Supporting People with Disabilities

The World Assembly,

Noting the importance of accessible infrastructure - particularly in the spheres of health, education, and communications - in allowing people with disabilities to effectively exercise their rights,

Concerned that, in addition to ableism, many people with disabilities regularly face discrimination and disadvantage on other grounds (such as race, sex, age, and - for most - low income), and

Recognising that - while legislation alone cannot serve to completely eradicate discrimination - an internationally recognized disability code to remedy the social disadvantages of people with disabilities and promote their equal participation in all spheres of life would be of at least some benefit in achieving that goal:

  1. Defines “people with disabilities” to be those that have a physical or mental impairment which, within their own, their guardian’s, or their doctor’s jurisdiction, has a detrimental or consequential effect on their capabilities to execute day-to-day activities;
  2. Requires member states to:
    1. Ensure that people with disabilities, within their jurisdiction, can conveniently access assistive technologies, housing programs, and mental health support services, relevant to their disability;
    2. Provide, in law and in practice, that no qualified applicants for any job receive worse terms and conditions, incentives, or allowances in their employment due to being disabled;
    3. Guarantee, to all people with disabilities, the right to all available, and relevant details regarding their personal medical condition; granted it is within their doctor’s capacity to provide such information;
    4. Refrain from the detainment, whether in medical facilities or otherwise, of people with disabilities, excluding the legitimate punishment of crimes and where it can be proven that the disabled person is a danger to others;
  3. Encourages member states to:
    1. Establish systems of special education for those with visual, hearing, or intellectual disabilities;
    2. Uphold a positive and inclusive stance on disability, particularly in mainstream media, schools, and workplaces;
    3. Utilise and conduct research to allow products and facilities to be used by anyone without the need for significant reworks and modifications; and
  4. Reaffirms the right to not be discriminated on the grounds of disability.

Noting that disabilities are mental or physical abnormalities that restrict a person's movements or senses and are caused by genetics, harmful environments, individual lifestyles, or other unknown causes,

Believing that all people should be guaranteed equal benefit and protection to the law and be free of discrimination,

Recognizing the fact that the majority of persons with disabilities live in poverty, which makes it critical to address the negative impact poverty has persons with disabilities,

Fully aware the importance of accessibility to the social environment, to health and education, and to information and communication, which would enable persons with disabilities to enjoy their human rights and fundamental freedoms,

Concerned about the challenging conditions faced by persons with disabilities who are subject to several forms of discrimination on the basis of disability and race, color, sex, religion, age, or other status,

Seeking to create a comprehensive international convention to remedy the social disadvantages of persons with disabilities and promote their participation in civil, political, economic, social and cultural spheres with equal opportunities,

Defines "universally designed" as the design of products to be usable by anyone without needing certain adaptations, requirements, or specialized design.

Desirous of reaching a fair compromise regarding the issue, requires that all member nations of the World Assembly:

(1) Take all appropriate measures to modify existing regulations, customs, or practices that constitute discrimination against persons with disabilities;

(2) Take all appropriate measures to eliminate all forms of discrimination on the basis of disability;

(3) Undertake research on universally designed products and infrastructure, which meet the needs of of any persons with disabilities and implement them to the furthest reasonable extent;

(4) Recognize that all persons with disabilities, granted this has been declared by a medically certified individual, are entitled to meticulous details and information pertaining to their condition;

(5) Ensure that all persons with disabilities have access to assistive technologies, housing programs, and service or emotional support services.

(8) Declares that member states must provide financial assistance to the economically marginalized deserving disabled students who seek to pursue post secondary or tertiary education;

(9) Declares that all persons with disabilities are entitled to meticulous details and information pertaining to their condition; and

(10) Declares that all qualified disabled people are subject to the same terms and conditions, privileges, incentives, and allowances as a qualified able-bodied person.

    6. provide appropriate financial assistance to all economically-marginalized students with disabilities who genuinely seek to pursue tertiary education;
  2. Encourages member states to effectively undertake and implement research into products (including infrastructure) that can be used by anybody, without the need for special adaptations; and

Operative and preamble clauses are muddled up. I suggest all non binding clauses to be put in front, then add all your important clauses.

  2. Encourages member states to effectively undertake and implement research into products (including infrastructure) that can be used by anybody, without the need for special adaptations; and
  3. Affirms that a person with a disability is one who has been declared so by a medically certified individual.

Clause 1c to me reads as if even if you’re disability makes you unable to do your job, you can’t be fired because of that. So if there was a factory worker who suffered a car accident and became a vegetable, they can collect wages forever. I think this could be fixed. (I could be wrong though.)

How’s this:
guarantee, to all people with disabilities, the right to know the meticulous details pertaining to their disability that a medically certified individual does;

Clause 1c states that a qualified PWD should be subject to the same terms as a qualified able-bodied person. If it’s too unclear for others, I’ll try to revise it soon.

Minor suggestion primarily for aestethic reasons =p: in Article 1d, remove "the meticulous [...]" and replace with "whatever meticulous [...]"

Somewhat less minor, but still not very important, suggestion: In Article 1a, replace "modifying" with "modifying or annulling".

Overall this is worded well and presents a great resolution to helping better the lives of persons with disabilities and allows for more access on their part. The only thing I would do is try to specify a bit more on rule 1a. This rule is very important but as it is worded at this current moment could lead to a various amount of loop holes. It states that for instance buildings should be more accessible but does not state in what way allowing for building owners to possibly work around this rule act. I would try to allow for some leeway/grey area but also specifically state how some things should change.

I'm sorry, but I'm not sure I understand. Clause 1a states that we must take action against discrimination on the basis of disability by putting an end to or regulating certain practices and laws that constitute discrimination. If you're talking about the first preambulatory clause, I don't think it needs that sort of revision, since it's not meant to be stating certain obligations/requirements. Instead, it states the importance of inclusive infrastructure in the spheres of health, education, and communications. Please tell me if I'm just not understanding what you're trying to help me with.

Schools for the deaf are covered by GA#493 as well. That is an entire resolution; between that and your strucken-out text, is one clause in a broader resolution about disability sufficient/necessary RE schools for the blind?

Alright, so I haven't thought about that, I just went ahead and removed it. But now that I am thinking about it, I don't believe my one clause necessarily negates an entire resolution, but I don't see the harm in removing it if somebody else plans to submit soon.
