ICDN Court (ICDN Members Only)

Postby Imperium Germaniae » Thu Feb 25, 2021 12:20 pm

"This has been established as a separate place for trials to avoid distractions from the General Assembly. The Prosecution Team of Siegfried Kopf, Jason Tavington, Richard Schwarzwald, and Angelica van Dyne is now bringing charges of War Crimes to the following:
Danny Morrison
Chiang Wei-kuo
Alwyn Wolfaardt
Nicolaas Fourie
Jacobus Stephanus Uys
Tsai Ing-wen
Choy So-yuk
Kurt Chew-Een Lee
Mary Robinson
Roger Thress
Mark Mellett
Eugene Terre Blanche
Lee Teng-hui
Michael D. Higgins
We now ask the defendants how they plead? (OOC: Taiwanese SW Africa and UASA since you guys brought them up and they are from your country you can represent them)."
A world where Germany took a democratic path after winning the Great War. This does not represent my political views and is simply a simulation of a nation.

Danny Morrison pleads guilty and then reveals more crimes after the Yamikaner Genocide , like the 2014 anti-British riots in which AWB members killed those who had British Ancestry

Mark Mellett pleads innocence and said he was acting out on orders during the Yamikaner Genocide , to the dismay to the Survivors of the Yamikaner Genocide who agreed to testify against them (Pieter Ikeda Akiko Nakamura , Johannes Hirano , Albrecht Kurosawa , and Michiko van Houten)

To Mellett, Schwarzwald probes further. “Assuming that you were acting on orders, what orders specifically were handed down to you, and is there any documentation or other evidence to prove that these orders came from above your position?”

(1. Just posting here so this doesn’t get brushed under the rug. Taiwanese South Africa should probably answer the Dalmanian lawyer.

2. Isn’t Hopal sending a few lawyers of their own?)

He tells the court he Had no choice because Chiang Ching-Kuo threatened to kill his family if he did

Danny Morrison meanwhile said , "I am now more convinced than ever that the genocide was a terrible mistake that blighted our land. and went on to testify against Mellett showing them that even the AWB were horrified by their actions and Terreblanche who died a week ago was recorded persuading Chiang Ching Kuo to leave them alone since they were civilians.

Schwarzwald considers this new evidence, and halts his prosecution for the time being, turning it over to either Kopf, van Dyne or Tavington. A recess is called for this period as the transition of prosecutors is organized, so another lawyer can take his or her turn. Other defendants and their lawyers are permitted a period of time to decide whether or not they plead innocence on the same basis as Mellett has; the basis of having been given orders by a higher authority to commit war crimes and humanitarian atrocities.

The Dalmannian attorneys Schwarzwald and van Dyne are in agreement that having orders is no excuse for committing atrocities. Even under military command, individuals have the free will to choose whether or not they act on their conscience.

Poniscowski asks about Morrison, if they think that he should be sentenced to less because he pleaded guilty and revealed more information of and about the atrocities committed.

“We are of the belief that any and all perpetrators deserve a minimum of 10 years imprisonment. Whether Morrison should qualify for this minimum or some greater sentence is yet to be determined.”
