[IC/OPEN] The Day of Verdict: Presidential Massacre Case

At the early hours of the morning, a detachment of more than two battalions of police were deployed at Camp Andres Nazancieno in Medalle, Katherinia as the promulgation of judgement for the most-awaited Presidential Massacre Case will be handed down by Presiding Judge Cecilia de Guzman of the Katherinia Regional Trial Court Branch 137.

That was recorded as the worst presidential security failure, worst political massacre, massive rubout of uniformed personnel and worst killing of journalists. The whole world will be watching the most awaited verdict which will be one of the most historical and landmark events in Pekweng, ending almost 20 years of waiting. This will set the tone to the whole Pekwengnian government, justice system and democracy.

The policemen, wearing anti-riot gear, stationed at the area, some remained in the facade while others went to their posts inside the camp. Before reaching the courtroom, they must board a vehicle for a 15-minute ride from the facade to the main vicinity, with strict security checks in between. The guards gave their salutes to the police as they pass by the vicinity. The whole of the country is placed on full heightened alert status, given the gravity and solemnity of the event.

Next, the journalists from local and international media who were accredited to cover the promulgation went to the camp together with their teams, accompanied by police escort. Then, they were stationed at the reporter's quarters, which is a few meters apart from the courtroom. Before they entered the room, a tight check by the guards are done to ensure that the rules regarding the live coverage pursuant to the order of the Supreme Court are followed. A representative of the Supreme Court is monitoring the flow of the media who entered the room and after all of the journalists went into their places, the representative reiterated the circular again to the members of the media. He also advised them to take down important notes of the proceedings.

The relatives of the victims started to arrive at the camp and was thorougly check by the police. They were escorted to the lounge behind the rails of the courtroom designated for them and advised to keep silent for the whole proceedings or else face direct contempt of court which entails imprisonment and fine.

The food was served for the relatives and the journalists as they prepare to watch the promulgation.

Afterwards, the accused entered the camp accompanied by jail guards, wearing their jail uniforms. They were tigthly monitored by the guards and every one of them was checked when they disembarked the vehicles. They were escorted to the courtroom, with handcuffs in place and seated according to order. The principal accused seated at the front while the secondary accused took their seats at the back.

Interviews with the relatives started as they themselves wanted to speak on the event. A minor commotion happened since the court representative admonished the journalists not to entertain interviews from anyone without the knowledge of the court, but the families of the victims wished to speak, which the representative forced to agree. Every relative made their chance to speak out their sentiments in the awaiting judgement. All of them expect the conviction of the accused.

Lawyers from both the prosecution and defense parties arrived at the courtroom. Some arrived with briefcases full of papers and some went with only a small bag. They were the loudest among the courtroom, chatting with other lawyers and others talking with their clients.

The convoy of Presiding Judge Cecilia de Guzman went to the camp vicinity, signalling the commencement of the promlgation. She was escorted with a lot of police bodyguards because of her involvement as the judge of the most high-profile case.

She wore a simple black dress, reminiscent of the emotion of the day, and proceeded to the judge's quarters behind the courtroom. All of those present rose as her arrival was announced. Before the session was about to start, she requested to eat for a while and take a personal reflection. The guards agreed and immediately gave her food and left outside to guard the courtroom.

"All please rise. Katherinia RTC Branch 137 is now in session, Honorable Judge Cecilia de Guzman presiding. Silence is hereby enjoined," the court sheriff announced the arrival of the judge. All of those present rose in respect. She banged the gavel and made the signal to take their places.

"Any matters on hand?," the judge asked.

"Your Honor, called for today's session is the promulgation of judgement in Criminal Cases Nos. K-23964-26842, People v. Katigbak, et al.

"Isa-isa pong tatawagin yung mga akusado, mangyari lamang pong tumayo kapag tinawag ang pangalan." (Each accused shall be called one by one. If the name is called, please rise.) The court sheriff admonished the accused.

The prosecution started entering themselves.

After all the appearances, four men carrying loads of papers arrived and placed it on top of the judge's table as well as the clerk's table.

"Before we proceed with the promulgation of judgement, I just want to inform you that the whole decision consists of almost 3,000 pages. If we will read it whole, we will not finish it the whole day."

Every one in the room was surprised in the announcement because of the many pages of the judgement.

"May I ask if the parties will be amenable to read only the salient portions of the case?," the judge asked the counsels.

Then, the lawyers talked to each other to make an agreement. A loud whisper told them to read only the dispositive portion, which the majority of them said yes.

"Your Honor, may I?" The Solicitor General presented himself to the judge, which the latter acknowledged.

"Your Honor, in behalf of the prosecution panel, we agree to read only the dispositive portion of the decision. As you have said that it consist of more than 3,000 pages, we submit to that recommendation."

"So, you decided to read only the dispositive (portion)?"

"Yes, Your Honor," the Solicitor General answered.

"Your Honor, in behalf of the defense, we submit to the motion of the prosecution to read only the dispositive part of the verdict," Atty. Giduma stood for the defense.

"Noted."

"Ok, let's start with the promulgation of judgement. Madam Interpreter, kindly read the dispositive portion of the decision." The judge signalled the clerk to read the judgment of the court.

"Please read it slowly."

"Yes, Your Honor," the clerk replied.

4. Likewise, pursuant to the Communist Surrenderee Reintegration Law, accused Fabian Mallari @ Punong Fabi and Alvin Masicat @ Kumander Vin are hereby acquitted, since their surrender to the government automatically extinguishes their liability;

Accordingly, the Jail Warden of Katherinia City Jail is hereby ordered to immediately release the aforementioned accused unless they are being detained for some other lawful cause or causes;

7. The filing fees shall constitute a first lien on the judgment pursuant to par. 3 of Section 1, Rule 111 of the Rules of Court and reiterated in OCA Circular No. 58-2019 dated March 25, 2019.

When the judgement of conviction against Katigbak was announced, there were applause as they rejoiced in the verdict. But there were some disappoinment when many of the accused were acquitted because there was no sufficient evidence against them.

"Order in the court," the judge reminded the people to keep silent as she banged her gavel four times.

Then, the lawyers responded by making motions to the court.

"Your Honor, Solicitor General Cabanada. May I ask if the court wishes to furnish copies of the said decision?" The state's lawyer asked.

"Based on the internal rules of procedure in this promulgation, the physical papers containing the full text of the decision shall only be for the perusal of the Supreme Court and this Court only because of the printing of papers. The cost of printing was estimated at around 4,500 Crons inclusive of the printing repairs since there are two printers that were damage due to the print load. Counsels and parties will be given the electronic file of the decision which will be sent to the emails of the lawyers."

"Thank you, Your Honor."

"Your Honor, Atty. Guillen for the KBP. May I ask if the media will be given copies of the decision?"

"As per order of the Supreme Court, the journalists will be given a syllabus of the judgement so that they can report on the promulgation easily. It only consists of at around 30 pages, I think. Those will be distributed later."

"Thank you, Your Honor."

"Your Honor, counsel for accused Katigbak. We will file the appropriate motion within 15 days."

"That's noted."

"Your Honor, counsel for the Elitista Group along with counsels for the Arancel and Galvan Groups, we will file the appropriate motions within 15 days."

The judge then said a series of announcements for the court.

"As the copies of the decision are concerned, the electronic copies will be also sent to the Office of the President, the National Law Center, and the Official Gazette for publication."

"With regards to the suspects that are still at large, let the outstanding warrants of arrest be issued against them. Court Sheriff, please direct the warrants to the PNP."

"Will comply, Your Honor," the sheriff answered.

"The letter made by Advocates for Free Activism to the Court sent on July 25, 2020 is considered moot and academic. The said Advocates are hereby adjudged guilty of contempt of court due to casting aspersions and ill motives against the court. No bail recommended."

"Motion reiterated to furnish all parties and persons concerned copies of the decision."

The judge rose and banged the gavel. "This court is adjourned."

"All stood up and a few moments later, applause broke up.

Lawyers shook hand with each other and greeted congratulations to others.

The accused who were acquitted were happy and some were emotional. Jail guards uncuffed those handcuffs of those who were not guilty, and their families are embracing them.

Those who were convicted were escorted to the jail bus together with the guards.

The journalists were gathered outside the courtroom for an interview with Renato Mallari, the grandson of President Diosdado Mallari. He spoke about his reaction to the verdict.

Ngayon po, ang hustisya ay suminag na sa bayang ito. Ang nararapat na hatol ng panahon ay naihain na, ang sinumang nagnanais na pabagsakin ang ating bansa ay mananagot sa mamamayan. Sa ating Konstitusyon, ang tunay na pamahalaan ay nasa mamamayan mismo nito. Sa hatol na ito, walang puwang ang komunismo dito sa Pekweng.

Naniniwala ako na ang hatol na ito ay tanda lamang na buhay ang demokrasya sa bansa at mananaig pa rin ang katarungan. Lubos ang kaligayahan namin dahil mababayaran na ang napakalaking kasalanan ng bansa, ang magtangkang pabagsakin ang gobyerno. Maging aral nawa ang hatol na ito na hindi-hindi pwedeng pabagsakin ang gobyerno dahil pinababagsak na rin nito mismo ang mga mamamayan.

(Today, justice has shone in this country. The right judgement is now served and whoever tries to revolt against the nation will be accountable to the people. In our Constitution, the true sovereignty lies in the citizens itself. In this verdict, communism has no place here in Pekweng.

I believe that this decision is a sign that democracy continues to live and justice will always prevail. Our joy is full because those who tried to bring the country down will now pay a hefty price to the nation. This decision serves as a reminder to us that the country cannot be put down, because if it succeeded, the people will also fall.)

Solicitor General Joseph Cabanada also made a statement on the verdict in behalf of the prosecution team.

"We have witnessed today the triumph of the rule of law in Pekweng. The perpetrators of the most henious crime agains the nation have been sentenced by the people. This verdict shows to the Pekwengnian people and to the whole world that justice must and always prevail and that those men wishing evil to society will be held accountable."

After the interviews from the media, a crowd outside the camp rejoiced the decision and sang the National Anthem. When the relatives of the victims came out of the camp, they were greeted with balloons, hugs, and confetti by the crowd waiting. Those relatives became emotional and thank them for their support.

When they were celebrating, the convoy of those convicted started to drove past the camp and sent to the National Penitentiary.

STATEMENT OF MANRIQUE PALACE ON THE PROMULGATION OF JUDGEMENT ON THE PEKWENGNIAN PRESIDENTIAL MASSACRE CASE


The Manrique Palace welcomes the decision made by Presiding Judge Cecilia de Guzman of Katherinia Regional Trial Court Branch 137 on the almost two-decade long Pekwengnian Presidential Massacre Case where the President was brutally killed on January 7, 2002 by the members of the Communist Party of Pekweng, together with other officials of the government, as wells as uniformed personnel and journalists. The court has spoke and rendered its judgment based on rightful evidence. Most of them were convincted, while some of them were absolved of their liabilities.

The Chief Executive, as a defender of justice, believes that this verdict will mark a very important milestone in the justice system of the Honorable Commonwealth, that true democracy, justice, and the rule of law still prevail despite the ongoing challenges and obstacles that might bring the country to ruins.

As a nation, the President invites every Pekwengnian to stand together for justice and freedom that we cherish. As the Preamble of our Fundamental Law provides that we are in pursuit to "build a just and humane society" and a respect for "truth, justice, freedom, love, equality, and peace."
