and approved by the State.

1. MANDATE the construction of 64 major subway stations that can fit up to 1000 persons at a time each, 8 for each municipality

35. MANDATE the construction of 1536 tram stops that can only be served by tram and can fit at most 25 people at a time, there shall be 24 tram stops constructed per route

36. MANDATE the construction of 64 tramway tracks that serve each route and connect the stops in such routes.

37. ORDER the purchase of 192 electric passenger-purposed locomotives, which 24 shall be used per intermunicipal route

38. ORDER the purchase of 2,304 subway trains, which 288 shall be used per municipality

39. ORDER the purchase of 3,072 trams, which 48 shall be used per tram route

40. ENLIST the employment of 35,136 employees for the electric passenger-purposed locomotives: 3 conductors that shall work in 8-hour shifts and 180 service staff that shall work in 8-hour shifts per locomotive

41. ENLIST the employment of 9,216 employees for the subway trains, 4 conductors that shall work in 6-hour shifts per train

42. ENLIST the employment of 24,576 employees for the trams, 8 conductors that shall work in 3-hour shifts per tram

43. ENLIST the employment of 96,000 maintenance crew that shall maintain the railroads servicing the intermunicipal routes, 12,000 crew per route

44. ENLIST the employment of 80,000 maintenance crew that shall maintain the railroads servicing the subway routes, 10,000 crew per municipality

47. MANDATE the construction of 10,000 Nuclear Power Plants

48. ENLIST the services of 10,000,000 people who are experienced in managing nuclear power plants to man such power plants upon completion of their construction, with 1,000 people serving in each power plant

49. PROVIDE the Lords of each municipality to determine the contract of every employee enlisted within their jurisdiction by this resolution after their initial contracts which lasts for 1 year each as provided by this resolution expires

50. MANDATE that construction time for the infrastructure listed from Rules 1 to 32 and in Rule 47 be finished within 100 days

51. MANDATE that construction time for the infrastructure listed from Rules 33 to 36 be finished within 10 days

52. MANDATE that delivery time for the vehicles purchased from Rules 37 to 39 be within 10 days

53. SET the price to ride an Intermunicipal Train Route at NS$10 per station

54. SET the price to ride Subway Train Routes at NS$1 per station

Contracts -

The Federal Government shall prescribe the initial contracts of any worker who voluntarily participates to enlist in the undertaking of this project.

1. Construction workers who participate in the project itself shall be paid NS$93,672.41 for their services, their contracts shall last for the duration of the construction of the infrastructure mandated in this resolution

2. Intermunicipal route employees (maintenance employees included) shall be paid NS$231,536 for their services as per the initial contracts, their initial contracts shall last for 1 year. After which, they must be renewed by the Lord of the municipality in which they signed for the job in.

3. Subway employees (maintenance employees included) shall be paid NS$151,704.02 for their services as per the initial contracts, their initial contracts shall last for 1 year. After which, they must be renewed by the Lord of the municipality in which they signed for the job in.

4. Tramway employees (maintenance employees included) shall be paid NS$93,672.41 for their services as per the initial contracts, their initial contracts shall last for 1 year. After which, they must be renewed by the Lord of the municipality in which they signed for the job in.

5. Nuclear Power Plant employees shall be paid NS$231,536 for their services as per the initial contracts, their initial contracts shall last for 1 year. After which, they must be renewed by the Lord of the municipality in which they signed for the job in.

The salaries listed in these contracts are exempt from income taxation to avoid redundancy.


We understand that the expenses needed to set the budget for the execution of this resolution shall amount to NS$ 20'805'402'158'727'317. Which shall be spent immediately upon the approval of the Wolf Pack and the signature of the Great Farmer

So, this resolution was authored by me around late June. This was written prior to the storm so I was not able to put into account the regulations that came after so this may or may not help my case. But nevertheless, this if the Wolf Pack and Great Farmer chooses to approve such a resolution will be the second session of a project that was first commenced around September last year. That original project was initiated as an Executive Order as part of response to mild protests during the half-anniversary celebration and it only included police stations, fire stations, hospitals, schools, and bus infrastructure. Now such a project was expensive for the time, the Central Bank didn't have that much money prior. But now, the Central Bank has a lot of money. I would argue too much money that isn't being spent on the welfare of the nation. For that, I believe considering we still have money left to spare from the storm regulations. I think it would be good if the State decided to give out one more infrastructural investment in service to the nation. Because almost every developed nation on Earth has trains, almost every developed nation on earth has trams, and almost every developed nation on earth can afford to provide a power surplus for their people. We are a developed nation economically, we have an HDI of 88/100 or somewhere around the 0.900 region on the World One scale but our infrastructure is still that of a middle-income economy like South Africa or Brazil or Mexico. Thus, it would be inconvenient for us to have all that money in the Central Bank yet still feel like we can't get anywhere across this country fast or our rent is still proportionately high due to power costs. We still have about 30 quadrillion dollars, so I'm hoping that spending 20 quadrillion won't do much to the Central Bank after all, we still won't go into debt for that and we certainly won't go bankrupt over this. So this is why I considered making this proposal. Calculations were made by the Honorable Minister Albert so please consider that.

Other than that, I have nothing else to explain regarding my proposal. Please consider what I have said, thank you.

This is gonna be a quick trial I see. So anyways, I will go with what opinions have been given. Personally, I think you also understand and respect well the procedure of the legislature and the judiciary. So much saw that you seemed to be going through this process legally. The other justices decide to give out a Constitutional verdict to Fretsburg as the proposal violated none of the articles listed in the Constitution.

Yesterday, the Great Tribunal rules in a 5-3 decision that any ideology no matter how extreme cannot be made illegal in Cavirfi under Article 10 of the Constitution protecting free speech. However speech that directly incites violence against people groups will remain illegal and punishment remains enforceable under federal law.

Meanwhile the Great Tribunal decides to actively challenge the Great Farmer's executive order regarding the withdrawal from the World Assembly which was signed just this afternoon on the basis of a certain resolution that the Great Farmer deemed unconstitutional was extremely likely to pass the General Assembly. The Justices meet in an emergency meeting ordered by Chief Justice, Mayson Turner, the Justices decide to debate the legality of the withdrawal.

Justices in support of the executive order state that the Great Farmer was the sole person who authorized the entry of Cavirfi into the World Assembly and thus she has every right to withdraw when she wants to. The supporting side reinforces their argument stating that the Great Farmer is required by Article 17 of the Constitution to respect the Constitution and do everything that she can to protect it.

Justices against the executive order state that the Great Farmer does not have authority to singlehandedly sign Cavirfi's withdrawal from the World Assembly and that by signing the Constitution days after entry into the World Assembly, the Great Farmer had voluntarilly vested her powers in constitutional (albeit undemocratic) mechanics rather than single-person autocratic rule. They also argue that the resolution that she stated was the reason for Cavirfi's withdrawal can be enforced in Cavirfi without violating the pro-NiceGuy Constitution by simply putting up safeguard laws that protect Cavirfite citizens from false accusations rather than overrelying on the World Assembly to address Cavirfi's individual concerns as a member state.

The Justices in support of the executive order rebutt this argument by stating that these "safeguard laws" would in essence be interpreted as bypassing the WA Resolution and thus a violation of WA Law but the Justices in opposition rebutt that the WA in the end is a rather ineffective institution that tends to not enforce its laws, so withdrawing for a resolution that one doesn't like is quite an overreaction.

The debate continues and the Great Tribunal decides to hold the final verdict

By a verdict of 6-2, the Great Tribunal declares that the Executive Order is Constitutional and the withdrawal of Cavirfi from the World Assembly is official.

After a week of negotiations between a law firm and the Great Tribunal, the Great Tribunal announces that they will be hearing a case between Maria Fretsburg and the Federal Government titled "Cavirfi v. Fretsburg" regarding the torture issue.

The Great Tribunal opens the first session of the "Cavirfi v. Fretsburg" trial, Maria Fretsburg and her lawyer, Isabelle Alexis are the plaintiffs and the defendants are the Federal Government represented by the following line of succession (this line of succession is for when the previous ranking official cannot attend court):

1. Margeaux Tortune, Great Farmer
2. Suzanne Mackenzie, Minister of Defense
3. Muskaan Tilman, Minister of Government

Currently Mackenzie is representing the Federal Government as Tortune holds a cabinet meeting on the other side of THE Barn's roundabout.

The first session of the trial lasted for 1 hour from 5:30 PM to 6:30 PM and mainly covered the evidence that plaintiffs Fretsburg and Alexis believe prove the illegality of the torturing of the 154 Class C OPLA Perpetrators detained at the military prison, Gutensland Fort Detention Center Golf. Fretsburg claims that the main reason why the torture is illegal is that; especially in regards to the incident where former Education Minister of Civetia, Isidros Miller; was hosed with sewage water over committing the crime of "apartheid". That the crime of apartheid was:

1. Not a law, it is written in Code 2020 XIV which is a Cavirfite ethical code, not a law.

2. Even if Code 2020 XIV is law. The Crime of Apartheid must be punished by death, not by torture. Fretsburg makes the claim that because an erroneous punishment was given, that the treatment and torture of the Class C prisoners is thus illegal under the principle that applying "Unus pro omnibus, omnes pro uno" to the prisoners thus entitle them to both the rights and the consequences of being tried under the conditions of the legal designation as mandated by the Citia Treaty's conventions on justice. In other words, if it's illegal to torture one of the Class C Prisoners, it is illegal to torture all Class C prisoners. To not give the prisoners the rights entitled to them as part of their legal conditions would be a violation of the Citia Treaty.

Fretsburg and Alexis also argue that:

3. The persona non iura order handed out by the Great Farmer is illegal because nowhere in the Constitution does it state that the Great Farmer has the right to declare either Cavirfite or foreign prisoners such statuses. Alexis in particular states that the Great Farmer is violating Article 9 of the Constitution by witholding the Great Tribunal's right to "carry out penalties for crimes committed during war times."

Alexis states that torture violates this section of Article 9 by deliberately postponing the trial of the Class C prisoners through unnecessary remand (pre-trial detention). Alexis further defends her position by stating that remand within the Jurisdiction of the Municipality of Barnumberg (where the prison is located) while not having a limit on the number of days one must be remanded, still prohibits the use of torture for any reason as per Municipality of Barnumberg Regional Executive Order 2021 LXXVIII. Thus by permitting torture within the territorial bounds of the Municipality of Barnumberg de jure, the Federal Government has violated regional law and thus overstepped its central authority.


Mackenzie defends the Federal Government with these following defenses:

1. Cavirfite ethical codes while not having the power of law de jure still acts as basis from which actual law is created upon and promulgated, to say that the Crime of Apartheid does not exist in Cavirfi because it is merely written in a code rather than a law would thus undermine the overall legal security of the Cavirfite State because if legal or extralegal action and/or retaliation is invalidated simply because it is ordered by code, then the very existence of all Cavirfite laws which in themselves are ordered by code are thus invalid, making Cavirfi a lawless society and thus violating Article 18 of the Constitution which demands that some form of law exist in the Free Land of Cavirfi.

2. Cavirfi is not a signatory of the Citia Treaty and is only a member of the World Congress by special statute granting permission for Cavirfi to ascend to the WC without having to obey the Citia Treaty. Thus to say that the act by which Cavirfi has done to make the specific torture of ex-minister Miller illegal does not simply exist within the bounds of Cavirfite law or any international law by which the Cavirfite state currently abides.

3. Saying that torturing Isidros Miller is illegal because the punishment prescribed to him by law (that is Code 2020 XIV which Mackenzie states is law under Federal Directive) is not the one that he is being currently given (his de jure punishment should be death, his de facto punishment is torture) would thus make literally every other form of death row in any country in any part of the world illegal. To back this up, Miller has not yet been tried by the Great Tribunal and is thus under remand making him not yet a convicted violator of Code 2020 XIV but rather a pre-trial detainee thus any punishments given to him in jail is not erroneous under Code 2020 XIV because he has not yet been convicted of violating Code 2020 XIV.

4. The jurisdiction of the Municipality of Barnumberg does not de jure apply to any prisons or territories of the Free Land of Cavirfi directly controlled by the Cavirfite Sovereign Guard (the military) as the Sovereign Guard is under federal control and thus the federal government is thus in control of the prisons thus granting the federal government the right to override Barnumberg regional law within their prisons, as the prisons are not even technically a part of Barnumberg, they're owned directly by the Free Land of Cavirfi. Making the federal law of the Free Land of Cavirfi in regards to pre-trial detention legal and not an override of regional authority. Further more, in regards to federal protocol on remand, no proscription of torture exists and definitely no limit on the number of days one can be remanded is put into place. In other words, the Great Farmer is not violating Article 9 by witholding trial "unnecessarily" because there's no limit into how long a "necessary" witholding of the trial can take place.


Alexis makes two objections to Mackenzie's defense:

1. Yes, Cavirfite law does draw from code, however code and law exists in different realms legally and thus to state that somehow all Cavirfite law loses legitimacy because their inspirations from a different realm of jurisdiction (that is no jurisdiction at all since Cavirfite ethical codes do not hold any real legal value as the Great Farmer signed them before the Constitution was enacted) do not really hold as stated any real legal value is absurd. Next, Code 2020 XIV may be a code that can be turned into law when necessary however the fact that no law exists within the archive of the Ministry of Government or the Ministry of Justice that bases itself off of Code 2020 XIV thus makes any usage of it in actual enforcement both illegal and simply baseless.

2. Since Cavirfi is not a signatory of the Citia Treaty and since there's no law in Cavirfi that permits the doctrine of "Unus pro omnibus, omnes pro uno", to use this doctrine is illegal and the Great Farmer has no formal authority to just make up and use the doctrine on the spot for a one-off detention of 154 people. One could argue that the Great Farmer has the authority to declare these prisoners as such since she made the doctrine on the spot through an executive order however executive orders are not laws constitutionally and the fact of the matter is, while the torture issue is primarily moral it is also a legal issue and if this case rules that the Great Farmer's probable fabrication of a legal doctrine without prior consultation of the Technocratic Council or the Chancellor is somehow okay, is to put it mildly, too much power for a court to grant the head of state. In short, there exists no such thing as an "Unus pro omnibus, omnes pro uno" doctrine in Cavirfite law and allowing the Great Farmer to just make it up without prior consultation essentially delegitimizes the entirety of the Cavirifte Constitution. Might as well abolish it and grant the Great Farmer absolute rule altogether.


The session continues for a while until the justices close it for tomorrow, by a strike of a gavel, the first session of "Cavirfi v. Fretsburg" is now over.

The second session will be held tomorrow: December 3, 2022 (Saturday).

From 5:00 PM to 11:00 PM of Wednesday (December 7, 2022), the Great Tribunal holds the fifth session of the "Cavirfi v. Fretsburg" trial. Maria Fretsburg and her lawyer, Isabelle Alexis are the plaintiffs. While Margeaux Tortune, who is the head of state of Cavirfi is representing the Federal Government who are the defendants.

This session mainly covered the legality of the extradition of the 154 Class C OPLA perpetrators from Crabaiaia to Cavirfi. Alexis claims that because the (legally) alleged crimes were committed in Crabaiaia and was committed against other Crabaiaian citizens thus making the extradition to Cavirfi illegal. However, Tortune objects to Alexis's statement stating that since the genocide was primarily against NiceGuys that the NiceGuy people have a special right to try the criminals in any country that has an extradition agreement with Crabaiaia. Alexis objects, stating that the NiceGuy people are not internationally recognized as a people group and is not even de jure recognized as a people group under both Crabaiaian AND Cavirfite law (for context, they are only de facto recognized). Alexis backs this stating that even if the victims of the genocide were a legally recognized people group, that doesn't entitle them to any special rights to try their oppressors in any country aside from Crabaiaia itself especially if that other country has a more authoritarian penal system than Crabaiaia (i.e: Cavirfi).

The session continues on for six hours until the Chief Justice adjourns the session for tomorrow. By a strike of a gavel, the fifth session of "Cavirfi v. Fretsburg" is now over.

The sixth session will be held tomorrow: December 8, 2022 (Thursday)

From 12:30 PM to 7:30 PM of Thursday (December 15, 2022), the Great Tribunal held the twelfth session of the "Cavirfi v. Fretsburg" trial. Overall, no point of interest has been made in this session and the court was adjourned after 7 hour of meeting for Friday, December 16.
