Public Endangered Species Table

A resolution to increase the quality of the world's environment, at the expense of industry.

Whereas a public database of endangered species would;

  1. Promote awareness regarding endangered organisms whose endangerment would otherwise be overlooked, in turn encouraging conservation action;

  3. Aid further research regarding endangered organisms, in turn further facilitating conservation thereof;

And whereas past World Assembly law tasks the WAESC with creating a variety of documentation and assessments regarding species and subspecies and endangerment thereof, but does not mandate that these assessments or lists be public or include other information relevant to conservation but not necessarily threats to survival, nor does it fully prevent or ban member states from purposefully concealing evidence of species endangerment or the extent thereof;

And whereas a separate resolution to do so and complement past conservation-related law would help to ensure that extinction can be mitigated as much as possible;

Now, therefore, as given due consideration and thereby decided by World Assembly Delegations and Ambassadors of member states united from across this grand both natural and artificial realm, and with the authority and assent of the same, the following shall hereby be enacted as binding World Assembly law by this most excellent chamber.

  1. Database. The Endangered Species Database Institution (ESDI) shall be formed as a subcommittee of the WA Endangered Species Committee and shall carry out the following tasks to the best of its ability;

    1. Compiling and regularly updating a database, known as the Public Endangered Species Table and hereinafter referred to as the 'Table', of all extant and recently extinct species, subspecies, and populations, and all data substantially relevant to past, current, or potential future conservation efforts thereof, including but not limited to natural habitat, diet, threats to survival, predators, genetic details, likelihood of extinction or endangerment, location, and sightings, based on objective information of clear demonstrableness from research, reports, or other evidence practically available to and publicly documented by the ESDI.
    2. Publishing the Table in full and in a manner that maximises the breadth and ease of public access.
    3. Using funds from the WA General Fund to complete tasks assigned to the ESDI in this resolution if necessary to do so.
  2. Investigations. The ESDI may conduct investigations to find new data that would significantly aid in updating the Table within member or consenting non-member states.

    1. Each member state where such an investigation is occurring must, to the best of its ability and in good faith, comply with all requests for information in regard to that investigation by the ESDI, except for such requests for information whose accessing, provision, or publication is demonstrably substantially likely to compromise national security or individual privacy.
    2. ESDI access for such an investigation may only be denied to areas within a member state to which access is restricted for all national residents without specific authorisation for protection of national security or public health or safety, or that area's status as private property, a quarantined area, or a vulnerable culturally or environmentally significant site, by that member state or an entity therein in charge of preventing unauthorised access to that area, unless the ESDI can clearly demonstrate that such access is to the minimal extent necessary to achieve the aim of that investigation. If the ESDI does enter such an area, it shall take sufficient precautions to duly minimise risk to national security, public health or safety, or damage to that private property or culturally or environmentally significant site.
    3. No member state or entity therein may wilfully otherwise obstruct the due course of any such investigation, via action or lack thereof.
  3. Provision of information. Member states must, to the best of their ability and in good faith, provide the ESDI with all research and factual data respectively published or discovered within their jurisdiction that they have practical access to, has not already been received by the ESDI, and is substantially relevant to any past, present, or future conservation efforts, unless the accessing, provision, or publication of that information is demonstrably substantially likely to compromise national security or individual privacy.
  4. Protection of sensitive information. Notwithstanding other mandates of this resolution, the ESDI shall not place in the Table, make public, or otherwise distribute any information in a manner that is substantially likely to compromise national security or individual privacy, nor shall the ESDI place in the Table raw intellectual property outside of mere fact.

Compiling and regularly updating a database, known as the Public Endangered Species Table, of all extant and recently extinct species, subspecies, and populations, and all data substantially relevant to past, current, or potential future conservation efforts thereof, including but not limited to natural habitat, diet, threats to survival, predators, genetic details, likelihood of extinction or endangerment, location, and sightings, based on objective information of reasonable accuracy and demonstrableness from research, reports, or other evidence practically available to and publicly documented by the WAESC.

Each member state where a 2.e investigation is occuring must, to the best of its ability, at the lowest possible cost, and in good faith, provide ESDI investigators investigating in that investigation with all information with regard to that investigation requested by those investigators. No member state may knowingly otherwise obstruct any such investigation, via action or lack thereof.
  4. Provision of information. Member states must, to the best of their ability, at the lowest possible cost, and in good faith, provide the ESDI with all research and new evidence published or discovered within their jurisdiction that has not already been received by the ESDI and is substantially relevant to any past, present, or future conservation efforts.
  5. Censorship. Notwithstanding other mandates of this resolution;

    1. No member state may provide information to the ESDI that clearly cannot be provided without violating individual privacy.
    2. The ESDI shall not place information in the Table that, if published in the context of the Table, would clearly compromise national security.

A cost for access may only be imposed by the Database Institution if it is the lowest cost necessary with 2.c funding to cover the cost of maintenance, creation, publication, and distribution of the Table, and 2.d investigations, and must be administered in a manner that is the least burdensome on public access necessary to cover such costs.
      3. Access may only be restricted if the accessor fails to provide the required cost compliant with 1.a(ii), if providing such access would compromise the privacy of individuals or the security of a nation (in which case only access to the sections where providing access would compromise such privacy or security may be restricted), or if the Database Institution can clearly demonstrate that said access is in bad faith.
    2. Reviewing research, reports, or other evidence provided to the Database Institution, and updating the Table with information from the same relevant to the Table meeting reasonable standards of accuracy;

Opposed to Article 2a(ii) as written. Access to fundamental scientific information such as the PEST, especially information held by a WA committee, ought to be available at no charge.

There is no reason why the name of the committee created in Article 2 should be abbreviated as "Database Institution" rather than - say - "ESDI."

'Charge is removed. Acronym is changed to 'ESDI'.'

OOC: As I said on discord, the charge mandate was there because information used to make the Table is likely to be patented, but I suppose the WAGF can fund it instead and people who access it to violate patents can be prosecuted anyway.

Patents govern inventions; copyrights govern things that are published. Second, you cannot copyright facts. Third, IP law is meant to enjoin people from using or reproducing that IP without permission. "People" in that phrase does not include the sovereign. And it is a huge stretch to say that mere receipt is infringement.

Why do you agree with Makko Oko that fraudulent, non-WA funding is undesirable for the ESDI?

Why do member states have to actively cooperate with ESDI investigations, which can occur without their agreement? This reeks an awful lot of the proposed amendments to the International Health Regulations that would allow the WHO Director-General to declare a health emergency in any country at any time for any reason without that country's consent. I am becoming increasingly opposed for the same reason I opposed GA#566.

Member states have to actively cooperate with investigations because not cooperating with investigations would make them more difficult and prevent the Table from being a reliable public source of information in regard to endangered organisms. This does not allow the ESDI (or WAESC) to declare an environmental emergency for no reason. Investigations may only occur if 'in [the ESDI's] view, there exists substantial evidence that substantial information substantially relevant to any past, present, or future, conservation efforts is likely to be discovered by such an investigation'. Moreover, mere gathering of evidence is not an environmental emergency. All member states are required to do is cooperate with investigations, not immediately start making conservation efforts if the ESDI does an investigation.'

This does NOT authorise violation of privacy or national security. Information that violates that and finds its way into the Table will NEVER be made public because 2a.ii requires the ESDI to 'suppress public access to sections of the Table that would compromise individual privacy or national security if public access is provided to'.'

Dr Justin Obama, Deputy Minister of Foreign Affairs: Is there a reason the thing is abbreviated as PEST? And I think there should be a provision to encourage people to use it, otherwise this would be an even bigger waste of time and money
