Flag Burning in YN

Postby Drongonia » Tue Jul 07, 2020 5:44 am

This thread has one very simple question. Is the act of burning the national flag illegal in your nation? If it is, what kind of punishments are there for it?

This was inspired by the recent flag burning in at a BLM protest in Australia. Upon doing some research I found out that flag burning is not illegal in Australia, but it is in New Zealand as well as other parts of the world.

To get us going, defacement of the Flag of Drongonia was made illegal today in a law passed by a very slim majority. You can click the link to view my news article in the NS News thread.

We do not have an official flag or set of national symbols. However, setting fire to an unnofficial symbol, such as the flag you see here, will likely be interpreted as an act of dissent, and those who do it will be detained and forcibly re-educated in line with the state ideology.

Since flags are more associated with national governments than with the people they govern, it's not illegal to burn the national flag to show disapproval of the course of the current government, as this move is not considered anti-Arcadian. We believe that, when possible, it's better to treat an actual cause of dissent, rather than a mere symptom. Besides, punishing people for relatively peaceful dissent would lead to an outrage, which would cause even more dissent. Surely it might be slightly disrespectful, but it's not a misdemeanor either! (unless other property is affected by the fire)

However, it's an entirely different story for active military personnel. Only worn-out flags can be burned, and the burning must adhere to the Flag Retirement Protocol. The same protocol allows to bury a flag in a special box or to recycle it whenever it's hazardous to burn it. If the compass emblem is alright, it may be cut out.

TL;DR: considered slightly disrespectful, but not illegal for civilians.

The act of burning the flag is not illegal in and of itself, but in certain contexts it could constitute a breach of the peace. In general, though, flag desecration is not considered a big deal by most people, as little importance is placed on the national flag.

Perfectly legal and held as protected speech.

Associate Justice Adam Lee wrote:It is well within the right of every Visayan citizen to express his or her opinions as he or she sees fit, so long as these expressions do not directly threaten the rights of others. To set fire to a flag is a sign that one expresses great contempt for any one particular country over grievances that have yet to be redressed; denying people the right to express their spite for such unaddressed grievances is one step closer to denying that said grievances exist.

In accordance with the principle of free speech guaranteed by the Charter of the Free Land, flag burning is perfectly legitimate expression of dissent within Anurial and cannot be restricted. However, the political system aims to promote consensus and co-operation, meaning this isn't really an issue regardless.

Legal, and protected by the constitution, becaus econsidered an exercise of freedom of expression. This way of manufestation is used in Alinghi (non do frequent, but you can see an alingan flag burning in some manifestation), and is not considering by the population a sign of "hating Alinghi", but a act to manifest dissent of a thing that in their opinion doesn't going well in the Confederation.

Flag bruning is a renouncement of the royal family, which is fine, but it is also a declaration against the empire, which is therefor treason.

Burning or desecrating the flag of Montevento is completely legal as long as the flag is privately own and for personal usage. However, the destruction, removal, intentional improper handling or desecration of national emblems (i.e. the National Flag, the Emblem of the Dogeship, provincial flags or the Coat of Arms) installed by a public authority is punishable by a monetary fine or imprisonment of up to five years.

In addition, all citizens of the Republic are required to swear loyalty to the National Flag at least once in life, thing that is usually performed during Independence Day at every educational institute of the country.

There is nothing legally preventing individuals from destroying their own property. However, if the person steals the flag from someone else or the government, it becomes a theft and vandalism charge. Depending on the situation it also may fall under the category of disturbing the peace.

So not illegal outright, except in certain circumstances.

Federal law prohibits the burning and desecration of all national and federal symbols. The flag is a national and federal symbol and thus it is illegal to burn the flag. The minimum penalty for burning the flag is 5 years in federal prison.

Flag burning is generally not illegal in the NAU, though tearing down flags in public or private areas and destroying them could count as vandalism. Causing public alarm if burning it in a public place depending on the circumstances could count as disorderly conduct.
