So, we're doing this again. The newest Puritan ploy out there under the guise of removing porn but really censoring the internet for corporate interest is named SIESA. As helpfully displayed by this nice lady on Twitter, we're just not talking like real porn and such. If you get your jollies drawing some good lewdness, happen to run an art site that allows NSFW stuff and so on and so forth, they're gunning for you too.

I know these anti-porn bills come along a lot, but I'm always fearful one is gonna finally win. Especially with how prudish the internet is being forced to be, ala what happened on Tumblr.

And yes, some of you are probably laughing at me getting riled up over them going after porn. But it's also just blatant censorship of free expression.

So, I pass it over to y'all. What do you think of all this?

Exactly. I mean politicians are some of the most morally bankrupt people in America, and they think that can pass bills trying to enforce standards they themselves don't follow. It's complete hypocrisy.

I've always tended to view porn the same way I view alcohol, and a total prohibition of the former, something existing within the Internet, would probably be less successful than the one tried against the latter.

See, that's just incorrect. Demonizing sexuality is never okay. I'm online friends with plenty of people who draw NSFW art, and I can tell you they're all very friendly and normal people. The fact politicians want to portray people who enjoy it/draw it/etc as these morally deviant weirdos is completely wrong.

While regulations, as in any industry, will be difficult to implement and will lead to additional expenses, a lot of these are long overdue and some of the costs can be passed off onto large corporate monopolies such as MindGeek. Given the political bent and occupational concerns of your source, I had to scour the internet for another source that elucidated precisely what SISEA would do and impose, without focusing solely on how it would negatively impact sex workers and the sex industry.

The motivation for authoring the bill wasn't prudishness. Rather, it's intended to protect people from revenge porn, illegal hacking, and the uploading of pornographic content without the explicit consent of those who appear in the videos or images concerned. I cannot discuss the other benefits due to the ill-conceived moratorium that we still have in place, but, when moderation decides that we should treat the issue concerned in the same way we treat transphobia or extreme racism, we can discuss the benefits of why we shouldn't empower sexual predators as well.

In all seriousness, given the lax standards in the pornographic industry, this bill is long overdue, regardless of the costs to large corporate monopolies such as MindGeek. The principal impact on sex workers will be that they have to fill out additional forms. The impact on those who want to access pornography will be that they can't access material that depicts people who haven't or cannot consent or pirated material. Which should be a universal standard anyway.

The bill isn't a ban on porn. It's a ban on porn that depicts people who haven't given informed consent to appearing in publicly accessible pornographic content and a set of regulations that puts the onus on a massive corporate monopoly to ensure that it's upheld.

The biggest monopolist is Mindgeek (the company behind Pornhub) and they have been hit badly by MasterCard and Visa cancelling them, and which alongside the NYTimes articles, led to them deleting millions of videos and very likely destroying their business model. It was big on the news. I am surprised it didn got a thread or hasnt been mentioned here.

Ironically I was always thinking their end would come by class lawsuit for systematical DMCA violations. Guess they have dodged that bullet to take another.

Yes, but bills are never used for just what the base intention is. And everyone knows it. Would cracking down on revenge porn and the like be good? Yes, very. Is that where they'd stop? Not a chance. You give them an inch, they take a mile with this stuff.

The bill doesn't ban pornography though. It simply requires some verification of identity and consent, which, given how MindGeek and the sex industry in general operate, is necessary to prevent a lot of the abuses that people who support the sex industry claim to want to prevent. As per my source...

Require any user uploading a video to the platform verify their identity.

Require any user uploading a video to the platform also upload a signed consent form from every individual appearing in the video.

Creates a private right of action against an uploader who uploads a pornographic image without the consent of an individual featured in the image.

Require platforms hosting pornography include a notice or banner on the website instructing how an individual can request removal of a video if an individual has not consented to it being uploaded on the platform.

Prohibit video downloads from these platforms, to be in place within three months of enactment of this legislation.

Require platforms hosting pornography offer a 24-hour hotline staffed by the platform. Individuals who contact the hotline can request removal of a video that has been distributed without their consent.

Require removal of flagged videos as quickly as possible, but not to exceed two hours.

Require platforms to use software to block a video from being reuploaded after its removal.

The platforms must have this software in place within six months of enactment of this legislation.

Directs the Federal Trade Commission to enforce violations of these requirements.

Creates a database of individuals that have indicated they do not consent. The database must be checked against before new content can be uploaded to the platforms.

Instructs the Department of Justice to promulgate rules on where this database should be housed, and determine how to connect these victims with services, to include counseling and casework.

Failure to comply with this requirement will result in a civil penalty to the platform, with proceeds going towards victims services.


Most of this seems more than fair.
