While I am pro-gay rights, I don't think your argument is necessarily the best. Many things are criminalized for which there isn't really a logical or rational argument for the criminalization of. For example: incest, even in cases where the involved individuals have no prior knowledge of each other, is illegal in most Western countries, for reasons that basically amount to the public thinking it's gross.

The definition of "mental illness" is much less scientific than one would think and is nebulous enough that, in some cultures, you could probably classify some LGBT stuff as it (because it inhibits functioning within those cultures), though within the context of the contemporary Western world, it's not and you could potentially even make a greater argument for including homophobia as a form of mental illness within our own societies (though I think that's a can of worms that shouldn't be opened).
