Judicious Use of Surveillance Tools In Counterterrorism Efforts Act of 2007

A BILL
To amend the PATRIOT Act and Foreign Intelligence Surveillance Act to limit surveillance powers to suspected terrorists, and protect the rights of American citizens.

SECTION 1: SHORT TITLE

This Act may be cited as the “Judicious Use of Surveillance Tools In Counterterrorism Efforts Act” or the "JUSTICE Act".

SECTION 2: PATRIOT ACT AMENDMENTS

a. Amends the PATRIOT Act to curtail the domestic surveillance powers of federal law enforcement and intelligence agencies. This legislation limits the scope of investigation of, and access to the communications, financial records, credit records, medical records, and library records of suspected terrorists or suspected spies.

b. Federal law enforcement and intelligence agencies must prove that library records and medical records belonging to American citizens are related to suspected terror or espionage activities.

SECTION 3: FISA AMENDMENTS

a. Amends the Foreign Intelligence Surveillance Act, or FISA, to (1) impose limits on roving electronic surveillance and the use of pen registers and trap and trace devices (defined as devices for recording incoming and outgoing telephone numbers); (2) enacts provisions barring immunity to telecommunication providers for illegal disclosure of subscriber records; (3) prohibit the warrantless collection of certain communications of U.S. citizens known to reside in the United States; and (5) revise certain reporting and evidentiary requirements;

b. Amends FISA to require that the government limit the collection of phone calls, emails, and text messages to suspected terrorists, spies, or those suspected of intentionally providing material aid to terrorist organizations. Any materials collected without a warrant can only be listened to, used, or distributed if the government can demonstrate that they have reason to believe that the collected communications relate to terrorism or espionage. Federal law enforcement and intelligence agencies are required to list the name(s) of the person(s) and place(s) that they require to be tapped

SECTION 4: EXCEPTIONS FOR NATIONAL SECURITY EMERGENCIES

Federal law enforcement and intelligence agencies will be permitted to continue secret searches targeting U.S. citizens only in emergency or urgent circumstances against suspected terrorists, those suspected of intentionally providing material and/or monetary support to terrorists, terrorist organizations, or to further acts of terrorism.

SECTION 5: ENACTMENT

The JUSTICE Act will be enacted with full force of law one (1) year after passage. The United States Government and its relevant agencies are expected to make the necessary changes to federal policy in order to be in compliance with the JUSTICE Act by the date of enactment.
