LGBTQIA+ Rights in YN

Postby Seppen » Mon Nov 29, 2021 2:56 pm

As you can see by my flag, LGBTQIA+ issues are really importnat in my Nation, so I was wondering what kind of rights do LGBTQIA+ people have in YN? Here are some questions:
1) Are same-sex relationships legal?
2)Are same-sex unions recognised? (If yes, by civil unions or marriage?)
3)What kind of parental rights (adoption, surrogacy, etc...) are there?
4)Is it legal to change your gender? (If yes, does it requires sterilization?)
5)Is there any form of neutral or third gender?
6)Are there any anti-discrimination laws concerning sexual/romantic orientation?
7)Are there any anti-discrimination laws concerning gender identity?
8]Are there any anti-discrimination laws concerning gender expression?
9)Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech?
10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression?

I would like to thank all those who have already replied, and thank in advance all those who will be replying later on.

And here are my answers:
1) Are same-sex relationships legal? Yes, always been.
2)Are same-sex unions recognised? (If yes, by civil unions or marriage?) Yes, by both. Civil unions are legal for heterosexual couple too and are different from marriage, so each couple can choose what institution access.
3)What kind of parental rights (adoption, surrogacy, etc...) are there? Adoption both conjoint, stepchild, and single parents; IVF (donor is anonymous); surrogacy is legal only if altruistic and there are other several harsh restrictions. All this options are available to heterosexual couples too.
4)Is it legal to change your gender? (If yes, does it requires sterilization?) Yes. Sterilization is not required, but hormonal and psychological therapy is.
5)Is there any form of neutral or third gender? There is "neutral gender" legal option for intersexual people only, pending decision for other people. All public structures must have gender-neutral restrooms. All clothes in shops are considered unisex.
6)Are there any anti-discrimination laws concerning sexual/romantic orientation? Yes, in all sectors of society.
7)Are there any anti-discrimination laws concerning gender identity? Yes, with some exceptions. Sports: Transgender athletes must have hormonal levels equivalent to their cisgender colleagues of their selected category. Employment in the artistic sector is exempt too.
8]Are there any anti-discrimination laws concerning gender expression? See answer #7 above.
9)Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech? Most illegal, but there are exceptions for art and satire. Also the law is enforced only if the victim (or someone in their stead) press charge.
10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression? Yes, and it's compulsory for all students.

1) Are same-sex relationships legal?
No.

2)Are same-sex unions recognised? (If yes, by civil unions or marriage?)
No.

3)What kind of parental rights (adoption, surrogacy, etc...) are there?
Surrogacy is allowed regardless of sexual orientation as long as they are a native (or assimilated) French citizen, adoption is a bit unclear as the government can't decide if there should be a law prohibiting LGBTQ people from adopting, but it is looked down upon and adoption centres frequently refuse such people from adopting a child.

4)Is it legal to change your gender? (If yes, does it requires sterilization?)
No.

5)Is there any form of neutral or third gender?
No.

6)Are there any anti-discrimination laws concerning sexual/romantic orientation?
No.

7)Are there any anti-discrimination laws concerning gender identity?
No.

8]Are there any anti-discrimination laws concerning gender expression?
Nope.

9)Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech?
Against people who are openly LGBTQ, there is no law preventing hate speech. However, if the LGBTQ person is either closeted or "places their identity as a citizen of the Fatherland above their sexual and gender identity" then hate speech directed towards them is treated as insulting your fellow countryman, which could lead to either a fine or a 3 year prison sentence plus social ostracisation.

10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression?
Yes, although such concepts are taught to be products of liberal degeneracy and divide a nation because of such petty things to be proud of.
Alternate timeline where the French Republic does an oopsie and gets booted out of the mainland to be replaced by the semi-fascist nation of the French Popular State.

still figuring out what all the buttons at the top of this do

4. Is it legal to change your gender? (If yes, does it requires sterilization?) Yes, however all gender changes require sterilization.

8. Are there any anti-discrimination laws concerning gender expression? Yes

1) Are same-sex relationships legal? Yes, given that sodomy laws and prosecution of homosexual romantic behavior in public were ruled unconstitutional as (in the case of the former) a violation of privacy rights, and the latter, free speech
2) Are same-sex unions recognised? most states have defense of marriage laws in effect. A resolution passed in Congress in 2000, 2014, and 2019 urging these laws to stay in effect. Some states have made provision for gay civil unions.
3) What kind of parental rights (adoption, surrogacy, etc...) are there? Adoption is only permitted to MF couples who are married, or singles in most locales. In some places, a parent’s same sex partner can become a legal guardian with attestation of the other parent.
4) Is it legal to change your gender? No, and there is no legal structure by which someone can change their legal gender, which by law is tied to biological sex.
5) Is there any form of neutral or third gender? Confederal law is silent on this. Some semi-autonomous tribes recognize Two-Spirit identification.
6) Are there any anti-discrimination laws concerning sexual/romantic orientation? Yes, in some localities and states housing and employment discrimination are prohibited
7) Are there any anti-discrimination laws concerning gender identity? none at the state or confederal level. One city has an ordinance prohibiting housing discrimination against transsexuals, but that’s it.
8) Are there any anti-discrimination laws concerning gender expression? No. That would be a violation of free speech.
9) Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech?it is protected by the Constitutional guarantee of freedom of speech
10) Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression? Yes, it touches upon it but emphasizes the optimality of heterosexuality, natural marriage, and the importance of gender being in conformity with biological sex, so yeah.

1) Are same-sex relationships legal? No

2)Are same-sex unions recognized? No

3)What kind of parental rights (adoption, surrogacy, etc...) are there? There are none

4)Is it legal to change your gender? It is illegal based on scientific facts showing that there are truly only two genders/sexes, there have been cases where a person is born with a p*nis (idk what the rules are for those words on the site) and a vag*na but only one can function as a reproducing organ, for a person cannot impregnate themselves.

5)Is there any form of neutral or third gender? Nope

6)Are there any anti-discrimination laws concerning sexual/romantic orientation? No, because same-sex marriage is outlawed there are no anti-discrimination laws

7)Are there any anti-discrimination laws concerning gender identity? No

8]Are there any anti-discrimination laws concerning gender expression? No

9)Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech? It falls under freedom of speech, if a person does not like what they are hearing they are encouraged to walk away, this applies to any situation unless such speech is determined to be illegal

10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression? It does not, it covers the reproductive system and functions, the two sexes, reproductive safety, etc.

10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression? Schools teach, though in more detail and care, that "Marriage between a man and a woman is the healthy and ideal framework of sexual activity both for themselves and for society, but that a number of complex factors can often lead good people who are merely hurting into falling short of that healthy, ideal framework in a variety of ways, including both heterosexual promiscuity and homosexual activity. Furthermore, People are overwhelmingly born clearly male or female, and in rare cases of external ambiguity their biological sex can be determined by further examination. Some people reach what really are factually incorrect conclusions about their nature, including that an internal knowledge about a true gender identity in conflict with the body can be known and is the truest form of their self, but such people do not deserve hate or bullying either."

1) Are same-sex relationships legal? Yes.

2)Are same-sex unions recognised? (If yes, by civil unions or marriage?) Yes, civil unions (known in Gandoor as same-sex partnerships) were recognized in 1975. In 1988, same-sex partnerships were phased out following the legalization of same-sex marriage that year. All same-sex couples who were entered into a same-sex partnership between 1975 and 1988 (and have not gotten formally married) are still registered as being in one, but it is considered to be equivalent to marriage in all-but name nowadays.

3)What kind of parental rights (adoption, surrogacy, etc...) are there? LGBT+ individuals have been allowed to adopt children since 1977, an LGBT+ individual has been allowed to adopt their partner's biological child (stepchild adoption) since 1977, and LGBT+ couples have been allowed to jointly adopt a child since 1979. All couples and individuals, regardless of their sexual orientation, have been allowed to adopt a child born via a surrogate mother since 1990.

4)Is it legal to change your gender? (If yes, does it requires sterilization?) Yes, transgender individuals have been able to change their legal gender since 1958. The law requiring that transgender individuals be sterilized before they could legally change their gender was repealed in 1994, following the passage of laws prohibiting discrimination on the basis of gender identity.

5)Is there any form of neutral or third gender? Several of the indigenous peoples of Gandoor recognize the existence of a third gender. Since 2017, the Democratic Republic has recognized an 'other' category for gender, which is considered to encompass all gender identities outside of the male/female binary.

6)Are there any anti-discrimination laws concerning sexual/romantic orientation? Yes, discrimination on the basis of sexual orientation has been prohibited since 1967 (this law is considered to encompass romantic orientation).

7)Are there any anti-discrimination laws concerning gender identity? Yes, discrimination on the basis of gender identity has been prohibited since 1993.

8]Are there any anti-discrimination laws concerning gender expression? Not officially, but the above law prohibiting gender identity discrimination is considered to encompass gender expression as well.

9)Is hate speech on LGBTQIA+ identities illegal, or does it fall under the freedom of speech? The government does not criminalize mocking or insulting speech against any group, only speech which calls for violence, either explicit or implicit, against a protected class or group (which LGBT+ people do fall under).

10)Does sex education in YN cover sexual/romantic orientation, gender identity and gender expression? Yes, it has been part of the national curriculum standards since the late 1990s.
