The General Assembly:
Acknowledging the clear will of this august body to prohibit the death penalty in civilian contexts, as provided by GA#535: Death Penalty Ban,
Concerned that the aforementioned legislation does not explicitly prohibit member nations from deporting residents to countries where they might be executed, which through abuse or malfeasance could cause the wrongful death of a civilian;
Hereby:
1. Prohibits member nations from deporting any person to a country where they face reasonable threat of facing capital punishment, as adjudicated by means consistent with World Assembly law;
2. Prohibits extradition of a civilian to any nation which permits capital punishment, if that person faces criminal indictment or has been found guilty of a crime in the pertinent nation.
OOC: The purpose of this bill is to simply avoid the pitfalls of a number of present proposals while covering an essential case in criminal law, preventing deportation and extradition likely to lead to the death penalty. Being rather new to working in the WA, please inform me if I need to modify anything for relevance or legality.
